Lakeshore Drive Jean Grafton r:fyOcoee, Florida 34761-2258 City Clerk ff*Of 0000�` (407) 656-2322 FAX (407) 656-5725 MEMORANDUM To: The Honorable Mayor and Board of City Commissioners From: Jean Grafton, City Clerk Date: December 1, 1995 Re: Establish New Election Day per House Bill 1273 When Orange County Supervisor of Elections Betty Carter made it final and defmite that she would no longer provide the equipment for municipal elections during the months that she is conducting national, state, or county elections it became necessary for municipalities to choose a different time for their elections. As the City of Ocoee's election was set by Charter to be the first Tuesday after the first Monday in November (which is traditionally the general election date) this Commission asked that a special bill be passed allowing the election date to be changed without going to referendum. Now that the 1995 election process is completed, it is appropriate to take action on House Bill 1273 which was enacted June 17, 1995. A copy of the minutes showing Commission action and HB 1273 are attached. Also attached is a list showing the dates chosen by other Orange County municipalities. Choosing a date to coincide with the other municipalities will lessen our cost for each election. Action Requested: Please direct staff to prepare an ordinance to amend the Charter to provide for the following: 1. new election dates 2. new beginning dates for terms of office 3. extended or shortened terms for incumbents to coincide with such new election dates 4. new qualifying dates 5. new qualifying fees to comply with Florida Statutes. The purpose of this letter is to inform you of election dates for 1996, so the dates can be tentatively reserved. If you have problems with any of the dates, please notify Nancy Lord or Pat Keough immediately. In 1996, elections are scheduled on the following dates: March 12, 1996 Presidential Preference Primary September 3. 1996 First Primary Election October 1, 1996 Second Primary Election November 5, 1996 General Election As always, our workers will arrive at the polls at 6 A.M. election day, and may be there until late in the evening. The election process requires that the room not be used for any other purpose during the entire day and until ail have voted and results accounting is completed. It is ESSENTIAL to the election process that we have a telephone in the voting room for election use between at 6 A.M. and the time poll workers leave. Our drivers will need access to the polling place on the day before and the day after each election for equipment delivery and pick up. Later this fall, a member of my staff will visit your location to check the arrangements and complete a use agreement. I really appreciate your past assistance and future cooperation. Motion carried 5-0. DEL GUERCIO ESTATES-PRELIMINARY/FINAL SUBDIVISION PLANS AND FINAL PLAT. Planning Director Wagner presented the staff report and recommendation to approve subject to the items listed by City Attorney in a memo dated September 14, 1994. Those items included providing certain receipts and documents, relocating easements, and confirming that the legal description accurately identifies the property. The public hearing was opened. As no one wished to speak, the public hearing was closed. Commissioner Gleason, seconded by Commissioner Johnson, moved to approve staff recommendation as .resented. Motion carried 5-0. RECESS 10:35 P.M. TO 10:45 P.M. OTHER BUSINESS RESOLUTION NO. 94-16, ESTABLISHING RIGHT-OF-WAY UTILIZATION PERMIT FEES. This resolution was presented by title only. Commissioner Combs, seconded by Commissioner Gleason. moved to adopt Resolution No. 94-16 as presented. Motion carried 5-0. RESOLUTION NO. 94-21, RELATING TO PERFORMANCE EVALUATION SYSTEM FOR GENERAL EMPLOYEES. This resolution was presented by title only. Personnel Director Psaledakis thanked former Mayor Dabbs for his input and explained that this document reduces the employee performance evaluation manual to 2 pages. Mayor Vandergrift, seconded by Commissioner Combs, moved to adopt Resolution No. 94-21 as presented. Motion carried 5-0. RESOLUTION NO. 94-22, RELATING TO THE ACCRUAL OF INTEREST ON WATER/SEWER DEPOSITS,THE PAYMENT OR FORFEITURE OF THAT ACCRUED INTEREST, REFUND OF DEPOSITS AND/OR APPLICATION OF DEPOSIT UPON TERMINATION OF WATER/SEWER SERVICES. This resolution was presented by title only. Administrative Services Director Beamer gave the staff report. Commissioner Combs, seconded by Commissioner Gleason, moved to adopt Resolution No. 94-22 as presented. Motion carried 5-0. DIRECTION RE: CHARTER REFERENDUM REGARDING MUNICIPAL ELECTION DATE. Mr. Rosenthal presented his report on the options regarding the municipal election date. Commissioner Johnson, seconded by Commissioner Gleason, moved to leave the issue alone and ask the State to pass a special bill.
