Contact Number: 407-905-3159 City Manager: Robert Fr.j�J t Subject: Acceptance of Residential Plumber for the Kimball Area Water Ma n Upgrade Project Background Summary: The Kimball Area Water Main Upgrade Project, awarded by the City Commission on July 17, 2018, is nearing completion as the new potable water mains have been installed underground. The contractor (Central Florida Tapping and Construction Services, Inc.) has yet to abandon the old potable water mains due to the absence of the connection of the existing plumbing of 108 residential homes to the new water meters installed in the front yard. In order for the contractor to abandon the old water mains, residential plumbing services will be required. The Finance Department sent out a Request for Qualifications for Residential Plumbing Services (RFQ #19-002) for 108 residential homes with a Bid Opening on October 23, 2018. Upon time of the Bid Opening, there were no bidders for RFQ #19-002. City Staff reached out to multiple plumbers stationed in and around the Ocoee area with no success. The Utilities Department decided to let City staff do the plumbing work for 58 residential homes and reached out to residential plumbers for the remaining 50 residential homes. The Utilities Department received proposals for 50 residential homes from A-1 Service Plumbing, Inc., and Josko Services in a total amount of$92,500.00 and $188,000.00 respectively. Staff is recommending the acceptance of A-1 Service Plumbing, Inc., proposal in the total amount of $92,500.00 to move forward with the residential plumbing of the remaining 50 homes in order for the contractor to finish the Kimball Area Water Main Upgrade Project. The Utilities Department shall be available for questions. Issue: Should the Mayor and City Commission approve A-1 Service Plumbing, Inc., for the residential plumbing of Kimball Area Water Main Upgrade Project? Recommendations: Motion for Mayor and City Commission to accept A-1 Service Plumbing, Inc., proposal for 50 residential homes in the total amount of$92,500.00. Attachments: 1. An additional $300,000, Capital Improvements (401-533-10-6302), was incorporated in the budget for Fiscal Year 2018/2019. When added to the remaining balance, makes available $555,882.52. Funding for the construction of Phase II (Change Order No. 1) in the amount of $279,151.48 leaves a project balance of $276,731.04. Funding for the residential plumbing for 50 residential homes in the total amount of $92,500 and additional expenses for residential plumbing conducted by City Staff, makes available $151,503.84 for the possible construction of Phase II. Qualification Packages will be received at the office of Joyce Tolbert, CPPB Purchasing Agent, Finance Department/Purchasing, Second Floor, 150 North Lakeshore Drive, Ocoee, Florida 34761 until 2:00 P.M., local time, on October 23, 2018. Qualification Packages received after that time will not be accepted under any circumstances. Sealed qualification Packages that have been timely received will be publicly opened and the names of the responding firms read aloud at that time. No Pre-Submittal conference is scheduled at this time. Prospective respondents may secure a copy of the documents required for submitting a response through OnvialDemandstar by accessing the City's website at http://www.ocoee.org under the "Living & Working" section. Partial sets of the documents required for submitting a statement of qualifications will not be issued. By using OnvialDemandstar, prospective respondents will be provided with all information regarding this RFQ, and all addendums and changes to the project requirements. RFQ19-002 PREQUALIFICATION FOR RESIDENTIAL PLUMBING SERVICES FOR KIMBALL AREA WATER 2 CITY OF OCOEE REQUEST FOR QUALIFICATIONS RFQ 19-002 RESIDENTIAL PLUMBING SERVICES FOR KIMBALL AREA WATER MAIN UPGRADE PROJECT INTRODUCTION AND INSTRUCTIONS 1. The City of Ocoee, Florida, has under construction the replacement of water lines in the Kimball Area with portions of the water lines being relocated from the rear yard property line to the right-of-ways in front homes. New meters shall be installed in front of the affected homes. The City is seeking the services of qualified individuals or companies that are licensed plumbing contractors (service provider, Respondent) to provide material and labor to abandon in place the existing service, and tie-in the home to the new meter. Service Provider shall provide a 180-day warranty. The City will install backflow device. Each home will require a permit. The City will setup a fast permitting process and shall pay all permitting fees directly. Dependent of installation method HDPE may be an acceptable alternative to PVC. Directional drill is acceptable. 2. It is the City's intent to pre-qualify up to five (5) service providers and issue work orders based on proposals from service providers. Since variances in conditions exist between each home, the City will coordinate a pre-proposal walk-through for each home. The work must be done by a licensed plumber or under the direct control of a plumber. 3. It is anticipated that approximately sixty two (62) to one hundred eight (108) residences will require this service. 4. In selecting the service provider, the City shall consider the service provider's qualifications: the ability to accomplish the work, and similar past experience (50%), and references and other pertinent issues that may affect the success of the work (50%). 5. Submittals shall include reference sheets and all applicable license numbers and years in business; include a copy of applicable license. References shall list contact name, phone number and email address, and any information obtained from reference may be used in the evaluation process. 6. Submittals shall also include a copy of their insurance certificate; summary of any current litigation;, addenda acknowledgement if applicable; and completed Confidential Disclosure form (attached) and Company Information/Signature Form (attached). 7. Selection shall be based on the above percentages for qualifications and evaluated by a Selection Committee comprised of staff with recommendation made to City Commission. 8. All questions regarding this solicitation shall be made to the Purchasing Agent, in writing, no later than 2:00 P.M. local time, on October 16, 2018. Potential Respondents should not contact City staff, with the exception of the Purchasing Agent, or other City consultants for information regarding this RFQ before the project award date. Contact RFQ19-002 PREQUALIFICATION FOR RESIDENTIAL PLUMBING SERVICES FOR KIMBALL AREA WATER 3 with any other member of the City staff, City Commission, or its Agents during the RFQ, award, and protest period may be grounds for Respondent disqualification. 9. All Qualification Statements must be received by the City at the location stated in paragraph 10 of the RFQ no later than 2:00 p.m. local time on October 23, 2018. Any qualification packages received after the above-noted time will not be accepted under any circumstances. Any uncertainty regarding the time a qualification package is received will be resolved against the Respondent. It shall be the sole responsibility of the Respondent to have the Qualifications Letter delivered to Ocoee City Hall by U.S. mail, hand delivery, or any other method available to them. Delay in delivery shall not be the responsibility of the City. A Qualification Statement received after the deadline shall not be considered and shall be returned unopened. Any request to withdraw a Qualification Statement must be addressed in writing. Such requests must be received by the City prior to the deadline of the submission. 10. Service providers interested in providing the services shall submit one (1) original and three (3) copies of their qualifications. Qualification Statements shall be submitted to the City of Ocoee in one sealed envelope, clearly marked on the outside with the appropriate RFQ number and closing date and time, addressed to: City of Ocoee Attn: Joyce Tolbert, CPPB, Purchasing Agent 150 N. The person signing the signature sheet on behalf of the respondent must have the legal authority to bind the respondent to the submitted qualification package and shall be understood to do so. All expenses for providing Qualification Statements to the City shall be borne by the Respondent and the City assumes no responsibility for such costs incurred. 11. Action on Qualification Statements is expected to be taken by the City within ninety (90) days of the due date; however, no guarantee or representation is made herein as to the time between receipt of the Qualification Statement and subsequent Commission action. 12. The City reserves the right to accept or reject any or all Qualification Statements, to waive irregularities and technicalities, and to request resubmission or to re-advertise for all or any part of the RFQ. The City shall be the sole judge of each Qualification Statement and the resulting negotiated agreement that is in the City's best interest. The City's decision shall be final. 13. All applicable laws and regulations of the United States, the State of Florida, and the City of Ocoee will apply to any resulting Agreement. RFQ19-002 PREQUALIFICATION FOR RESIDENTIAL PLUMBING SERVICES FOR KIMBALL AREA WATER 4 14. Pursuant to Section 287.133(2)(a), Florida Statutes, interested firms who have been placed on the convicted vendor list following a conviction for public entity crimes may not submit a proposal on a contract to provide services for a public entity, may not be awarded a contract and may not transact business with a public entity for services, the value of which exceeds CATEGORY TWO for a period of 36 months from the date of being placed on the convicted vendor list. 15. DRUG-FREE WORKPLACE: The Respondent certifies the Respondent's status as a Drug-Free Workplace or evidence of an implemented drug-free workplace program. 16. Certification of Non-Segregated Facilities: The Respondent certifies that the Respondent does not and will not maintain or provide for the Respondent's employees any segregated facilities at any of the Respondent's establishments and that the Respondent does not permit the Respondent's employees to perform their services at any location, under the Respondent's control, where segregated facilities are maintained. The Respondent agrees that a breach of this certification will be a violation of the Equal Opportunity clause in any contract resulting from acceptance of this Bid. As used in this certification, the term "segregated facilities" means any waiting room, work areas, time clocks, locker rooms and other storage and dressing areas, parking lots, drinking facilities provided for employees which are segregated on the basis of race, color, religion, national origin, habit, local custom, or otherwise. The Respondent agrees that (except where the Respondent has obtained identical certification from proposed contractors for specific time periods) the Respondent will obtain identical certifications from proposed subcontractors prior to the award of such contracts exceeding $10,000 which are not exempt from the provisions of the Equal Opportunity clause, and that the Respondent will retain such certifications in the Respondent's files. Governing Law: the non- discriminatory guidelines as promulgated in Section 202, Executive Order 11246, and as amended by Executive Order 11375 and as amended, relative to Equal Opportunity for all persons and implementations of rules and regulations prescribed by the U.S. Secretary of labor. 17. FLORIDA PUBLIC RECORDS LAW: In accordance with Chapter 119 of the Florida Statutes, and, except as may be provided by Chapter 119 of the Florida Statutes and other applicable State and Federal Laws, all Respondents should be aware that the proposal and the responses thereto are in the public domain and are available for public inspection. Respondents are requested, however, to identify specifically any information contained in their proposal which they consider confidential and/or proprietary and which they believe to be exempt from disclosure, citing specifically the applicable exempting law. All proposals received in response to this request of proposal become the property of the City of Ocoee and will not be returned. In the event of an award, all documentation produced as part of the contract will become the exclusive property of the City. PUBLIC RECORDS COMPLIANCE: The City of Ocoee (City) is a public agency subject to Chapter 119, Florida Statutes. The Contractor agrees to comply with Florida's Public Records Law. Specifically, the Contractor shall: 1. Keep and maintain public records required by the City to perform the service. 2. Ensure that public records that are exempt or confidential and exempt from the public records disclosure requirements are not disclosed except as authorized by law for the duration of the contract term and following completion of the contract if the Contractor does not transfer the records to the City. 4. Upon completion of the contract, Contractor agrees to transfer at no cost to the City all public records in possession of the Contractor or keep and maintain public records required by the City to perform the service. If the Contractor transfers all public record to the City upon completion of the contract, the Contractor shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If the Contractor keeps and maintains public records upon completion of the contract, the Contractor shall meet all applicable requirements for retaining public records. All records stored electronically must be provided to the City, upon request from the City's custodian of public records, in a format that is compatible with the information technology systems of the City. 5. A Contractor who fails to provide the public records to City within a reasonable time may be subject to penalties under section 119.10, Florida Statutes. The City may accept any item or group of items of any proposal, unless the Respondent qualifies its proposal by specific limitations. The City may accept one or more proposals if, in the City's discretion, the City determines that it is in the City's best interest to do so. The City reserves the right to award the contract to the Respondent which, in the City's sole discretion, is the most responsive and responsible Respondent The City reserves the right, as an aid in determining which proposal is responsible, to require a Respondent to submit such additional evidence of Respondent's qualifications as the City may deem necessary, and may consider any evidence available to the City of the financial, technical, and other qualifications and abilities of a Respondent, including past performance (experience) with the City and others.
