Background Summary: Metroplan, the regional transportation-planning agency, has asked its municipal members to adopt a resolution that supports enforcement of laws pertaining to crosswalks within the Orlando Metropolitan area. Issue: The Orlando Metropolitan area has one of the highest pedestrian fatality and injury rates in the nation. Metroplan has asked that its municipal members adopt an ordinance in support of enforcing crosswalk laws. Recommendations Staff respectfully recommends that city commission adopt the resolution in a show of support for the continuation and stressing of crosswalk laws and their enforcement. Parker, District 4 STAFF REPORT TO: The Honorable Mayor and City Commissioners FROM: Robert Frank, City Manager DATE: May 10, 2005 RE: Adoption of METROPLAN Orlando Crosswalk Resolution ISSUE The Orlando Metropolitan area has one of the highest pedestrian fatality and injury rates in the nation. METROPLAN Orlando has asked that its municipal members adopt a resolution in support of enforcing crosswalk laws. BACKGROUND/DISCUSSION METROPLAN Orlando, the regional transportation-planning agency for Orange, Osceola, and Seminole Counties, has asked its municipal members to adopt an ordinance that supports enforcement of laws pertaining to crosswalks within the Orlando Metropolitan area. RECOMMENDATIONS Staff respectfully recommends that city commission adopt the resolution in a show of support for the continuation and stressing of crosswalk laws and their enforcement in partnership with METROPLAN Orlando. RESOLUTION NO. 2005- A RESOLUTION OF THE CITY OF OCOEE,FLORIDA, SUPPORTING ENFORCEMENT OF FLORIDA'S CROSSWALK LAWS IN THE ORLANDO METROPOLITAN AREA; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Orlando Metropolitan Area has one of the highest pedestrian fatality and injury rates in the nation; and WHEREAS, pedestrian safety is the responsibility of motorists as well as the pedestrians themselves; and WHEREAS, pedestrian safety is a component of both good design and enforcement of traffic laws; and WHEREAS, pedestrians must feel confident that motorist will yield to them if crosswalks are to be useful as a safety tool; and WHEREAS, based on a survey of Orlando Metropolitan Area residents, over 93%of adults support law enforcement professionals giving tickets to motorist who fail to stop or yield for pedestrians in crosswalks; and WHEREAS, the Florida Statues states that "When traffic controls signals are not in place or in operation, the driver of the vehicle shall yield the right-of way, slowing down or stopping if need be so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OCOEE,FLORIDA,AS FOLLOWS: The City Commission now hereby declares its support for the enforcement of Florida Statute 316.130 paragraph 7. 006.106966.1 SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Resolution pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
