HomeMy WebLinkAbout01-23-2007 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING January 23, 2007 CALL TO ORDER Vice Chair Chancey called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation and the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Vice Chair Chancey, Members Ballard, Hopper, Morton, Stanley and Alternate Member Lowery. Also present were Code Enforcement Supervisor Loeffler, Code Enforcement Officer Siegrist, Permitting Clerk Ramos, Attorney V ouis and Deputy City Clerk Sibbitt. ABSENT: Chairman Godek and Member M. Godek were absent excused. Permitting Clerk Ramos administered the oath to Code Enforcement Officers Loeffler, Siegrist, and anyone intending to speak regarding a case. CONSENT AGENDA ALL MATTERS LISTED UNDER TIffi CONSENT AGENDA ARE CONSIDERED ROUTINE BY TIffi CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. TIffiRE WILL BE NO SEPARATE DISCUSSION OF TIffiSE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF TIffi BOARD, IN WHICH CASE TIffi CHAIRMAN WILL INSTRUCT TIffi BOARD CLERK TO REMOVE TIffi ITEM FROM TIffi CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. Bluford Avenue Officer Siegrist Violation Cited: 165-3 01-10-07 NOCV Re-Inspection Date: 01-10-07 01-10-07 SOY 01-10-07 NOH Meeting Date: 01-23-07 01-10-07 POS Certified Mail 01-20-07 POS Hand Delivery Observation: One Mini Van Plymouth white, in front yard, with no tag, flat tire, and broken mirror. Officer Siegrist gave a detailed history of the case and provided exhibits. He further announced this case is a repeat violator and the property was in non-compliance as of January 23,2007. Member Morton stated he recalls that the previous violation for this address in May hosted a lot of other issues. Officer Siegrist stated that the previous complaint had three separate code violations including 165-3. Vice Chair Chancey inquired if the previous case was in compliance. Officer Siegirst stated they did come into compliance for the previous case. Shannon Dun, 128 N. Bluford Avenue, stated as far as the case last year she did not receive any paperwork on it. She stated an officer did stop by her house to let her know of the violations and she took care of it immediately. As far as the case before them today she has spoken with the tenant and the notice the tenant showed her stated that they had until the 25th of January to come into compliance. Vice Chair Chancey explained to Ms. Dunn that since she was cited as a repeat violator the compliance date would be immediate. Member Hopper inquired if the officer had sent a certified letter. Officer Siegrist stated they did send out a certified letter which was not signed for; however, they did hand deliver a letter on January 20th. Member Ballard clarified that the vehicle that was cited is owned by the tenant and not the owner of the address. Ms. Dunn stated that the tenant is intending to have the vehicle removed by the end of this week. A brief discussion ensued regarding repeat violations. Alternate Member Lowery briefly explained to the owner that it is her responsibility as the owner of the property to make sure her tenants are following the City Code. Member Morton inquired as to when the owner returned back to Florida from being out of state. Ms. Dunn stated she returned right before the New Year however, her mail had been stopped and being a single parent with four kids she is just now able to get around to doing what needs to be done. Member Morton, seconded bv Member Ballard. moved in Case No. 07-002 to find the respondent in violation as a repeat violator. and be fliven until January 26, 2007. to come into compliance or be fined $100/per day thereafter. Motion carried 5-1 with Member HODDer opposing. Case No. 06-128 - Mahid N. Motion carried unanimouslv. COMMENTS Officer Loeffler provided before/after exhibits of violations corrected.
