Colonial Drive (SR 50). The subject site is currently undeveloped. The subject site parcel ID number is 21- 22-28-6328-00-070. The table below references the future land uses, zoning classifications, and existing land uses of the surrounding parcels. DIRECTION: JURISDICTION/FUTURE LAND USE JURISDICTION/ZONING North City of Ocoee/Commercial City of Ocoee/Community Commercial"C-2" East City of Ocoee/Commercial City of Ocoee/Community Commercial"C-2" South Orange County/Road Right-of-Way Orange County/Road Right-of-Way West City of Ocoee/Commercial City of Ocoee/Community Commercial"C-2" Discussion: The subject site is located on the northwest corner of Clarke Road and W. Colonial Drive (SR 50). Both roadways are designated as arterials roads. There is an existing left-turn lane on Clarke Road that is planned to be used for the project's main entrance. Water, sanitary sewer, reclaimed water, solid waste and police & fire protection will be provided by the City. On December 1, 2009, the Ocoee City Commission approved the rezoning of the parcel to PUD with a PUD Land Use Plan. The approved Land Use Plan proposes a mixture of uses which are Commercial, Retail, Restaurant, Restaurant with a drive-thru facility, Medical Offices, and Financial Services. All other uses are proposed to be prohibited. The Preliminary Subdivision Plan proposes three (3) commercial lots, which are sized to fit the proposed building structures. All of the lots will be serviced by a common tract (Tracts "A"). Tract "A" will address the requisite infrastructure (access, parking, sidewalks, landscaping, etc.) improvements. The Preliminary Site Plan proposes three (3) one-story structures with a total gross floor area of 30,443 square feet. The allocation for the total square footage for each use proposed is 16,358 square feet of Commercial, 4,500 square feet of Financial Services/Commercial/Drive-thru Restaurant, and 9,585 square feet of Restaurant space. Back in January of 2017, a developer named Green Tree Development Company had the property under contract and planned to buildout the approved plan. A "ground Breaking" was held and the property was cleared of all vegetation for development. The contract was subsequently canceled, and the property has sat with no improvements made. From time to time, as weeds get high, Code Enforcement has to notify the property owner to have the property mowed. Substantial Amendment The applicant is proposing to amend the PUD Land Use plan by reducing the overall square footage from 30,443 SF to 27,750 SF in order to accommodate a revision to Lot 1. Lot 1 is only approved for a combined 3,285 SF restaurant and a 6,300 SF restaurant. The applicant proposes to amend the plan to change from a restaurant use to a 15,750 SF strip retail/restaurant building. Also, the Land Use Plan is being revised to move the stormwater from under the parking to a retention pond. Issue: Should the Honorable Mayor and City Commission approve an ordinance for the Substantial Amendment to the Ocoee Town Shops PUD Land Use plan to amend Lot 1 from a single use of 9,585 SF of restaurant space to 15,750 SF of retail/restaurant space? Development Review Recommendation: The Development Review Committee (DRC) met on Wednesday, January 2, 2019. The DRC made a recommendation of"no objection" to the proposed changes. Planning and Zoning Commission Recommendation: The Planning and Zoning Commission (P&Z) reviewed the proposed Substantial Amendment to the Ocoee Town Shops PUD Land Use Plan on January 8, 2019. No issues or concerns were brought up. When deliberations finished, the Planning and Zoning Commission voted unanimously to recommend approval of the Substantial Amendment. Staff Recommendation: Staff recommends that the Honorable Mayor and City Commission approve an ordinance for a Substantial Amendment to the Ocoee Town Shops PUD Land Use plan to amend Lot 1 from a single use of 9,585 SF of restaurant space to 15,750 SF of retail/restaurant space. WHEREAS, the owner (the "Owner") of certain real property located within the corporate limits of the City of Ocoee, Florida, as hereinafter described,has submitted an application to the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission") to approve an amendment (the "Amendment") to the Ocoee Town Shops PUD Land Use Plan as approved by the Ocoee City Commission on December 1,2009 (the"PUD");; WHEREAS, the Amendment was scheduled for study and recommendation by the Development Review Committee("DRC") on January 2, 2019; and WHEREAS,the DRC recommended approval of said Amendment; and WHEREAS, the Zoning was scheduled for study and recommendation by the Planning and Zoning Commission of the City of Ocoee ("PZC"); WHEREAS, on January 8, 2019, the P&Z held an advertised public hearing on the Amendment and, after discussion, recommended approval of the proposed Land Use Plan modification; and; WHEREAS, the Ocoee City Commission has held a de novo public hearing with public notice thereof with respect to the Zoning; and WHEREAS,this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041(3), Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE,FLORIDA,AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Amendment to PUD/PSP. The Amended PUD, prepared by Florida Engineering Group, date stamped received by the City of Ocoee on December 26, 2018, with such additional revisions thereto, if any, as may be reflected in the minutes of the City Commission of the City of Ocoee meeting approving same, is hereby approved, The Amended PUD is attached hereto as Exhibit "A", and by this reference made a part hereof. As described therein,the Amended PUD amends the previously approved PUD for Ocoee Town Shops PUD. All references to the PUD or the Amended PUD for Ocoee Town Shops PUD shall hereafter refer to the previously approved PUD for Ocoee Town Shops PUD as amended by the attached Amended PUD ORLA_1224586.2 -2- SECTION 3. Ocoee Comprehensive Plan. The Ocoee City Commission hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan. SECTION 4. Inconsistent Ordinances. All ordinances or parts of ordinances in conflict or inconsistent herewith are repealed and rescinded as of the effective date of this Ordinance. SECTION 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto SECTION 6. Effective Date. This Ordinance shall become effective ten (10) days after its passage and adoption.
