Recreation Advisory Board (2 year terms)
As discussed in your September 1 meeting, an appointee is needed for a term to expire October,
2000 to replace Mr. Chris Caldwell who resigned May 18 because he had moved from Ocoee.
An application has now been received from a citizen residing in District 4 who is interested in
serving on the Recreation Board.
Attached are Mr.Caldwell's resignation letter, the above referenced application, a current
member listing for the board and a brief description of City boards.
Action needed: Appointment of new member for term to expire October, 2000.

My family and I moved to the City of Ocoee in 1975 when I was just 11 years old. I am now
married and have two children of my own and I continue to reside in Ocoee. I have seen
tremendous growth in the 23 years I have lived here and expect to see more growth and change
in the years to come. My objective is to become more involved by serving on the Recreational
Advisory Board so I can help with improving and expanding the recreational activities for all
of the City of Ocoee's citizens,young and old.

BRIEF DESCRIPTION OF CITY BOARDS
BOARD OF ADJUSTMENT
Meets as needed
5 members, 2 alternates - 3 year terms
Duties: To hear and decide appeals for administrative review; to hear and recommend to
City Commission special exceptions and variances to the zoning ordinance.
CITIZEN ADVISORY COUNCIL FOR POLICE DEPARTMENT
Meets 3rd Thursdays, alternate months, 7:00 p.m.
No less than 15 members, no more than 25 members - 3 year terms
Duties: To promote and maintain communication, cooperation and a positive relationship
between the citizens of the City of Ocoee and the Ocoee Police Department.
CODE ENFORCEMENT BOARD
Meets 4th Tuesdays, 7:30 p.m.
7 members, 2 alternates - 3 year terms
(Membership will, when practicable, include an architect, a businessman, an engineer, a
general contractor, a sub-contractor and a realtor) .
Duties: To review infractions of City technical codes, negotiate compliance and impose
fines for failure to comply.
EDUCATION COMMISSION
Meeting day, time, frequency to be determined
No less than 7 members, no more than 15 members - 2 year terms
(Membership shall include at least one representative member for each public school
within the City.)
Duties: To improve the quality of education for Ocoee students by serving as an advisory
body to the City Commission on education issues within the City.
PERSONNEL BOARD
Meets as needed
5 members - 3 year terms
(Membership will include at least 1 City employee, 1 City Commissioner, 1 person who
holds management position with City, and 1 citizen of Ocoee who is not employed by and
does not hold office with City. All must be qualified electors of the City.)
Duties: Responsible for developing personnel policies for the City and recommending
such policies to City Commission for adoption.
PLANNING AND ZONING COMMISSION
Meets 2nd Tuesdays, 7:30 p.m. (and 4th Wednesdays, if needed)
7 members, 2 alternates - 3 year terms
(Membership will, when reasonable, include an architect, an engineer, a general building
contractor, a real estate agent and lay persons) .
Duties: Establishes principles and policies for guiding action affecting development in
the City and its environs. Determines whether special proposed developments conform to
the principles and requirements of the comprehensive plan. Acts in advisory capacity to
the City Commission.
RECREATION ADVISORY BOARD
Meets 3rd Mondays, alternate months, 7:30 p.m.
7 members - 2 year terms
Duties: To advise the City Commission, City Manager and Recreation Director on the
operation of the City's parks, recreational facilities and programs.
GENERAL EMPLOYEES' RETIREMENT TRUST FUND BOARD OF TRUSTEES
5 members: 2 employees, 2 residents and 5th member chosen by majority of the previous 4
members. 2 year terms
Duties: General administration and responsibility for the operation of the Retirement
Trust Fund for general employees.
POLICE OFFICERS' AND FIREFIGHTERS' RETIREMENT TRUST FUND BOARD OF TRUSTEES
5 members: 1 police officer, 1 firefighter, 2 residents and 5th member chosen by
majority of the previous 4 members. 2 year terms
Duties: General administration and responsibility for the operation of the Retirement
Trust Fund for the City's police officers and firefighters.

STIPULATED SETTLEMENT AGREEMENT
This Stipulated Settlement Agreement made and entered into this day of September
1998 by and between Paul Vees, Cindy Vees, Al Hoover, Sue Hoover, Joseph J. Pierdominici,
Avis Pierdominici, Yvonne B.E. Pierdominici, Betty Louis Wood, David W. Campbell, Suellen
Ritter, Shirley Chasteen, Carey Campbell, Michael W. Riley, Maureen R. Riley, Raleigh
Talley, and Louise Talley (hereinafter "the Plaintiffs"); the City of Ocoee, a Florida municipal
corporation (hereinafter "Ocoee"); and Orange County, a political subdivision of the State of
Florida.
WITNESSETH:
WHEREAS, in 1960 Orange County constructed a drain well within the right-of-way of
Johio Shores Road, unincorporated Orange County; and
WHEREAS, the function of the drain well is to control the lake level of Lake Johio,also
located within unincorporated Orange County at the time of construction of the drain well, and
WHEREAS, the drain well was permitted by the Florida Department of Air & Water
Pollution Control, now known as the Florida Department of Environmental Protection("DEP")
and the permit has never been transferred; and
WHEREAS, much of the property surrounding Lake Johio has been annexed into the City
of Ocoee and the City annexed the Johio Shores Road right-of-way in 1987; and
WHEREAS, the Plaintiffs are all Orange County residents and owners of residential
properties located southeast of the Lake Johio drain well and all rely on private wells for their
potable water supply; and
WHEREAS, in 1998 the Plaintiffs began experiencing disruptions in their potable water
supply and the presence of bacteria and discoloration due to the operation of the drain well; and

WHEREAS, the Plaintiffs assert that the problems with their private wells is due to the
operation of the Lake Johio drain well and the lack of any maintenance having been performed
on the drain well in over ten years;
WHEREAS, Orange County does not have public water service available in the area
proximate to the Plaintiffs and has no future plans to service this area of unincorporated Orange
County with public water; and
WHEREAS, the Lake Johio drain well is not currently operating and the lake level in
Lake Johio has reached its highest reading since before the drain well was constructed, causing
flooding and threatening residential structures located both within the City of Ocoee and
unincorporated Orange County; and
WHEREAS, the Plaintiffs have brought a declaratory judgment action in Orange County
Circuit Court, Case No. CI98-3144, seeking a determination as to whether the City of Ocoee
or Orange County is responsible for the proper function and maintenance of the drain well; and
WHEREAS, the parties desire that the drain well be maintained so that it will function
with its intended purpose which is to control the water level in Lake Johio without interfering
with the potable water supply derived from the private wells of the Plaintiffs; and
WHEREAS, the City of Ocoee does have public water service in the proximate area of
the Plaintiffs' residences.
NOW, THEREFORE, in consideration of the premises and the mutual promises and
agreements set forth herein and other good and valuable consideration the receipt of which is
hereby acknowledged, and intending to be legally bound hereby, the parties hereto do hereby
agree as follows:

1. Immediately upon execution of this Agreement, Orange County will notify DEP,
pursuant to 62-528.350, F.A.C., that it intends to transfer the permit to the Johio Shores drain
well to the City of Ocoee.
2. Immediately upon execution of this Agreement, the City of Ocoee, at no cost to
the County, will begin design, permitting, and construction of the extension of Ocoee water
service from Johio Shores Road to those portions of Mauldin Road, Florence Street, Ashville
Street, and Lake Street lying between New Victor Road and Old Silver Star Road.
3. Upon completion of construction of the public water service extension the County
will, in writing, transfer its permit to the Johio Shores drain well to the City of Ocoee or take
such other actions as may be necessary to have the permit transferred to the City of Ocoee.
Upon transfer of the Permit, the City of Ocoee agrees to accept all maintenance and operational
responsibilities for the Lake Johio drain well.
4. Within seven days from completion of the public water service extension, Orange
County, at no costs to the Plaintiffs for impact fees or water meter hookups, shall connect all
Plaintiffs to the City of Ocoee public water service. The.Plaintiffs will then be billed by the
City of Ocoee for their monthly water service at the rates applied to non-city residents.
5. Upon execution of this Agreement, the Plaintiffs hereby release and discharge the
City of Ocoee and Orange County fort any and all claims, causes of action, or suits they ever
had, now have, or could have arising from the operation of the Lake Johio drain well.
6. All parties shall bear their own costs and attorneys' fees.
