Background Summary:
The Ocoee Landings Planned Unit Development (PUD) was approved on October 20, 2015, and consists of a
mixed -use development consisting of 9.15 acres of residential and 6.89 acres of commercial. The residential
portion of the project was approved with a maximum of fifty (50) dwelling units. The typical lot size is 50' x 110'
(5,500 sq. ft.). The minimum living area is 1,400 sq. ft. There are three passive recreation areas with two tot -lots
proposed on the LUP/PSP. The subdivision will be un-gated with public streets. Per the approved PUD, the four
(4) commercial lots will have access on Silver Star Road and Lake Johio Drive. The commercial portion will
consist of 6.89 acres of C-2 (Community Commercial) uses with certain uses (Automobile Sales, Hotel, Motel)
excluded. Special Exception uses allowed will require a Special Exception Site Plan approval before permitting.
The Future Land Use designation is "Low Density Residential" which allows up to 4 dwelling units per acre. On
April 19, 2016, the City Commission reviewed and approved a non -substantial amendment to the PUD/Land
Use Plan for Oak Trail Reserve PUD.
The table below references the future land uses, zoning classifications, and existing land uses of the
surrounding parcels.

DISCUSSION:
There were three (3) waivers from the Land Development Code that were approved. First, the Applicant
received a waiver from Table 5-1 Permitted Use Regulations to allow drive-in restaurants within two hundred
(200) feet of residential property. The reason for the waiver is because of the mixed -use characteristics of the
PUD, the residential lots will be less than 200 feet from the commercial out parcels. The second waiver
approved is for the commercial building setback of 50 feet against residential use to be reduced to 25 feet on
lots 3 and 4 only. Again, the mixed -use characteristic of the PUD makes for a more compact development
pattern. The third and final waiver granted reducing the PUD 25 feet minimum building setbacks for the
residential portion of the PUD. Staff supports all waivers as requested on the LUP/PSP.
The Developer of the PUD has brought in KHovnanian Homes as the builder of the residential section of the
PUD. The builder is requesting a change to the front setback from its current 25 feet to a reduced setback of 20
feet. The request is to provide enough lot coverage for a popular model home which will upgrade the
community. During deliberations at the Planning and Zoning Commission meeting, a compromise was made to
modify the request from a rear yard setback reduction to a front yard setback reduction request.
Issue:
Should the Honorable Mayor and City Commission approve an ordinance for a Substantial Amendment to the
Ocoee Landings PUD Land Use Plan to approve a front yard setback change from 25 feet to 20 feet?
Development Review Recommendation:
The Development Review Committee (DRC) met on November 07, 2018, and reviewed the Amendment to the
PUD Land Use Plan. Staff discussed how the rear yards of the lots drained and if it would have an effect on
properties to the rear. The applicant provided that the lots were approved with "A" type drainage. A drainage of
this type has the water run from the back to the front as opposed to a "B" or C" which has some drainage to the
rear.
When the discussion was finished, the DRC voted unanimously to recommend approval of the Substantial
Amendment to the PUD Land Use Plan for a rear setback from 20 feet to 10 feet (original request).
Planning and Zoning Commission Recommendation:
The Planning and Zoning Commission (P&Z) reviewed the proposed Substantial Amendment to the Ocoee
Landings PUD Land Use Plan on November 13, 2018. Several letters and emails stating an objection were
received from the residents of the Johio Bay and Willows on the Lake Subdivision. During deliberations for the
rear setback reduction, staff and the applicant brought forward a modification to reduce the impacts the
residents had objected to. A new request to reduce the front setback from 25 feet to 20 feet, which would keep
the rear setback at 20 feet, was proposed. The residents agreed, but asked that homes in Ocoee Landings
subdivision adjacent to lots 14 through 25 of Johio Bay subdivision have a requirement to only be single -story.
The Planning and Zoning Commission recommended the following: Motion: Move that the Planning and
Zoning Commission, actinq as the Local Planninq Agency, recommend to the Ocoee City Commission
Approval of the Ocoee Landings Planned Unit Development (PUD) Major Amendment to the PUD;
Project No: RZ-18-09-14, with a recommendation of retaining the rear yard setbacks at 20 feet and
reducing the front yard setbacks from 25 feet to 20 feet; and further, adding a condition that Lots 14
through 25 be limited to only single -story homes, subject to resolution of the remaining staff comments
before the City Commission meeting: Moved by Member Mellen, Seconded by Member Wunderlich; motion
Passed unanimously 3-0 with Chair Keller and Member Bernstein absent.
Staff Recommendation:
Staff recommends that the Honorable Mayor and City Commission approve an ordinance for a Substantial
Amendment to the Ocoee Landings PUD Land Use Plan for a front setback from 25 feet to 20 feet. Staff does
not recommend the City Commission require a new condition of single -story homes along lots 14 through 25 of
the Johio Bay subdivision.

PUD/PSP FOR CERTAIN REAL PROPERTY COMPRISING
APPROXIMATELY 13.74 ACRES LOCATED NORTH OF EAST
SILVER STAR ROAD AND SOUTH OF THE JOHIO BAY
SUBDIVISION PURSUANT TO THE APPLICATION SUBMITTED BY
THE PROPERTY OWNER; AMENDING THE OCOEE LANDINGS
PUD/PSP TO REDUCE THE FRONT YARD SETBACK FROM 25 FEET
TO 20 FEET; FINDING CONSISTENCY WITH THE OCOEE
COMPREHENSIVE PLAN; REPEALING INCONSISTENT
ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the owner of certain real property located within the corporate limits
of the City of Ocoee, Florida, as hereinafter described owner (the "Owner"), has submitted an
application to the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission")
to approve an amendment (the "Amendment") to the Ocoee Landings PUD Land Use Plan and
Preliminary Subdivision Plan, as approved by the Ocoee City Commission on October 20, 2015
(the "PUD/PSP");
WHEREAS, the Amendment was scheduled for study and recommendation by the
Development Review Committee ("DRC") on November 7, 2018; and
WHEREAS, the DRC recommended approval of said Amendment; and
WHEREAS, the Amendment was scheduled for study and recommendation by the
Planning and Zoning Commission of the City of Ocoee ("P&Z");
WHEREAS, on November 13, 2018, the P&Z held an advertised public hearing on
the Amendment and, after discussion, recommended single -story houses only be allowed on Lots
14-25 of the PUD/PSP and recommended approval of the Amendment, as modified to allow a
reduction in the front setback from 25 to 20 feet and requiring single -story houses on Lots 14-25;

WHEREAS, on February 5, 2019, the Ocoee City Commission has held an
advertised de novo public hearing with respect to the proposed Amendment and this Ordinance and
determined that an Amendment to the PUD/PSP to reduce the front setback from 25 to 20 feet and
this Ordinance are consistent with the City of Ocoee Comprehensive Plan, as amended; and
WHEREAS, this Ordinance has been considered by the Ocoee City Commission in
accordance with the procedures set forth in Section 166.041(3), Florida Statutes.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
SECTION 1. Authority. The City Commission of the City of Ocoee has the
authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida
and Chapter 166, Florida Statutes.
SECTION 2. Amendment to PUD/PSP. The Amended PUD/PSP, prepared
by Dave Schmitt Engineering, Inc., date stamped received by the City of Ocoee on December 12,
2018, with such additional revisions thereto, if any, as may be reflected in the minutes of the City
Commission of the City of Ocoee meeting approving same, is hereby approved, subject to the
Conditions of Approval as approved on October 20, 2015. The Amended PUD/PSP is attached
hereto as Exhibit "A", and by this reference made a part hereof. As described therein, the
Amended PUD/PSP amends the previously approved PUD/PSP for Ocoee Landings PUD/PSP. All

references to the PUD/PSP or the Amended PUD/PSP for Ocoee Landings PUD/PSP shall
hereafter refer to the previously approved PUD/PSP for Ocoee Landings PUD/PSP as amended by
the attached Amended PUD/PSP.
SECTION 3. Ocoee Comprehensive Plan. The Ocoee City Commission
hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan.
SECTION 4. Inconsistent Ordinances. All ordinances or parts of ordinances
in conflict or inconsistent herewith are repealed and rescinded as of the effective date of this
Ordinance.
SECTION 5. Severability. If any section, subsection, sentence, clause, phrase,
or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision
and such holding shall not affect the validity of the remaining portion hereto.
SECTION 6. Effective Date. This Ordinance shall become effective ten (10)
days after its passage and adoption.
