BACKGROUND: Lake Olympia Square partuepro g� �� � +" square foot ' port on of the Lake Olympia Square Shopping Center (Retail Space "F" A a d at the southwest corner of Silver Star Road and Clarke Road) to Tutor Time Child Care Systems , Inc . so that they may operate a Child Care Facility on the site. Based upon the requirements of the Ocoee Land Development Code, such a use is only permitted within a C-2 Community Commercial District upon approval of a Special Exception. In order to clarify specific site issues affecting the Special Exception, a Preliminary Site Plan is required to be submitted for City Staff review. Even though the Preliminary Site Plan does not convey Site Plan approval per se, the inclusion of that Plan within the DRC recommendation permits the establishment of appropriate Conditions of Approval which may then be incorporated with the Final Site Plan approval . DISCUSSION: The Preliminary Site Plan has incorporated numerous Conditions of Approval in response to Staff comments to ensure the proposed facility maintains high quality design standards to mitigate any impacts to surrounding property owners . In addition to the general limits placed on the initiation and operation of the Special Exception, the applicant has agreed to 1) place limits on the number of children occupying the facility, 2) provide for drop-off and pick-up of children only at the front of the facility, 3) establish specified hours for the operation of the facility, 4) establish specified hours for the operation of the outdoor playground area, and 5) provide significant landscape screening for the proposed outdoor playground area. Approval of the Special Exception is also subject to City Commission approval of the proposed changes to the existing Land Use/Preliminary Subdivision Plan that are necessary to accommodate this facility . Lake Olympia Square Partnership, Special Exception September 13 , 1995 Page 2 PLANNING AND ZONING COMMISSION RECOMMENDATION: At their meeting on September 12 , 1995 , the Planning and Zoning Commission voted 5 to 2 to recommend approval of the Special Exception Application of Lake Olympia Square Partnership per the Staff Recommendation, subject to the fence for the outdoor playground area being increased from 5 feet high to 6 feet high. STAFF RECOMMENDATION: At their meeting on September 6, 1995 , the DRC unanimously recommended approval of the Special Exception subject to a clarification on weekend hours of operation for the facility . This revision has now been incorporated into the Plan, and Staff therefore respectfully recommends that the Mayor and City Commissioners approve the Special Exception Application of Lake Olympia Square Partnership to operate a Child Care Facility within Retail Space "F" in accordance with the Preliminary Site Plan as date stamped received by the City on September 8, 1995 including the Conditions of Approval as identified thereon and with consideration of the Planning and Zoning Commission recommendation.
