Wagner, Director of Planning SUBJ: PLANTATION GROVE PUD CROSS CREEK - SINGLE FAMILY SUBDIVISION PHASE II FINAL SUBDIVISION PLANS APPROVAL ISSUE: Should The Honorable Mayor and City Commissioners approve Phase II (164 lots) of the Final Subdivision Plans for the single family portion of Plantation Grove PUD identified as "Cross Creek"? BACKGROUND: Plantation Grove PUD is a multi-use project located on the east side of Maguire Road, directly north of Moore Road. It has certain vested rights as outlined in Certificate of Vesting CV-92-1 . The City Commission approved the Preliminary Subdivision Plans for the project on May 18, 1993 . Final Subdivision Plans for Phase I, totaling 158 lots were approved by the City Commission on December . 7, 1993 . All development standards are consistent with the approved Revised Land Use Plan. Typical lot size is 60 ' x 115 ' , with a 6 , 800 sw. ft . minimum area. Setbacks are 25 ' front, 25 ' rear and 7 . 5 ' side . Minimum living area is 1, 200 sq. ft . DISCUSSION: Included with the Final Subdivision Plans are construction plans for the paving of Moore Road extending from the subdivision west to Maguire Road. Based upon prior approvals, this road will be realigned from its present location to form what eventually will be a fully signalized intersection with Roberson Road. The existing off-set portion of Moore Road will be vacated and incorporated into '. the Commercial portion of the Plantation Grove PUD when that project is developed. Page 2 The Honorable Mayor and City Commissioners January 10, 1996 Staff requested the developer to include the Moore Road Plans with the Final Subdivision Plans to expedite the review process and to ensure that both the Cross Creek subdivision improvements and paving of Moore Road are undertaken simultaneously. This approach is different from the strict requirements of the revised PUD Land Use Plan for Plantation Grove PUD. Condition of Approval No. 22 (attached) restricts utilities and horizontal improvements from being constructed within Plantation Grove PUD until : 1) the process for vacating the existing Moore Road is initiated, 2) the plans for Moore Road and any other improvements which, impact the OUC Conserv II Easement have been approved by ', OUC, and 3) the realigned portion of Moore Road has been paved a distance of 1, 281 .4 feet from Maguire Road. With regard to the vacation of Moore Road, the developer of the Commercial tract may initiate this process as part of the plan review process for that portion of the development . In the case of OUC, we have received a letter from them indicating they approve of the roadway plans . The actual paving of 1, 281 .4 feet of Maguire . Road was initially required to ensure that a paved connection was ', made from the single family portion of the project to Maguire Road. Obviously, the requirement to pave this portion of the road ahead of the start of any construction being undertaken on the project itself is rather restrictive, and it would hold up the subdivision for many months . Assuming that the developer undertakes both the subdivision improvements and Moore Road paving concurrently, Staff'., believes that the intent of the original PUD approval would be achieved. PLANNING AND ZONING RECOMMENDATION At their regular meeting held January 9, 1996 , the Planning and Zoning Commission unanimously recommended approval of the Final Subdivision Plans for Cross Creek, Phase II, based upon the Staff recommendation and correction of a number of minor technical ) changes which are now incorporated in the Plan Set . Page 3 The Honorable Mayor and City Commissioners January 10, 1996 STAFF RECOMMENDATION: Based upon the unanimous approval of the DRC at their meeting held ! on January 3 , 1996, and the Planning and Zoning Commission recommendation, Staff recommends approval of the Final Subdivision Plans for Cross Creek, Phase II, which includes construction plans for Moore Road, as date stamped received by the City on January 10, 1996, subject to a temporary water easement being recorded for the ', temporary water line prior to holding the Pre-Construction Conference for the project; and that Condition of Approval No. 22 '. of the Revised Land Use Plan for Plantation Grove PUD as ! incorporated in the Third Developer Agreement dated December 29, 1993 , be waived for this portion of the development and in lieu : thereof, the Final Subdivision Plans for Cross Creek, Phase II, be approved subject to completion and acceptance of the paving of Moore Road as incorporated therein prior to issuance of a Certificate of Completion for the subdivision portion of the improvements .
