HomeMy WebLinkAboutII (A) Kissimmee Ave / Story Road and Marshall Farms / maguire Road Intersections INTERSECTION IMPROVEMENTS MK-04 KISSIMMEE AVE/STORY ROAD MARSHALL FARMS ROAD/MAGUIRE ROAD On May 4, 1993, the City authorized Professional Engineering Consultants, Inc., to W, prepare final engineering plans and specifications (including all necessary permitting) for the upgrading of the Kissimmee Road/Story Road and Marshall Farms Road/Maguire Road intersections. The 100% plans and specifications have been completed and delivered to the City. The following activities are needed to complete the preconstruction services for the intersection improvements. 1. Right-of-Way Acquisition - Based on the final engineering plans, additional rights-of-way, drainage easements and construction easements are required to implement the construction activity. A total of ten (10) parcels are needed for the intersection improvements. The location and ownership of the ten (10) needed parcels are shown in Figure 1. The initial step would be to seek authorization of the City Commission to obtain an appraisal of each needed rill parcel. 2. Negotiations for the acquisition of each parcel would occur after completion of As the appraisals. 3. Bid documents and advertising - Upon completion of all necessary property acquisitions, the City would advertise the Construction Documents for a thirty (30) day bid period. The proposed improvements to the intersections (shown in Figure 2) are briefly described as follows: KISSIMMEE AVE/STORY ROAD IMPROVEMENTS The Kissimmee Ave./Story Road intersection improvement consists of signalizing the intersection and adding left and right turn storage lanes to all four approaches to increase traffic capacity. The existing pavement will be removed and all new pavement will be constructed to current roadway standards to accommodate the heavy truck traffic in the vicinity. The new roadway section will provide 12 foot wide lanes bounded by curb and gutter as well as associated signing and pavement markings, signalization and drainage improvements. Intersection Improvements Page 2 MARSHALL FARMS ROAD/MAGUIRE ROAD IMPROVEMENTS The Marshall Farms Road/Maguire Road intersection improvement consists of � P reconfiguring the existing "Y" type intersection to a "T" type intersection for safety purposes. Approximately 200 feet of Marshall Farms Road will be realigned to intersect Maguire Road radially. The drainage system will be converted to an urban type system with stormwater treatment ponds being constructed within the areas of the old pavement. The improvements include the necessary turn lane storage lengths on both Maguire Road and Marshall Farms Road. The intersection will remain unsignalized with the traffic on Marshall Farms Road being controlled with a stop sign at the intersection. Maguire Road traffic will be maintained as the thru movement. a The City has financially planned for the intersection improvements to occur after completion of Clarke Road improvements and after payment of road impact fees by the West Oaks Mall. Other possible contributors to the financing of these intersection improvements include Orange County (added traffic generation from Services Building) and FDOT (80/20 matching fund program). The current construction estimates for completion of the intersection improvements are ""' KISSIMMEE AVE/STORY ROAD $587,687.15 MARSHALL FARMS ROAD/MAGUIRE ROAD $322,082.80 TOTAL COST $909,769.95 The above total cost estimate is based upon construction of both intersections simultaneously. The estimated construction cost does not include an amount for the acquisition of needed right-of-way, drainage comments, and construction easements. The use of one contract for both intersections results in considerable cost savings and reduces the total inconvenience to the motoring public. Rosenthal, Esq. , City Attorney -( ;'____ DATE: December 12, 1995 RE: Acquisition Costs Associated with Kissimmee Avenue/ Story Road/Marshall Farms Road Improvement Project In connection with the above-referenced project, it is anticipated that the City will incur costs associated with both title reports and appraisals. Additionally, the City will incur legal expenses with the City Attorney associated right-of-way acquisition. In the event it becomes necessary to file an eminent domain action, it is likely that the City will be responsible for the payment of attorneys ' fees, appraisal fees and possibly expert witness fees incurred by the property owner. Pursuant to your request, I have obtained proposals for both appraisal and survey services. Please find enclosed a memorandum to me from Mary Doty forwarding two appraisal fee proposal and providing a summary with respect thereto indicating a price range between $9, 000 and $15, 000, exclusive of any trial testimony. Additionally, Fidelity Title and Guaranty Company has advised that they will provide title search reports on the basis of $125 per parcel for a total charge of $875. In the event the City is able to acquire the necessary rights-of-way and easements through donations or voluntary acquisitions, I would estimate our attorneys' fees to be between $17, 000 and $25, 000. Additionally, the City would incur title insurance costs which cannot be calculated until we have an indication of the value of the properties. For budgeting purposes, I would estimate title insurance costs of $10, 000. In the event it is necessary to pursue any condemnation proceedings, I would then estimate our total attorneys' fees to be between $30, 000 and ESTABLISHED . 8 4 2 Ellis Shapiro, City Manager December 12, 1995 11 Page 2 IL $50,000. Attorneys' fees and costs for the property being condemned could easily average between $15, 000 and $20, 000 per parcel. Until such time as the appraisals are obtained and an initial contact is made with the property owners, it is very difficult to predict the amount of attorney time which will be involved and the likelihood of the need to pursue condemnation proceedings. The Matonis firm has provided an estimated fee proposal of $15,000, which does not include expert testimony necessitated by condemnation proceedings. The Matonis fee proposal is based on a report delivery date of January 15, 1996. Mr. Matonis told me on the phone that a delivery date of January 31, 1996 would not change his fee proposal. The second proposal is from The Real Estate Consortium. For a delivery date of January 15, 1996, The Real Estate Consortium has provided a fee proposal of $10, 500. For a delivery date of January 31, 1996, the fee proposal is $9, 000. Our firm's fee for preparation of the required appraisals is $10,500, based upon a delivery date of January 15, 1996 or$9,000 based upon a delivery date of January 31, 1996. Trial preparation and expert testimony necessitated by any condemnation proceedings will be billed at an hourly rate of $150 per hour for my time and $100 per hour for staff appraisal time. Since the possibility exists that appraisal expert testimony may be required, I have attached to Lthis letter a summary of significant testimony given by me in Central Florida during the recent past.
