STAFF REPORT
TO:
The Honorable Mayor and City Commissioners
FROM:
Bob Zaitooni, Director of Public Works
DATE:

RE:
Request for Assignment of Contract, RFP#03-001-Residential Collection
ISSUE
Should the Honorable Mayor and City Commission approve a request by Waste Services of Florida, Inc. (WSI)
for assignment of Residential Collection Contract (RFP #03-001) to Waste Pro?
BACKGROUNDIDISCUSSION
Waste Services of Florida, Inc., the current City's hauler for the Residential Collection (garbage and recycling)
has requested assignment of the Contract to Waste Pro per Section 16 (A) of the Contract RFP#03-001, which
states:
"This Agreement and the rights and privileges shall not be assigned or otherwise transferred
by Contractor except with the express written approval of the City. The City reserves the
right in its sole and absolute discretion to approve or disapprove any such requested
assignment or transfer of this Agreement."
The primary reason stated by WSI for the request to assign the contract is "... divesting certain aspects of our
business and the City of Ocoee is part of that divestiture." Staff has evaluated the request from WSI and has
formulated City's options in response to this request.
WSI Performance
WSI was awarded the contract for the residential collection through a competitive process and began operations
in Ocoee in June 2004. The terms of the Contract involved 5 years with an optional2-year extension.
The rate charged by WSI is $10.98 per household for garbage (twice per week) and recycling (once per week).
This unit price was the lowest amongst the 6 proposals received by the City as summarized in the table below.
As per the terms of the contract, rates are subject to a 3% adjustment in years 3 through 5.
Advance Republic *Waste Onyx
Dis osal Services Pro Base & Alt. 1
$13.99 $12.35 $14.23 $13.78 $11.63
* Proposed graduated rate. Year 4 rates are shown.
A performance summary for the first 12 months of service for WSI is attached to this report. Beyond the
quantifiable statistics (misses, broken carts, etc.) as noted in the summary, the overall qualitative assessment of
the performance has been judged as "poor to fair" on a scale of "poor to excellent" based upon the number of
complaints received from the customers. The qualitative issues include, but not limited to leaving carts in the
road, leaving carts in front of the mail boxes, leaving carts in the middle of driveway, not collecting extra
garbage (even after a holiday), throwing bins, speeding, hydraulic spills, etc.
Waste Pro's Credentials
A package containing Waste Pro's credentials is included with this staff report, which provides list of existing
customers and references. A selected list of comparable municipal customer include:
. City of Fort Pierce - residential recycling
. City of Longwood - residential garbage, recycling, and yard waste
. City of Palatka - residential recycling
. Putnam County - residential garbage, recycling, and yard waste
. 81. Lucie County - residential garbage, recycling, and yard waste
. Seminole County - residential garbage, recycling, and yard waste
City's Potential Options
1. Approve Contract Assignment - City Commission may approve the assignment of the contract as requested
by WS1. If this option is chosen, staff recommends negotiations with Waste Pro to insert several performance
security measures currently not in the Agreement as provided below:
. Insert semi-annual performance evaluation subject to contract termination or renewal by the City
Commission on anniversary date of the assignment, providing for transition period of four (4) months to
a new hauler.
. Waste Pro to submit a list of active and spare equipment to be used in Ocoee on permanent basis subject
to initial certification and regular inspection by staff.
. Require Waste Pro to train their drivers on quality of service and customer service issues.
. Consider negotiating and addition of extra bag concept to Ocoee service.
2. Disapprove Contract Assignment - City Commission may disapprove assignment of service and require
execution of the terms of the Contract with WS1.
Other Considerations
City's current commercial and yard waste contracts with will expire in August 2006. City has the option of the
(1) extending contracts for another 2 years, or (2) may negotiate lesser term transition service until a new
contract is set in place through an RFP process.
As an alternative solution, City Commission may also consider negotiation with WSI to extend their service
through August 2006 while preparing a new RPF for all services (commercial, residential C & D, and
residential curbside) to become effective upon termination of the current commercial and yard waste contracts.
This option may be attractive to consider for the City due to combined overall services and potential savings to
the City.
RECOMMENDA TION
Staff respectfully requests that the Honorable Mayor and City Commission to consider the options provided in
the staff report, consider background information and analysis, and provide direction to staff.

Re: Section 16 Assignment or Change of Control
Dear Bob,
Thank you for the opportunity to meet and discuss the request for assignment of our
current Residential Garbage & Recycling Collection & Disposal RFP #03-001 to Waste
Pro.
This letter is requesting formally the assignment of Florida Recycling / Waste Services of
Florida to Waste Pro. As discussed yesterday,'Waste Services of Florida is divesting
certain aspects of our business and the City of Ocoee is part of that divestiture.
Per our meeting; Waste Pro was selected by Waste Services of Florida based on their
ability to provide top levels of service. Several packets of information regarding Waste
Pro were provided at our meeting and I would trust you will research their qualifications.
Upon the assignment being granted, Waste Services and Waste Pro will work diligently
to ensure a smooth and transparent transition for all parties concerned. If you should
have any questions and or need additional information, please contact me at 407-831-

To'Whom It May Concern:
(
Waste Pro of Florida, Inc. (Waste Pro) has been providing residential garbage, yard trash,
and recyclables collection to Putnam County since Aprill, 2004. Waste Pro acquired the
Putnam County contract from Waste Management, Inc. after approval by the Putnam
County Board of County Commissioners. Putnam County agreed to this contract
assignment largely because of the prior experience we had with Waste Pro personnel
several years ago, as well as the very competitive rate they have offered. Mr. John
Jennings, Mr. Fred Wood, and Mr. Dave Danford provided superior customer service to
Putnam County. They are a remarkably responsive and conscientious group of peoRle.
In our current contract, Waste Pro appears to be on track to provide the same superior
service we have seen in the past. I highly recommend Waste Pro to provide curbsid,e
residential collection service for your County or your City.
Sincerely,
~~

take care of us and they are doing a wonderful job. Whatever we asked of them they do
in a timely manner.
Joe Wilson, our sales rep from Waste Pro is a real go getter and he handles everything we

Dear Mr. Danford:
(: The Town of'Windermere awarded Waste Pro a 2 year Solid Waste Contract on September
10, 2002. The transition to the new Company has been a great experience. After the contract was
awarded the next several days Waste Pro was in Town introducing the employees and checking
routes so they would be familiar with our Town before the sta,rt date of October 1,2002.
As expected in the beginning there were a few missed residents. Waste Pro was very .
receptive and corrected the problem right away.
The Town of Windermere would recommend Waste Pro to any municipality or private
business. . -

Dear Mayor Grant:
It is my understanding that the Town ofEatonville is in the process of soliciting proposals for the
provision of solid waste collection services in Eatonville. The City of Lake Helen recently
completed solicitation of proposals for similar services and, after lengthy interviews with the
proposing firms, selected Waste Pro to be its solid waste collection and recycling services
provider for the next five years.
/
Because Lake Helen had been provided service by another company since the early 1990's, and
because Lake Helen's residents were obviously used to and satisfied with the collection methods
and routines of that company, it was very important that Waste Pro be able to make a smooth
transition between services provided by themselves and those of previous service provider.
Waste Pro undertook this task with diligence. Its employees took time to fumiliarize themselves
with the town, its residents and its businesses.. Collection routes were analyzed and ultimately
established for efficiency and timeliness of collections (which resulted in initiating collections
later in the morning and completing collections earlier in the afternoon). Waste Pro employees
maintained close contact with City administrative personnel at all times during the transition
process to solicit stafI's input and to advise staff of Waste Pro's activities and progress.
Waste Pro also provided commercial customers with brand new dumpsters and purchased new
waste collection vehicles customized for speci:fi9 residential and for commercial waste collection
needs in Lake Helen. The provision of new dumpsters and new collection vehicles has really
helped to improve the visual image of the City.
When Waste Pro began collecting waste in. Lake Hele~ it did so in a very professional manner,
with minimal service problems. What few service problems arose, as a result of the transitio~
were addressed immediately, willfugly and professionally. In fact, there have been instances
where the driver of a collection vehicle has noticed that a resident has not put his/her garbage or
recyclables out for collection and the driver has made several trips past the residence during the
course of the collection day to insure that the resident was provided collection service that day.

That kind of tale usually
ends predictably enough, with
a disgruntled householder
cursing both the fates and the
local trash collector.
But this time, the truck driv-
er croising the streets of Wm-
dermere backed up to the for-
. lorn woman. A helper jumped
down and whisked the bottles
and plastic away.
That's the kind of customer
semce that John J. Jennings,
owner of Waste Pro, a garbage

three states, wants to give.
Good seIVice keeps resi-
dents happy and allows him to
command higher prices than
some of his corporate competi-
tors, Jennings said.
But how do you motivate
employees?
For Jennings, the answer is a
combination of self-esteem
building ~d financial incen-
. tives. It includes overtime pay,
an array of bonuses and month-
ly company parties-cum-moti-
vational meetings that put ev-
eryone on the team and make
good service a shared goal.
The recent Wmdermere in-
cident, for example, resulted in
the grateful woman writing a
letter of commendation to
Waste Pro's offices. So, at the
.. next monthly meeting, the driv-
er and helper each got a
"Franklin Award" - so-named
for the portrait of Benjamin
Franklin on the front of the
$100 bill that each man got.
At the company's Longwood
headquarters, there's a month-

members are invited.. Ifs a

The results of good worker

said.
"You go up to a store at

In contrast, Nelson cited
Southwest Airlines, where, af-
