Infrastructure Project
Background Summary:
The Ocoee Crown Point PUD Phase 1 Infrastructure project includes the installation of the roadway
and utilities for the first phase of the development. The water main extension into the development
connects to the water main installed for the Westyn Bay development. When the contractor was
installing the new pipeline, it was discovered that the pipeline across the entrance to Westyn Bay
was only 12 inches in diameter. Staff and VHB, Inc., the design engineer, determined that the short
section of 12-inch pipeline would not allow for meeting fire flow requirements at the new school.
Therefore it was determined that the 140 linear feet of 12-inch pipeline needed to be replaced.
Details of the proposed changes are included in the attached copy of the Change Order No. 2. The
amount of the change order is an increase of $55,360.00, with an increase in contract time of 14
days.
Issue:
The Engineering/Public Utilities Department has proposed a change to the Ocoee Crown Point
PUD Phase 1 Infrastructure project and requests the City Commission approve Change Order No.
2 with Master Site Development, Inc. in the amount of an increase of $55,360.00, with an increase
of 14 days in contract time.
Recommendations
The Engineering/Public Utilities Department recommends that the City Commission approve
Change Order No. 2 for the additional work and increase the construction contract by $55,360.00,
with an increase of 14 days in contract time, and authorize the Mayor and City Clerk to execute the
change order.

Financial Impact:
This change order will be funded in part by the City of Ocoee from the Ocoee Crown Point PUD
project fund and Orange County Public Schools in accordance with the agreement between both
parties. The Ocoee share is 51.8% or $28,576.48 and the OCPS share is 48.2% or$26,683.52.

ISSUE
The Engineering/Public Utilities Department requests that the City Commission approve Change Order No. 2
with Master Site Development, Inc. on the Ocoee Crown Point PUD Infrastructure Project for the installation of
140 linear feet of 16-inch water main to replace a 12-inch water main in the amount of an increase of
$55,360.00, with an increase of 14 days in contract time.
BACKGROUND/DISCUSSION
The Ocoee Crown Point PUD Phase 1 Infrastructure project will install the roadway and utilities for the first
phase of the development. That first phase is for the new Ocoee High School. The water main extension into
the Ocoee Crown Point PUD development was to connect to the water main installed for the Westyn Bay
development. The water main from Ocoee-Apopka Road to Westyn Bay Boulevard was constructed as a 20-
inch diameter pipeline and the pipeline that turned into the Westyn Bay development was a 12-inch pipeline.
Based upon a review of the plans it was assumed that the pipeline across Westyn Bay Boulevard was a 20-inch
pipeline; the drawings did not label this pipeline, they only showed the pipeline to be constructed.
Since this pipeline was in the Orange County Utilities service area, contact was made with OCU and they
basically stated that it was a 20-inch diameter pipeline. When the contractor was installing the new pipeline
was when it was discovered that the pipeline across the entrance to Westyn Bay was only a 12-inch pipeline.
Staff and VHB, Inc., the design engineer, determined that the short section of 12-inch pipeline would not allow
for meeting fire flow requirements at the new school. Therefore it was determined that the 140 linear feet of
12-inch pipeline needed to be replaced. Staff and VHB, Inc. determined that using 20-inch diameter pipe would
meet fire flow requirements. The installation of the 20-inch pipeline cost $55,360.00 with an increase in
contract time of 14 days.
The change order is attached for review.

CHANGES ORDERED:
I. GENERAL
This change order is issued pursuant to the applicable provisions of the Contract Documents and is intended
to provide an equitable adjustment in the Contract Sum to accommodate an unprecedented market
condition.
II. REQUIRED CHANGES
Item A: To replace the existing 12-inch water main across the entrance to the Westyn Bay subdivision with
a 20-inch water main,which is required.
III. JUSTIFICATION
Item A: The water main installed across Westyn Bay Boulevard as part of the Westyn Bay development
was assumed to be a 20-inch pipeline. This information was based upon plan review and discussions with Orange
County Utilities, who operates the water main. The water main was installed as a 12-inch diameter pipeline.
Because of the fire flow requirements for the new high school the 140 linear feet of 12-inch pipeline needed to be
replaced to meet the fire demand.
IV. NARRATIVE OF NEGOTIATIONS
Item A: Bid amounts were used where applicable and pay items not on the original bid schedule were
negotiated.

VI. APPROVAL AND CHANGE AUTHORIZATION
This proposed change to the Contract is to be approved by the Ocoee City Commission.

Acknowledgements:
The aforementioned change,and work affected thereby,is subject to all provisions of the original contract not
specifically changed by this Change Order;and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original
contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in
Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and
modifications of performance time incurred by the CONTRACTOR as a result of this Change Order and/or relating
to or arising out of the reasons and justifications for this Change Order.. No other claim for increased costs of
performance or modifications of time will be granted by the OWNER for the Work covered by this Change Order.
Nothing contained in this action by the City shall be deemed to constitute a waiver or an estoppel to assert its rights
or remedies under the Contract Documents nor shall it be deemed to set a precedent for an equitable adjustment for
any other materials required by the Work. The CONTRACTOR hereby waives and releases any further claims for
cost or time against the OWNER arising from or relating to the matters or Work set forth or contemplated by this
Change Order and/or relating to or arising out of the reasons and justifications for this Change Order.
