Rosenthal, Esq. , City AttorneyKL DATE: July 12, 1995 RE: Consideration of Scheduling of Public Hearing to Terminate or Modify Senior Program This is to follow-up on my memoranda to you of April 14 and July 7, 1995 regarding the City of Ocoee Senior Program. Budget workshops are scheduled to begin on August 2 . This will require that the City Commission make certain decisions regarding the continuation of the Senior Program in FY 95-96. Options available include: (i) funding the Program; (ii) modifying the Program and providing funding for a modified Program; (iii) terminating the Program by repealing Resolution No. 90-06; or (iv) declining to fund the Program, but keeping Resolution No. 90-06 in place to allow the possibility of funding in subsequent years. Resolution No. 90-06 specifically provides that the Senior Program is subject to the annual appropriation of funds. It further provides that the Program can be terminated or modified at any time so long as an advertised public hearing is held in connection therewith. In order for the City to continue the Senior Program in its current form, it will be necessary to direct the City Manager to include funding in the proposed FY 95-96 budget. In the event the City Commission wants to consider a termination or modification of the Senior Program, it will be necessary to schedule an advertised public hearing to consider any such action. If a majority of the City Commission is inclined to consider the termination or modification of the Senior Program, then it is recommended that such a public hearing be scheduled for The Honorable Mayor and City Commissioners of the City of Ocoee July 12, 1995 Page 2 the August 1, 1995 City Commission meeting.
