HomeMy WebLinkAbout11-27-2018 Minutes CITY OF OCOEE Code Enforcement Board November 27,2018 I.CALL TO ORDER Chairman Lowery called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Vice-Chairman Carrington initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Lewis led board in the Pledge of Allegiance to the U.S.flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared quorum (4) present. PRESENT: Chairman Lowery,Vice-Chairman Carrington, & Members Lomneck, Lewis, & Mirza. Also present: Board Attorney Scott Geroge,Support Services Assistant Director Doug Gaines, Code Enforcement Clerk Justin Mieras, and Code Enforcement Officers Ed Loeffler, Carmen Diaz, & Bob Siegrist. ABSENT: Members Murray and Odom are excused absences. D. SWEARING OF OFFICERS/WITNESSES: Code Enforcement Clerk Justin Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. ORDER OF CONTINUANCE: None Vice-Chairman Carrington,seconded by Member Lomneck, moved that the supplemental consent agenda be accepted as presented. Motion carried unanimously. III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS Vice-Chairman Carrington,seconded by Member Lomneck, moved to move Case 2018-00144 to the beginning of the agenda then to return to the scheduled order starting with Case 2018-00099. Motion carried unanimously. CASE NO 2018-00144 OFFICER DIAZ 3 SUNSET KEY CT PAMELA DENISE HARPER Violation Cited: §115-3. B. & §115-3. A. City Code Summary: No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass, undergrowth or other dead or living plant life. No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health,safety and welfare. Observation: Grass/weeds overgrown on property. Miscellaneous trash/debris littering the property. Officer Diaz presented the case and gave its history.Officer Diaz further explained that as of November 27,2018,the property remains in non-compliance.The City asked for an order of compliance within 30 days, or thereafter to be fined $50.00 per day, per violation until found in compliance. Officer Diaz noted the longer compliance timeframe is because the property owner has been in contact with the city and has already made efforts to clean up the property. Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2018-000144, the respondent be found in violation as cited as of November 1, 2018, and be given until December 27, 2018, to come into compliance or be fined $50.00 per day,per violation that remains in non-compliance. Motion carried unanimously. CASE NO 2018-00099 OFFICER SIEGRIST 2410 EL MARRA DR DEVIN GLOVER Violation Cited: §168-6. B. (1) &§165-3.A. City Code Summary: No owner, private property, shall allow the parking of motor vehicles on non-improved surfaces. No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation:Tall weeds and grass;front,side, and rear yards. 2 no-tag wrecked, inoperable white sedans on property. Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of November 27, 2018, the property is still in non-compliance.The City asked for an order of compliance within 10 days, or thereafter to be 2IPai; 4. fined $50.00 per day, per violation until found in compliance. Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2018-00099, the respondent be found in violation as cited as of October 27, 2018, and be given until December 07, 2018, to come into compliance or be fined $50.00 per day, per violation that remains in non-compliance. Motion carried unanimously. CASE NO 2018-00103 OFFICER LOEFFLER 330 NORTHERN DURANGO AVE JOSE RODRIGUEZ Violation Cited: §165-3.A. & §115-3. A. (3)City Code Summary: No person shall keep any abandoned or junk vehicle on any public property or any private property. No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health,safety and welfare. Observation: Mops, mop buckets,gray buckets, trash, litter, bottles, beer cans littering property and leaning against home. Wrecked truck no license tag back side yard. Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of November 27, 2018, the property is still in non-compliance.The City asked for an order of compliance within 15 days, or thereafter to be fined $50.00 per day, per violation until found in compliance. Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2018-00103, the respondent be found in violation as cited as of October 27,2018, and be given until December 07,2018, to come into compliance or be fined $50.00 per day,per violation that remains in non-compliance. Motion carried unanimously. II. OTHER BUSINESS CASE NO 2018-00049 OFFICER LOEFFLER 1897 LESLIE ANN LN. PEDRO J. CARTAGENA Violation Cited: §115-3. B. & §165-3.A.City Code Summary: No person shall allow or permit excessive growth,ten inches or more on property owned,of weeds,grass, undergrowth or other dead or living plant life. No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation:Tall weeds and grass; front,side, and rear yards. 2 no-tag wrecked, inoperable white sedans on property. Officer Loeffler presented the case and gave its history and explained that as of November 27, 2018, the property is still in non-compliance.The City asked for an order imposing fine of$50.00 per day, per violation that remains in non- compliance Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2018-00049 the Board imposes fines and leans of$50.00 per day, per violation that remains in non-compliance beginning November 10,2018. Motion carried unanimously. V. COMMENTS Support Services Assistant Director Doug Gaines reminded the Board their December meeting was cancelled. He 3IPdge wished everyone a happy holiday season and announced our next meeting would be January 22, 2018. The Board Members wished everyone happy holidays.
