Background Summary:
The City Commission awarded the work of constructing Phase 1 of the Lakefront Park Improvements
project to MARBEK Construction, Inc. A major element of that work is construction of a new parking lot
between the Lakeshore Center and Bluford Avenue. The city Utilities Department is decommissioning the
existing City Hall lift station and replacing it with a larger facility across the street that will also provide
service to the downtown commercial area. A connecting pipe is needed to link the existing lift station to
the new one. This pipe needs to be installed before the new parking lot is constructed.
Issue:
Should the City Commission authorize Change Older No. 1 with MARBEK Construction Co. in the
amount of$66,944.67?
Recommendation:
Staff recommends that the City Commission approve the proposed change order. MARBEK Construction
Co. is qualified to do the work and the price offered is consistent with the expected cost of construction.
The pipe's installation was an expected element of the overall Downtown Sanitary Sewer System project
but has been delayed due to issues related to constructing the receiving lift station. It is now necessary
for the pipe to be installed as part of the Lakefront Park Improvements project in order to allow that work
to proceed without additional delay and cost.

The cost of the connecting underground pipe is covered by the existing Utilities capital budget (Account

CHANGES ORDERED:
I. REQUIRED CHANGES
The existing lift station serving the City Hall campus is being decommissioned and converted to
a receiving manhole. The CITY needs to install a sanitary sewer conveyance pipeline between
the existing City Hall lift station and the future Downtown lift station to be constructed across
Bluford Avenue. This pipe needs to be installed prior to constructing the overlaying parking lot,
which is part of the CONTRACTOR's original scope of work.
II. JUSTIFICATION
The CITY has been delayed in constructing the pipeline due to issues related to the design and
construction of the new lift station. Rather than wait until the new lift station is ready—which
will be after the parking lot is installed—the CITY prefers to install the pipe now and not later
need to cut through and restore the new parking lot.
III. NARRATIVE OF NEGOTIATIONS
The parties discussed the work and negotiated a reasonable price for the job.
IV. PAYMENT
The additional project cost is being covered by CITY Utility Account 408-531-00-6302, which
will become an additional funding source for the Lakefront Park Improvements project. This
change order will not impact park funding. Progre3ss payments are subject to the terms of the
existing project Agreement.
V. APPROVAL AND CHANGE AUTHORIZATION
The original project and funding allocation was established by issuance of a CITY purchase
order, subject to the terms and conditions contained in the CITY's solicitation, Project Manual,
Drawings, Specifications, and/or the CONTRACTOR's service and price proposal, which
collectively form the terms of an agreement between the CITY and the CONTRACTOR for the
performance of the Work. This proposed change to the agreement requires approval by the
CITY Commission under the CITY's Purchasing Rules and Regulations and is consistent with
any prior action by the CITY Commission to award the Work to the CONTRACTOR. It is
expressly understood and agreed that the approval of the Change Order shall have no effect on
the original agreement other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the
adjustments in contract price and time shown hereon constitute full and complete compensation
and satisfaction for all costs and modifications of performance time incurred by the
CONTRACTOR as a result of this Change Order. No other claim for increased costs of
performance or modifications of time will be granted by the CITY for the Work covered by this
Change Order. The CONTRACTOR hereby waives and releases any further claims for cost or
time against the CITY arising from or relating to the matters or Work set forth or contemplated
by this Change Order.

I.SITE SPECIFIC QUALIFICATIONS:
1)All bypass pumping and sewage contrtol including monitoring is solely the liability of the city of Ocoee.
2)Vault box will bee exposed and above grade along the sidewalk.
3)With relocation of the valve vault positive drainage from the p trap/vault drain is not gaurenteed.
4)No insertion elevations will be changed in the wet well.
5)All dewatering to be discharged into city of Ocoee MS4 Drainage system with no additional filtering included.
6)FCCI takes no liability for proper alignment of existing gravity main to precisely intersect with existing wet well.
