Background Summary:
The project as bid did not include a electrical service drop to provide power to the irrigation system
and the fountain, irrigation on the high school side of Ocoee Crown Point Parkway, nor
maintenance of the landscaping until the project is accepted by the City. These items are
necessary to provide a complete project that meets the expectations of the City. Details of the
• proposed changes are included in the attached copy of the Change Order No. 3. The amount of
the change order is an increase of$78,063.00, with an increase in contract time of 14 days.
Issue:
The Engineering Department has proposed a change to the Ocoee Crown Point PUD Phase 1
Infrastructure project and requests the City Commission approve Change Order No. 3 with Master
Site Development, Inc. in the amount of an increase of $78,063.00, with an increase of 14 days in
contract time.
Recommendations
The Engineering Department recommends that the City Commission approve Change Order No. 3
for the additional work and increase the construction contract by $78,063.00, with an increase of 14
days in contract time, and authorize the Mayor and City Clerk to execute the change order.

Financial Impact:
This change order will be funded by the City of Ocoee from the Ocoee Crown Point PUD project
fund. According to the agreement with the Orange County Public Schools they are not participating
in the landscape/hardscape cost in the overall project.

ISSUE
The Engineering/Public Utilities Department requests that the City Commission approve Change Order No. 3
with Master Site Development, Inc. on the Ocoee Crown Point PUD Infrastructure Project for the installation an
electrical drop to provide power to the irrigation system and the fountain, installation of irrigation around pond
8 and on the high school side of Ocoee Crown Point Parkway, and for the maintenance of the landscaping until
the project is accepted by the City in the amount of an increase of$78,063.00, with an increase of 14 days in
contract time.
BACKGROUND/DISCUSSION
The Ocoee Crown Point PUD Phase 1 Infrastructure project will install the roadway and utilities for the first
phase of the development. That first phase is for the new Ocoee High School. The water main extension into
the Ocoee Crown Point PUD development was to connect to the water main installed for the Westyn Bay
development. The water main from Ocoee-Apopka Road to Westyn Bay Boulevard was constructed as a 20-
inch diameter pipeline and the pipeline that turned into the Westyn Bay development was a 12-inch pipeline.
Based upon a review of the plans it was assumed that the pipeline across Westyn Bay Boulevard was a 20-inch
pipeline; the drawings did not label this pipeline, they only showed the pipeline to be constructed.
The original bid for the phase 1 infrastructure did not include a design or bid item for the electrical service for
the irrigation system and fountain. The service drop could not be tied into the lift station electrical service
because the lift station is operated by Orange County Utilities. The new service drop was placed near the lift
station so that the landscaping could be used as a screen for the transformer and control boxes.
The original bid did not show landscaping and irrigation on the high school side of the road because it was
envisioned that the Orange County Public Schools would be including that area in there landscaping and
irrigation plan. This was an incorrect assumption. Therefore, the City needed to add in as a minimum,
irrigation for the sod within the road right-of-way and to size it appropriately if the City decided to install other
landscaping after the school is completed and/or when future phases of the development come along.
The original bid had line items for furnishing and installing the landscaping but there was no mention of
maintenance of the landscaping until the entire project is accepted by the City. It would not be a good idea to
have the City start tiittintaining the landscaping until the contractual obligations for the entire project have been
met.
The total cost for these three items is $78,063.00 with an increase in contract time of fourteen days. The change
order is attached for review.

CHANGES ORDERED:
I. GENERAL
This change order is issued pursuant to the applicable provisions of the Contract Documents and is intended
to provide an equitable adjustment in the Contract Sum to accommodate an unprecedented market
condition.
II. REQUIRED CHANGES
Item A: Provide and electrical service for the fountain and the irrigation controller.
Item B: Provide irrigation for the school side of Ocoee Crown Point Parkway including road crossings.
Item C: Provide maintenance of the landscaping after installation up to acceptance of the project.
III. JUSTIFICATION
Item A: The project plans and specifications did not include a design for the electrical service drop for the
irrigation controls and the fountain.
Item B: It as envisioned that the high school project would include landscaping and irrigation along their
side of Ocoee Crown Point Parkway. The high school plans did not address landscaping or
irrigation off-site. Therefore provisions needed to be made to sod and irrigate the high school side
of the road right-of-way.
Item C: The project plans and specifications did not include maintenance of the landscaping until the
project was accepted by the City
IV. NARRATIVE OF NEGOTIATIONS
All three items were negotiated based upon required work,materials,equipment,and manpower needed. Based
upon the estimated scope,the work was reduced to provide only the minimum required.

VI.APPROVAL AND CHANGE AUTHORIZATION
This proposed change to the Contract is to be approved by the Ocoee City Commission.
Acknowledgements:
The aforementioned change,and work affected thereby,is subject to all provisions of the original contract not
specifically changed by this Change Order;and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original
contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in
Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and
modifications of performance time incurred by the CONTRACTOR as a result of this Change Order and/or relating
to or arising out of the reasons and justifications for this Change Order.. No other claim for increased costs of
performance or modifications of time will be granted by the OWNER for the Work covered by this Change Order.
Nothing contained in this action by the City shall be deemed to constitute a waiver or an estoppel to assert its rights
or remedies under the Contract Documents nor shall it be deemed to set a precedent for an equitable adjustment for
any other materials required by the Work. The CONTRACTOR hereby waives and releases any further claims for
cost or time against the OWNER arising from or relating to the matters or Work set forth or contemplated by this
Change Order and/or relating to or arising out of the reasons and justifications for this Change Order.

David,
The original scope of work involving Crown Point Parkway on the bid set of drawings
designated the irrigation only to be installed in an area on one side of the highway.
During construction of the project,we noticed new trees,shrubs, and landscaping were
being installed on the opposite side of the street as well.
We sent an RFI to the City of Ocoee concerning this issue and were instructed to meet
the requirements of irrigating the new landscape design. We proceeded with the work and
submitted for an increase in our contract amount on change order request#3 as
"additional irrigation".
