REGULAR CITY COMMISSION MEETING A. CALL TO ORDER Mayor Vandergrift called the regular session to order at 7:15 p.m. in the Commission Chambers of City Hall. Commissioner Parker gave the Invocation and Gloria of the Sweet Adelines, led the Pledge of Allegiance to the Flag. City Clerk Eikenberry called roll and declared a quorum present. Roll Call: Mayor Vandergrift, Commissioner Anderson, Commissioner Howell, Commissioner Johnson, and Commissioner Parker. Also Present: City Manager Frank, City Attorney Rosenthal, and City Clerk Eikenberry. B. PRESENTATIONS AND PROCLAMATIONS Proclamation — Sweet Adelines International Week/Day — July 11th-18th. (Mayor Vandergrift) C. COMMENTS FROM CITIZENS/PUBLIC Tony Bushert, Sleepy Harbor— asked about the plans for the new Post Office that may be built in Ocoee and City Manager Frank advised it is in the preliminary stages and we are trying to get new contacts at the Post Office for Ocoee residents because the contact person they gave us is on extended vacation. We will post the information on OGTV. James Fleming- 511 Worth Avenue, questioned some of the Code Enforcement processes in the City and said Code Officers should be advised not to trespass on private property without the owner's permission. He also said he did not agree with the changes that were made to the Board during the last Commission Meeting. D. COMMISSIONERS ANNOUNCEMENTS/CORRESPONDENCE Commissioner Howell—no comments Commissioner Anderson- the new stop sign at Lady Avenue and Marlene Drive is blocked by Crepe Myrtles and difficult to see. Public Works Director Zaitooni advised they would look at it tomorrow morning and trim them, if necessary. Commissioner Johnson- The Ocoee High School baseball program is having a golf tournament at Forest Lakes this Saturday at 1:00 p.m., sign up and lunch is at noon, and it is $65.00. They have offered a free foursome to City staff. He said to ask interested employees if they would like to participate. Commissioner Parker — said Homes In Partnership, Inc. is celebrating their 30th anniversary with an appreciation banquet on Thursday, October 20, 2005. City Commission Regular Meeting July 5,2005 Commissioner Parker, seconded by Commissioner Johnson, moved to approve that the City purchase a Corporate Table and eighth-page advertisement for the Homes In Partnership Banquet, expending $750.00 from the Commission Contingency Fund. Motion carried 5-0. Mayor Vandergrift — said the Turnpike Authority is having an open house Tuesday, July 26, 2005, at 5:30 p.m. at the Turkey Lake Service Plaza, where they will be discussing the widening of approximately 10 miles of the turnpike in Orange County. E. CONSENT AGENDA 1. Approval and Acceptance of the Regular City Commission Minutes of June 21, 2005. (City Clerk Eikenberry) 2. Appointments of Mark Lippman and Charles Lawrie to the Citizen Advisory Council for the Ocoee Fire Department(CACOFD). (City Clerk Eikenberry) There are currently nine (9) members serving on the CACOFD and the board is meeting with less than fifteen (15) members with Commission's approval. Two (2) applications were recently submitted for the CACOFD; therefore, staff recommends the Honorable Mayor and City Commission consider appointing Mark Lippman and Charles Lawrie to the CACOFD with terms ending November 2008. 3. Consideration of Resignation of Member John Grogan, Removal of Member Edward Johnson, and Appointment of Two (2) New Members From Open Applications for the Education Commission. (City,Clerk Eikenberry) Members of the Education Commission serve two-year terms. Currently the Education Commission has fourteen(14)members and their resolution allows no less than seven(7)members and no more than fifteen(15) members. The City's Education Commission is recommending that the City Commission accept the verbal resignation of Mr. John Grogan; remove Mr. Edward Johnson for lack of attendance; and appoint Sherri Blank and Rosalie Wells to the Education Commission with terms ending August 2007. 4. Resolution Adopting Railroad Reimbursement Agreement, Crossing #621878-V on N. Bluford Avenue. (Public Works Director Zaitooni) The Florida Department of Transportation (FDOT) will be funding a safety project in their work program to upgrade the detection system for the railroad signals on Crossing#621878 located on N. Bluford Avenue,south of at Rewis Street. The Florida Department of Transportation requests that the City of Ocoee approve the Railroad Reimbursement Agreement between the City, the Florida Department of Transportation, and the Florida Central Railroad,Inc. for this improvement. RESOLUTION NO.2005-007 A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A RAILROAD REIMBURSEMENT AGREEMENT FOR THE INSTALLATION OF UPGRADED GRADE CROSSING TRAFFIC CONTROL DEVICES AND FOR THE FUTURE MAINTENANCE AND ADJUSTMENT OF SAID DEVICES BETWEEN THE CITY OF OCOEE,THE FLORIDA DEPARTMENT OF TRANSPORTATION,AND THE FLORIDA CENTRAL RAILROAD, INC. FOR THE CROSSING NO. 621878-V ON N. BLUFORD AVENUE; PROVIDING AN EFFECTIVE DATE. 5. Consideration of Short Plat of Sawmill Lot 11. (City Engineer Wheeler) This short plat is for Sawmill Lot 11, which consists of splitting one lot of single-family residential development into two lots. Consideration of Contract for Utility Management and Operations Service with Dyer, Riddle,Mills'& Precourt,Inc.''(City Manager Frank) Commission approved the expenditure of funds up to $25,000 for Utilities Director consulting services at the April 19th Commission Meeting. The process to hire a Utilities Director took longer than originally anticipated. Additional expenses of$16,400 were incurred before successfully hiring Charles Smith as the new Utilities Director. 7. Consideration of Richfield Subdivisions MVP Grant Application. (Multimedia/Community Events Manager Elliott) At the City Commission Meeting on March 1, 2005, the Commission approved allowing the Richfield Subdivision to submit a late MVP Grant application as there was still funding remaining within the account. However, Commission made it contingent upon the project coming back before Commission for approval prior to implementation. 8. Consideration to Award Bid #B05-10, Replacement of Community Center Air Conditioning System. (Purchasing Agent Tolbert) The scope of work includes removal of the existing three(3)7.5-ton units and appurtenances,and installation of three(3)new 7.5 ton Trane or equal units and appurtenances. The budget includes $30,000 for this project. The bid was publicly advertised on May 15, 2005, and opened on June 15, 2005. There were five (5) responses to this bid. The Public Works Department and Finance Department have reviewed all bids. Staff recommends awarding the bid to Apple Air Conditioning&Heating,Inc. as the most responsive and responsible bidder. 9. Living Waters Church Special Exception Application Fee Waiver. (Principal Planner James) The Living Waters Church is applying for a Special Exception and requests a waiver of the application fee under the "Policy for Non-Profit Organizations Wishing to Request a Waiver of Development Review Application Fee"approved by the City Commission on February 18,2003. The Church has submitted a written request and the necessary documents to prove its non-profit status. The church is requesting the waiver of the Special Exception application fee of$1,000. The church will be required,under the above policy,to submit the $1,000 Review Deposit for the application. City Attorney Rosenthal read the resolution for Consent Agenda Item#4, adopting Railroad Reimbursement Agreement. Consent Agenda Vote: Commissioner Parker, seconded by Commissioner Johnson, moved to approve Consent Agenda, Items #1 through #9, including Resolution No. 2005-007 under Item #4. Motion carried 5-0. F. PUBLIC HEARINGS -None G. REGULAR AGENDA 10. Appointments to the Code Enforcement Board. (City Clerk Eikenberry) The board consists of seven (7) regular members and two (2) alternate members. Chairman John Linebarier (District 2) resigned effective May 17, 2005, leaving a regular member opening on the board and Member Konicek (District 3) resigned effective June 27, 2005, leaving an alternate member opening on the board. Applicants, James Morton and Steven Ballard, both from District 2 have indicated interest in serving on the Code Enforcement Board. Commissioner Johnson asked if we could table this item until the next meeting, he has some interested residents in his district that would like to participate on this board and he would like to include their applications. Page 3 of 5 City Commission Regular Meeting July 5,2005 11.Discussion Re: City of Ocoee 80th Birthday Celebration. (Mayor Vandergrift) Mayor Vandergrift said the City is 80 years old this year and he would like to discuss how we should celebrate it. Commissioner Anderson said the gazebo was built in the past in honor of the City's 60th Birthday, and we might want to look into refurbishing it and replacing the roof. Commissioner Parker suggested holding a celebration there again this year with a "re-raising" of the gazebo and a ribbon cutting ceremony with a giant birthday cake. City Manager Frank asked if we wanted to include something, such as a float, in the Founder's Day event to commemorate the 80th Birthday, and the consensus of the Commission was to have also staff look into that. 12. Discussion Re: Naming of New Seniors'/Veterans' Center. (Mayor Vandergrift) Consensus of the Commission was to direct the Community Relations Division work on a method that would include city residents' input into the naming of the Center. Commissioner Howell suggested that it be named after Tommie Sanders, and Commission Parker agreed that if we were going to name it in someone's honor, it should be Tommie. H. STAFF REPORTS - none I. COMMENTS FROM COMMISSIONERS Commissioner Anderson — read part of an email from Henry Morgan at 304 S. Lakeshore Drive, and asked about the garbage haulers spilling liquids in the street when they pick up garbage, and about the age of their trucks. He said they were supposed to use trucks that were 5 years old or less and they appear to be using much older trucks on a regular basis. Public Works Director Zaitooni said liquids would sometimes leak out when the garbage is being compacted, and he will look into the spills reported by Mr. Morgan. Mayor Vandergrift asked about holiday pickup schedules for garbage, to which Public Works Director Zaitooni said they have four holidays that they do not pick up (Thanksgiving, Christmas, New Year's and Forth of July). Mr. Zaitooni agreed to have that information placed in the "News to You" to remind residents. Commissioner Howell—none Commissioner Johnson-1) asked about getting a new rate schedule for all of the City facilities that are rented. City Manager Frank said he has been discussing formulating a comprehensive resolution that would cover all charges in the recreation programs and it can be brought back to the Commission in that form, 2) said we need to find a way to control the boaters at Starke Lake on the weekends. Boaters are running their boats up on the shoreline near kids and others who are in the picnic area. He said we should consider requiring (free) permits for City residents and charge non-residents a fee to use the ramp, and we need enforce safety issues in areas where boats are prohibited due to swimmers or picnickers; and 3) asked if the recreation impact fees can be used to purchase bleachers for Ocoee High School for the football season starting in September. Mayor Vandergrift said he talked to previous Parks and Recreation Director Farmer about the cost of possibly renting bleachers to get them through this season. City Page 4 of 5 City Commission Regular Meeting July 5,2005 Manager Frank said Finance Director Horton, City Attorney Rosenthal, and he will look into what portion of Impact Fees, if any, can be used for assisting the school. Mayor Vandergrift read a live email from Frances Watts asking if seniors can be a part of naming the new SeniorNeteran's Center, and Ms. Watts also welcomed Commissioner Johnson back. Commissioner Anderson— said the retention pond at the Christian Service Center is overgrown and asked if the City can assist. The consensus of the Commission, without objection, was to have the City help with the clean up of the retention pond at the Christian Service Center. Commisisoner Parker—none Mayor Vandergrift — distributed several emails and said they are trying to form a Lake Watch Committee, and asked Commission if they feel we are at the point of declaring permanent "No Wake Zones" to prevent erosion of the lake and water on the road around Starke Lake. Public Works Director Zaitooni said they are watching it constantly and does not feel that there is a need to take any immediate action. He said he would address the issue of the tree roots being exposed. Commissioner Anderson asked about placing buoys out to designate certain swimming areas. Public Works Director Zaitooni said he would like to check into options and make sure we are not violating any rules from water management authorities. City Manager Frank added we would make sure there are no liability issues. Commissioner Anderson read a live email from resident Rick Roberts, 208 East Silver Star Road, which suggested all boaters should be charged a launch fee, and officers should patrol the boat ramp area on the weekend. Parker, District 4 MEMORANDUM TO: Robert Frank, City Manager FROM: Tonya Elliott, Multimedia/Community Events Manager DATE: July 19, 2005 RE: Senior/Veteran Service Center Naming Survey After our last commission meeting on July 5, 2005 staff was given direction to put together a survey for the community regarding the naming of the Senior/Veteran Service Center and bring back the results by the commission meeting taking place on July 19, 2005. Since then staff created a survey instrument and placed it on the city's website and OGTV. Surveys were also placed at the Jim Beech Recreation Center and the City Hall Receptionist's Desk. Surveys were also given to the West Orange Chamber for distribution to their membership. To date the City has received 42 completed surveys. He soon became school principal and teacher. He was also Postmaster and Justice of the Peace. In 1913 he bought a home on West Oakland Avenue and converted one of the rooms into a library, which he allowed the community to use. Mrs. E. D. Perkins She was the original schoolteacher at Ocoee's first school, which was established in 1880. William T Withers Supplied the materials for the building Ocoee's Christian Church, the oldest existing Christian church still in use in Florida. David Maguire Cultivated the Citrus Industry in Ocoee and Central Florida Citizens Who Have Contributed to the City over the Years: Tommie Sanders Worked hard to gain programs and services for Veteran's in Ocoee. Fought hard to erect the Ocoee War Memorial Frances Watts Has been persistent over the years in championing causes in Ocoee that serve and benefit the needs of seniors John Linebarier Has been the most active community member on Citizen Advisory Boards in recent years. He has served on citizen advisory boards since the early 80's to the present. Ellis Shapiro Former City Manager and long time resident who shaped Ocoee, as we know it. Was City Manager for the Clarke Road and Maguire Road projects. Building of Water and Sewer Plants, the West Oaks Mall, and Health Central. Harold Maguire Former mayor and member of one of the long-standing families in the city Harold Switzer Chairman of the Planning & Zoning Board for many years when the City was building all its major infrastructure and approving countless developments. Tom Ison Former Mayor Betty Irvine Ocoee resident (Sleepy Harbor condos)who has always championed protection of the City's historical resources. Betty was instrumental in both the Maguire House and the Christian Church being put on the National Register of Historic Places. Doc Pounds Long time city resident, served in public office and also headed up civic organizations. Jim Beech Former Recreation Director and long time city resident, helped establish many of the recreation programs and parks that the City still uses today. Most of the kids he first worked with probably have kids of their own now. He really worked tirelessly and devoted much of his time to giving children opportunities to recreate. He also started our senior's program. Elizabeth Maguire Wife of Harold Maguire who also has been involved in the Historical Commission, most likely since its inception. Lives with her daughter in downtown Ocoee. Nancy Maguire Also a strong proponent of historical properties in Ocoee. Lives in downtown Ocoee. (Harold and Elizabeth's daughter). Lester Dabbs He has been a long time resident of the city, plus served as mayor and on several other city committees and is still active in providing his opinions on many subjects that come before the City. He has also played an important role in the reconciliation task force. Mayor Vandergrift Has been hugely popular with the electorate. Part of the reason the city has really made headway with the Orange County School Board
