SUBJECT: Resolution 98-10 Form for Application for Traffic Calming/Street Closing
Resolution 98-11 Addition to the Flat Fee Schedule to include the Traffic Calming
and Street Closing Application Fee
ISSUE:
Should the Mayor and City Commissioners approve Resolution 98-10 adopting the attached Traffic
Calming / Street Closing Application Form ( Land Development Code Form # 29 ) and Resolution
98-11 amending the Flat Fee Schedule to include the Traffic Calming and Street Closing Application
Fee?
BACKGROUND
On July 15, 1997 the Mayor and City Commission adopted the Traffic Calming and Street Closing
Policy and directed staff to prepare a Resolution adopting an application form and an application fee
of $250. The Traffic Calming and Street Closing Policy outlines the goals and objectives of the
program and provides an overview of possible alternatives when faced with traffic problems on local
residential streets. It also includes a process which when followed, should provide a clear
understanding of the traffic problem and assist in determining the best possible solution which meets
the needs of the neighborhood and the City.
DISCUSSION
In order to establish a fair and cost-efficient process, staff and TransCore, the City's transportation
consultant, researched traffic calming and street closing policies in Orlando, Maitland, Orange
County, and other Florida jurisdictions to determine what type of application form and fee should be
adopted. It was determined that all requests for traffic calming and/or street closures should be
made by formal application and that the application fee be adopted to cover some of the costs
associated with review of the request. The attached application form was designed to collect the

basic level of information required by staff to make an initial determination of what type of action is
being sought by the applicant. Studies may be done to measure volume and or speed of vehicles as
well as cut-through traffic and safety issues.
City staff estimates that a fee of$250 is a reasonable portion of the cost to process and evaluate the
initial request upon submittal of an application. This would basically include processing the
application, a meeting with relevant City staff, basic data collection to include traffic count and speed
information and presentation of the initial findings to the City Commission. This fee is consistent
with the fees charged for other applications which involve a similar level of staff and consultant effort.
Actual costs for the process may be higher due to additional review and analysis by staff and
TransCore, as well as mailings and advertisements for public meetings; however, the initial studies
may also show that no further action is warranted. Since the need for more extensive analysis
would be determined after the initial staff review, the allocation of cost to pay for further study and
design would be made by the City Commission.
RECOMMENDATION
Staff respectfully recommends that the City Commission approve Resolution 98-10 adopting the
attached Traffic Calming and Street Closing Application Form and Resolution 98-11 amending the
Fee Schedule to include the Traffic Calming and Street Closing Application Fee.

A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
ADOPTING ADDITIONAL FORMS FOR THE
IMPLEMENTATION OF THE LAND DEVELOPMENT
CODE PURSUANT TO SECTION 1-13 OF CHAPTER 180
OF THE OCOEE CITY CODE; PROVIDING THAT THIS
RESOLUTION IS SUPPLEMENTAL TO PREVIOUS
RESOLUTIONS ADOPTING LAND DEVELOPMENT
CODE FORMS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CONFLICTS; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, Section 1-13 of Chapter 180 of the Code of Ordinances for the
City of Ocoee authorizes the City Commission of the City of Ocoee to from time to time adopt
by resolution forms for the implementation of the Land Development Code; and
WHEREAS, forms for the implementation of the Land Development Code have
been prepared by the staff of the City of Ocoee, and the City Commission of the City of
Ocoee, after reviewing the forms, desires to adopt and approve such forms.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OCOEE, FLORIDA:
SECTION ONE: Authority. The City Commission of the City of Ocoee has the
authority to adopt this Resolution pursuant to Section 1-13 of Chapter 180 of Code of
Ordinances of the City of Ocoee, Article VIII of the Constitution of the State of Florida and
Chapter 166, Florida Statutes.
SECTION TWO: Additional Land Development Code Forms. The City
Commission of the City of Ocoee hereby adopts and approves the additional CITY OF OCOEE
LAND DEVELOPMENT CODE FORMS as set forth in Exhibit "A" attached hereto and by
this reference made a part hereof.
SECTION THREE: Resolution Supplemental. This Resolution is supplemental to
Resolution Nos. 92-12, 92-18, and all resolutions adopting Land Development Code Forms
which may have heretofore been or may be hereafter adopted by the City Commission of the
City of Ocoee.
SECTION FOUR: Severability. If any section, subsection, sentences, clause, phrase
or portion of this Resolution is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the remaining portion hereto.
SECTION FIVE: Conflicts. All resolutions, parts of resolutions or acts of the City
Commission of the City of Ocoee in conflict herewith are hereby repealed and rescinded.
SECTION SIX: Effective Date. This Resolution shall become effective
immediately upon passage and adoption.

RELATING TO DEVELOPMENT REVIEW FEES;
ESTABLISHING AN ADDITIONAL SCHEDULE OF FLAT
FEES; PROVIDING FOR CERTAIN APPLICATIONS FOR
WHICH THE FLAT FEE INCLUDES ALL REVIEW COSTS;
PROVIDING THAT THIS RESOLUTION IS SUPPLEMENTAL
TO PREVIOUS RESOLUTIONS ESTABLISHING A
SCHEDULE OF FLAT FEES; PROVIDING FOR

WHEREAS, the Flat Fees relating to the review of
Applications as set forth in this Resolution are an accurate method
of assessing the costs of development review functions and ensuring
payment thereof .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA:

of Ocoee has the authority to adopt this Resolution pursuant to

ADDITIONAL SCHEDULE OF FLAT FEES as set forth in Exhibit "A"
attached hereto and by this reference made a part hereof .
SECTION FOUR. Applications for Which the Flat Fee
Includes All Review Costs . Pursuant to the provisions of
Section 12-1 .C (2) of Chapter 180 of the Code of Ordinances of the
City of Ocoee, the City Commission of the City of Ocoee hereby
designates those Applications set forth in Exhibit "B" attached
hereto and by this reference made a part hereof as applications for
which Review Deposits are not required and for which the City
Attorney, legal, consultants and engineering fees and costs
incurred by the City are included within the Flat Fee.
SECTION FIVE. Designation of Additional Applications
Subiect to the Payment of Development Review Fees . Pursuant to
Section 1-12 .A(2) (xiv) of Chapter 180 of the Code of Ordinances of
the City of Ocoee, the City Commission of the City of Ocoee hereby
designates those Applications listed on Exhibit "A" hereto as
additional Applications within the scope of and subject to the
provisions of Section 1-12 of Chapter 180 of the Code of Ordinances
of the City of Ocoee.
SECTION SIX. Supplemental to Previous Resolutions. This
Resolution is supplemental to Resolution Nos . 92-11, 92-19, and any
other resolutions which have heretofore been or may from time to

time hereafter be adopted by the City Commission of the City of
Ocoee pursuant to the provisions of Section 1-12 of Chapter 180 of
the Code of Ordinances of the City of Ocoee .
SECTION SEVEN. Conflicts . All resolutions, parts of
resolutions or acts of the City Commission of the City of Ocoee in
conflict herewith are hereby repealed and rescinded.
