SUBJECT: State Road 50 Access Management and Intersection Operations Study
ISSUE:
Should the City Commission approve Ordinance Number 98-11 enacting the State Road 50
Access Management and Intersection Operations Study'?
BACKGROUND:
On February 3, 1998, The City Commission authorized TransCore to begin an Access
Management and Intersection Operations Study of State Road 50 from Good Homes Road to
the Florida Turnpike. The purpose of the study was to identify areas along State Road 50
where access management and intersection improvements are needed to maintain adequate
traffic flow and improve safety. The study examined existing and future roadway, intersection,
and traffic flow conditions. The future year conditions Were projected to the year 2003. The
results of this Study will serve three important functions: 1) to guide the City in the review of
proposed development regarding access, 2) to coordinate with the Florida Department of
Transportation (FDOT) with respect to access permits and needed roadway and intersection
improvements and 3) to coordinate with the State Rdad 50 Activity Center Study that was
initiated by Health Central in cooperation with the City.
DISCUSSION:
TransCore, working with City Staff, has completed their analysis and has prepared the attached
report for consideration. You will notice that the Studer recommends improvements such as
roadway medians, limits on access, additions of turn Manes at intersections, and changes to
signal timings. Many of the recommended improvements will evolve over time as development
occurs along State Road 50 and when the FDOT completes the needed widening of State Road
50 from four to six lanes. Significant improvements that can be completed in a more
reasonable period of time include; the addition of turn lanes and signal timing changes at the
Maguire Road, Bluford Avenue, Blackwood Avenue and Good Homes Road intersections.
Actual cost for these improvements will need to be determined on a project by project basis.

PLANNING AND ZONING COMMISSION RECOMMENDATION:
On June 18, 1998, the Planning and Zoning Commission and City Commission held a public
workshop regarding the proposed State Road 50 Access Management and Intersection
Operations Study. During this workshop commissioners and members of the public offered
comments and suggestions regarding the proposed Access Management and Intersection
Operations Study. In the attached memorandum, Staff has outlined the comments, responses,
and proposed changes, if any. Following the workshop, the Planning and Zoning Commission
held a de novo public hearing regarding the Study and voted unanimously to recommend
approval of the State Road 50 Access Management and Intersection Operations Study as
recommended by Staff.
STAFF RECOMMENDATION:
Staff respectfully recommends that the Honorable Mayor and City Commissioners APPROVE
Ordinance Number 98-11 enacting the State Road 501 Access Management and Intersection
Operations Study.

Subject: Revisions to the Access Management ano In -rsection Operations Study
On June 18, 1998, the City held a Joint Workshop between the City Commission and Planning
and Zoning Commission. During this public workshop commissioners, citizens, developers, and
property owners were given an opportunity to make comments, ask questions, and suggest
revisions to the State Road 50 Access Management and Intersection Operations Study.
Rather than revise the Access Management and Intersection Operations Study twice, Staff has
prepared this memorandum to identify proposed revisions to address comments made during
the Joint Workshop. Although Staff has identified some minor typographical errors in the draft
Study (i.e. "Clarke Avenue" instead of"Clarke Road"), these errors are not listed below but they
will be corrected prior to adoption. The comments below are organized in the order that they
were made at the public workshop.
Comments:
1. Jim Lee expressed concern about U-turns and truck movements. He stated
that improved and new north-south! roads become more important when
turning movements are restricted. Scott Gold echoed Mr. Lee's concerns
about U-turns and a discussion ensued.
(response) Staff agrees with Mr. Lee that improvements to existing north-south roads
and new north-south roads are an essential component of the proposed
State Road 50 Access Management and Intersection Operations Study.
Turning movement restrictions alone will not improve traffic efficiency or
safety. In order to relieve congestion along State Road 50, the proposed
identified improvements must be considered as a whole. The City has
undertaken this Study so that specific improvements can be identified and
discussed including their potential for relieving congestion on State Road 50.
As roadway improvements are made and turning movements are restricted,
drivers (including truck drivers) will modify their routes to account for new
roadways, intersections, and turn lanes. Over time, traffic circulation will
improve as drivers learn more efficient traffic patterns and adjust their driving
habits accordingly.

2. Jim Lee asked that we emphasize which intersections are candidates for
future signalization.
(response) Any new intersections are subject to the standards contained in the Manual
on Uniform Traffic Control Devices and the guidelines for conducting signal
warrant studies identified in the Manral on Uniform Traffic Studies; however,
the proposed new intersections have been located so as to maximize the
possibility of signalization when conditions warrant a signal based upon the
above noted standards and guidelines.
(change) None suggested.
3. Commissioner Howell described an existing turning problem for south bound
drivers on Bluford Avenue when they turn right (or west bound) onto
State Road 50. He asked if a south pound right turn lane could be added to
the proposed diagram for the intersection of State Road 50 and Bluford.
(response) Staff agrees with Commissioner Howell.
(change) Revise the diagram to add a proposed south bound right turn lane to Bluford
Avenue.
4. Scott Gold stated that he is concerned that the City will implement restricted
turning movements before any new nprth-south roadways are constructed.
(response) The regulation of turning movements and roadway improvements will be
implemented through the developmeht review process as new projects are
approved. Ultimately, the City intends to implement all of the proposed
improvements identified in the Access Management and Intersection
Operations Study; however, this is normally accomplished through the
development review process and any limitations to existing driveways or
streets will be considered as part of a Traffic Impact Analysis.

5. A citizen suggested the use of traffic circles or roundabouts rather than
standard intersections and a discussion ensued.
(response) It is unlikely that traffic circles could be considered along State Road 50 since
they typically require more right-of-way than a standard intersection and
certain local sections of State Road 50 are constrained in terms of additional
right-of-way. Additionally, the FDOT Manual on the Design of Roundabouts in
Florida states that roundabouts are not well-suited for high volume/ high
speed roads such as State Road 50.

WHEREAS, pursuant to the provisions of Chapter 163, Florida Statutes,
the Ocoee Planning and Zoning Commission, acting as the Local Planning Agency of the
City (the "LPA") has held an advertised public hearing on June 18, 1998 to review and
consider the Access Management and Intersection Operations Study for SR 50 from
Good Homes Road to the Florida Turnpike, as prepared by TransCore (the "Study"); and
WHEREAS, after consideration of the comments raised at the public
hearing, the LPA recommended that the City Commission adopt by ordinance the Study;
and
WHEREAS, pursuant to Chapter 163 and Section 166.041(3)(c), Florida
Statutes, the Ocoee City Commission held advertised public hearings on July 7, 1998 and
on July 21, 1998 to receive public comment on this Ordinance and the Study; and
WHEREAS, the City Commission of the City of Ocoee finds and determines
that this Ordinance is consistent with and implements the City of Ocoee Comprehensive
Plan and that adoption of this Ordinance is in the best interest of the City of Ocoee.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. The City Commission of the City of Ocoee has the authority
to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida
and Chapters 163 and 166, Florida Statutes.
SECTION 2. The City Commission hereby accepts the Access
Management and Intersection Operations Study for SR 50 from Good Homes Road to the
Florida Turnpike, dated Revised July 1998, as prepared by TransCore (the "Study"). The
Study is hereby incorporated by reference and made a part of this Ordinance. The City
Commission hereby determines that revisions to the Study may hereafter be made by
Resolution adopted by the Ocoee City Commission at a public hearing preceded by at
least ten (10) days notice prior to adoption in a newspaper of general circulation in the
City.

SECTION 3. Section 6-2.1 of Article VI of Chapter 180 of the Code of
Ordinances of the City of Ocoee, Florida, is hereby adopted as follows:
Section 6-2.1 STATE ROAD 50 ACCESS MANAGEMENT AND
INTERSECTION OPERATIONS
A. Access Management Generally.
(1) Purpose and Intent. The purpose of the Access Management and
Intersection Operations Study fo>fi SR 50 from Good Homes Road to
the Florida Turnpike, dated Revised July 1998, as prepared by
TransCore,as it may from time to time be revised by Resolution of the
City Commission of the City in accordance with the procedures set
forth in this Ordinance No. 98-11 ("the Study") is to maintain
adequate traffic flow and safety along State Road 50 and its
intersecting roads between Good Homes Road and the Florida
Turnpike. The intent of the Study is to provide guidelines for
development review and approval regarding access and other
improvements as well as to provide a framework for determining
traffic impact analysis. The Study is intended to be used by the City
to coordinate with other governmental agencies as a means to identify
needed transportation related improvements and to obtain funding for
said improvements.
(2) Conformity with the Study. All new development and redevelopment
within the City along State Road$0 and its intersecting roads between
Good Homes Road and the Florida Turnpike shall be approved by the
City in conformity with the Study(the "Study Area"). The Study Area
is depicted in Exhibit"A" attached hereto and by this reference made
a part hereof.
(a) All points of access, ingress, and egress for all new development
and redevelopment within the Study Area and the corporate limits
of the City shall conform to the Study.
(b) Any improvements to intersections required in conjunction with
new development and redevelopment within the Study Area and
the corporate limits of the City shall conform to the Study.

B. Procedure for Obtaining Waivers from the Study.
(1) The findings and recommendations of the Study shall be presumed to
be conclusive based upon the research and analysis conducted to
prepare the Study.
(2) The City will consider individual requests for waivers from the
provisions of the Study,or any portion thereof, in conjunction with the
review and approval of a preliminary or final site plan application. In
order to obtain a waiver from the Study, the burden of proof shall be
on the applicant to affirmatively allege and demonstrate that:
(a) traffic conditions have changed significantly such that the
recommended improvementsl are now technically impractical or
not feasible;
(b) conformance with the guidelines of the Study will not improve
traffic flow and safety within the Study Area;
(c) another traffic configuration/ improvement will be more effective
in improving traffic flow and safety within the Study Area;and/or
(d) alternative Traffic Management methods will be used by the
applicant to achieve the goals,1 objectives and standards set forth in
the Study.
The decision of the City Commission shall be final as to whether or not an
applicant has met the burden of proof necessary to obtain a waiver from any
provision of the Study. Waivers, if granted,will be made in conjunction with
the approval by the City Commission of a preliminary or final site plan.
C. Recognition of Existing Agreements.
Nothing herein is intended(1)to abrogate any vested rights which
may have been or may hereafter begranted by the City to an
applicant,(2)to amend or in anyway modify any provision of any
development order, developer agreement or other agreement
entered into with the City prior to the effective date of this
Ordinance, or (3) to modify, amend or in any way negate any
preliminary or final site plan approvals granted by the City prior
to the effective date of this Ordinance;provided,however,that the
City may require as a condition of approval of any revision to a
previously approved preliminary or final site, or any extension
thereof, that such plan be revised so as to conform with this
section to the extent practical.

SECTION 4. Severability. If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by
any court of competent jurisdiction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the validity of the remaining
portion hereto.
SECTION 5. Effective Date. This Ordinance shall become effective
immediately upon passage and adoption.
