January 22,2019
I. CALL TO ORDER
Chairman Lowery called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission
Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida.
A. INVOCATION:Vice-Chairman Carrington initiated the moment of silence.
B. PLEDGE OF ALLEGIANCE: Member Lomneck led the Board in the Pledge of Allegiance to the U.S.flag.
C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared
quorum (4) present.
PRESENT: Chairman Lowery,Vice-Chairman Carrington, & Members Lomneck, Lewis, Odom, & Murray.
Member Mirza arrived 7:03 p.m.
Also present: Board Attorney Mary Sneed, Support Services Assistant Director Doug Gaines,
Code Enforcement Clerk Justin Mieras, and Code Enforcement Officers Ed Loeffler, Carmen Diaz,
& Bob Siegrist.
ABSENT: None.
D. SWEARING OF OFFICERS/WITNESSES: Code Enforcement Clerk Justin Mieras administered the oath to the Code
Enforcement Officers and to anyone intending to speak regarding a case.
II.CONSENT AGENDA
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT
BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS
UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE
BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY.

III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS
Vice-Chairman Carrington,seconded by Member Lomneck, moved to begin with cases 2018-00187, 2018-00199, &
2018-00231 then revert to the original agenda. Motion carried unanimously.
CASE NO 2018-00187

Violation Cited: § 165-3. A., § 108-23. Q., § 168-6. B. (1), § 115-3. B., &§ 115-3. A. (2) & (3) City Code
Summary: No person shall keep any abandoned or junk vehicle on any public property or any private property.
Garages, storage buildings and all other accessory structures shall be maintained and kept in good repair and sound
structural condition.
No owner, private property, shall consent to the parking or storing of vehicles on non-improved surfaces of the
property.
No person shall allow or permit excessive growth,ten inches or more on property owned,of weeds,grass,
undergrowth or other dead or living plant life.
No person shall dump or cause to be dumped, or place or cause to be placed within the City any nuisance and menace
to public health, safety and welfare.
Observation: Dodge Ram 3500 pick-up truck/blu/ FL tag#J51 3XH/exp. DEC-18/with flat LF tire.Also, I-H pick-up truck
in disrepair parked in backyard. Fence in disrepair with broken/missing slats. One (1) I-H pick-up truck parked in
backyard on grass. Grass/weeds in backyard over 10". Misc. trash/debris on property.
Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of January 22, 2019,the
property is still in non-compliance.The City asked for an order of compliance within 10 days, or thereafter to be fined

$50.00 per day, per violation until found in compliance.
Respondent Kurtis Henson asked for 30 days to come into compliance and discussed possible remedies with the Board
and the Code Officer.
Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2018-00187, the respondent be found
in violation as cited as of November 17, 2018, and be given until February 22, 2019, to come into compliance or be fined
$75.00 per day,per violation that remains in non-compliance. Motion carried unanimously.
CASE NO 2018-00199

Violation Cited: § 108-23. Q. & 165-3.A.City Code
Summary: Accessory structures. Garages, storage buildings and all other accessory structures shall be maintained and
kept in good repair and sound structural condition.
No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation: Fence in disrepair with missing/fallen sections/slats. Ford Expedition/blu/ NO TAG/ parked in driveway.
Officer Siergist presented the case and gave its history. Officer Siegrist further explained that as of January 22, 2019,the
property is still in non-compliance.The City asked for an order of compliance within 15 days, or thereafter to be fined
$50.00 per day, per violation until found in compliance.
Respondent Cindy Rolandini asked for 6 weeks to come into compliance.
Vice-Chairman Carrington, seconded by Member Odom, moved that in Case#2018-00199, the respondent be found in
violation as cited as of November 26, 2018, and be given until March 05, 2019, to come into compliance or be fined
$75.00 per day, per violation that remains in non-compliance. Motion carried 6 to 1;Member Lomneck opposing.
CASE NO 2018-00231

Violation Cited: §165-3.A. City Code
Summary: No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation: Dodge Ram 1500 pick-up truck/blk/FL tag#Y32 HXF/exp.JAN-18/parked in driveway.
Officer Siergist presented the case and gave its history. Officer Siegrist further explained that as of January 22, 2019,the
property is still in non-compliance.The City asked for an order of compliance within 10 days, or thereafter to be fined
$50.00 per day until found in compliance.
Respondent Tami Marshall explained she cannot get the car tagged until it is transferred into her name.The Board
discussed alternatives to getting the car tagged.
Vice-Chairman Carrington, seconded by Member Lomneck, moved that in Case#2018-00231, the respondent be found
in violation as cited as of December 17, 2018, and be given until February 22, 2019, to come into compliance or be fined
$50.00 per day the violation remains. Motion carried unanimously.

Violation Cited: §168-4.A. (1), § 108-24. D., § 168-6. & B. (1), City Code & §6-4. H. (6) LDC
Summary: No person shall stop or park a vehicle on a sidewalk.
It shall be unlawful for to use a residential property for the storage of any abandoned motor vehicle, ice box,
refrigerator, stove,glass, building material, building rubbish or similar items. It shall be the duty every such owner and
occupant to keep the premises of residential properties clean and to remove all such abandoned items as listed
above, including but not limited to weeds, dead trees,trash,garbage, etc.
No owner, private property, shall consent to the parking or storing of vehicles on non-improved surfaces of the
property.
Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is located
behind the front yard building line and screened with a six-foot high opaque fence with gate.
Observation: Prohibited trailer storage locations, equipment,tools, materials littering property. Grass parking.Vehicles
blocking pedestrian sidewalk.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of January 22, 2019,
the property is still in non-compliance.The City asked for an order of compliance within 15 days,or thereafter to be
fined $50.00 per day, per violation until found in compliance.
Member Odom,seconded by Member Lomneck, moved that in Case#2018-00067, the respondent be found in violation
as cited as of November 14, 2018, and be given until February 06, 2019, to come into compliance or be fined$50.00 per
day, per violation that remains in non-compliance. Motion carried unanimously.
II. Case Resolution
CASE NO 2018-00099
OFFICER SIEGRIST 2410 EL MARRA DR DEVIN GLOVER
Violation Cited: §168-6. B. (1) & §165-3.A. City Code
Summary: No owner, private property, shall allow the parking of motor vehicles on non-improved surfaces.
No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation:Tall weeds and grass;front, side, and rear yards. 2 no-tag wrecked, inoperable white sedans on property.
Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of January 22, 2019,the
property is only in non-compliance with violation §165-3. A.The City asked for an order imposing fines of$50.00 per day
for the remaining violation until found in compliance.
Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2018-00099, the Board imposes fines as
of December 08, 2018 of $50.00 per day that violation of§165-3. A. remains. Motion carried unanimously.
CASE NO 2018-00103
OFFICER LOEFFLER 330 NORTHERN DURANGO AVE JOSE RODRIGUEZ
Violation Cited: §165-3.A. & §115-3.A. (3) City Code
Summary: No person shall keep any abandoned or junk vehicle on any public property or any private property.

No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety
and welfare.
Observation: Mops, mop buckets,gray buckets, trash, litter, bottles, beer cans littering property and leaning against
home. Wrecked truck no license tag back side yard.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of January 22, 2019,
the property is still in non-compliance.The City asked for an order imposing fines of$50.00 per day, per violation until
found in compliance.
Member Odom,seconded by Member Lomneck, moved that in Case#2018-00103, impose fines as of December 8, 2018
as was set by the Board. Motion carried unanimously.
CASE NO 2018-00144
OFFICER DIAZ 3 SUNSET KEY CT PAMELA DENISE HARPER
Violation Cited: §115-3. B. & §115-3. A. City Code
Summary: No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass,
undergrowth or other dead or living plant life.
No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety
and welfare.
Observation:Grass/weeds overgrown on property. Miscellaneous trash/debris littering the property.
Assistant Support Services Director Doug Gaines presented the case and explained that as of December 28, 2018,the
property was in compliance.The City asked for no further action.
V. COMMENTS
Support Services Assistant Director Doug Gaines reminded the Board to respond in a timely manner to the reservation
e-mails and Chair Lowery added to not reply all.
