HomeMy WebLinkAbout02-26-2019 Minutes CITY OF OCOEE Code Enforcement Board February 26,2019 I.CALL TO ORDER Chairman Lowery called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Vice-Chairman Carrington initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Odom led the Board in the Pledge of Allegiance to the U.S. flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared quorum (4) present. PRESENT: Chairman Lowery,Vice-Chairman Carrington, & Members Lomneck&Odom. Also present: Board Attorney Mary Sneed, Support Services Assistant Director Doug Gaines, Code Enforcement Clerk Justin Mieras, and Code Enforcement Officers Loeffler, Diaz, Rodriguez, &Siegrist. ABSENT: Member Lewis is an excused absence. Member Mirza is an unexcused absence. D. SWEARING OF OFFICERS/WITNESSES: Code Enforcement Clerk Justin Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS Vice-Chairman Carrington,seconded by Member Odom, moved to begin with case 2018-00271 then revert to the original agenda. Motion carried unanimously. CASE NO 2018-00271 OFFICER DIAZ 212 S CUMBERLAND AVE TONT PIETSCHMAN BRIDGES TR Violation Cited: §115-3.A. & B. and §165-3.A. & B. City Code and 6-4. H. (6)(a) LDC Summary: No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass, undergrowth or other dead or living plant life. No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. 2IPage No person shall keep any abandoned or junk vehicle on any public property or any private property. No more than one commercial vehicle, under one and one-half-ton, allowed on the premises. Observation:Vehicle untagged, and inoperable on property. Misc.junk/debris on property. Overgrown grass/weeds. Commercial vehicles stored on property. Officer Diaz presented the case and gave its history.Officer Diaz further explained that as of February 26, 2019, the property is only in non-compliance for violation §115-3.A. & B.The City asked for an order of compliance within 10 days, or thereafter be fined $50.00 per day until the property is found in compliance. Respondent Toni Bridges asked for 30 days to come into compliance stating she just evicted the previous tenants. Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2018-00271, the respondent be found in violation as cited as of December 20,2018 but found in compliance for§165-3.A. & B. and 6-4. H. (6)(a)and in non- compliance for§115-3.A. & B. as of February 26, 2019 and be given until March 27, 2019, to come into compliance or be fined$50.00 per day until the property is found in compliance. Motion carried unanimously. CASE NO 2018-00166 OFFICER DIAZ 217 S KISSIMMEE AVE JOSUE D SANDOVAL MARIELA SANDOVAL Violation Cited: §115-3.A., §115-3. B., & §165-3. A. City Code Summary: No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass, undergrowth or other dead or living plant life. No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation: Excessive weed or grass growth on the property back and front.Vehicle untagged, and inoperable on property. Misc. trash/debris on back of property on City right of way. Officer Diaz presented the case and gave its history. Officer Diaz further explained that as of February 26, 2019, the property is still in non-compliance.The City asked for an order of compliance within 15 days,or thereafter to be fined $25.00 per day, per violation until found in compliance. Vice-Chairman Carrington,seconded by Member Odom, moved that in Case#2018-00166, the respondent be found in violation as cited as of November 14, 2018, and be given until March 15, 2019, to come into compliance or be fined $25.00 per day, per violation that remains in non-compliance. Motion carried unanimously. CASE NO 2018-00261 OFFICER SIEGRIST 2620 COVENTRY LN CHERYL L FLANNIGAN Violation Cited: §165-3.A. City Code&§51-13. LDC Summary: No person shall keep any abandoned or junk vehicle on any public property or any private property. It shall be a violation to do work related to construction without first obtaining a permit. Observation:One (1) Ford Explorer/whi/FL tag#J64 01F/exp.JUL-16/parked in driveway. 'Pack Rat' storage container #T803483 in driveway. 3I1) d Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of February 26, 2019, the property complied with violation 165-3.A., but still in non-compliance for violation 51-13.The City asked for an order of compliance within 10 days, or thereafter be fined $50.00 per day until found in compliance. Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2018-00261, the respondent be found in violation of code 15-13. as of January 11, 2019, and be given until March 07, 2019, to come into compliance or be fined $50.00 per day until the property is found in compliance. Motion carried unanimously. CASE NO 2018-00294 OFFICER LOEFFLER 1504 STARFIRE LN CHUNSHENG YU Violation Cited: §108-24. D. &§115-3. A. City Code Summary: It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove,glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items. No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. Observation:Condition constituting a nuisance and creating a blighted effect on the neighborhood; Misc.junk, debris, parts,tools,supplies, equipment,furniture littering front, side and rear yards. Items covered with tarps. Not characteristic of a residential neighborhood. Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of February 26, 2019, the property is still in non-compliance.The City asked for an order of compliance within 15 days,or thereafter to be fined $25.00 per day, per violation until found in compliance. Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2018-00294, the respondent be found in violation as cited as of December 31, 2018, and be given until March 15, 2019, to come into compliance or be fined $50.00 per day, per violation that remains in non-compliance. Motion carried unanimously. CASE NO 2019-00005 OFFICER RODRIGUEZ 806 WINDERGROVE CT SNIIIC TWO LLC Violation Cited: §51-13 City Code Summary: It shall be a violation to do work related to construction without first obtaining a permit. Observation: Re-roof of property without required permits, plans, approval and inspections. Officer Rodriguez presented the case and gave its history.Officer Rodriguez further explained that as of February 26, 2019,the property is still in non-compliance.The City asked for an order of compliance within 15 days, or thereafter be fined $50.00 per day until found in compliance. Member Odom,seconded by Member Lomneck, moved that in Case#2019-00005, the respondent be found in violation as cited as of January 16, 2019, and be given until March 15, 2019, to come into compliance or be fined$50.00 per day until the property is found in compliance. Motion carried unanimously. CASE NO 2019-00009 OFFICER LOEFFLER 9723 CLARCONA OCOEE RD STANDARD PACIFIC OF FLORIDA Violation Cited: §108-23.Q.&§115-3.A. 4IP3f, Summary: Accessory structures. Garages,storage buildings and all other accessory structures shall be maintained and kept in good repair and sound structural condition. No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. Observation: Damaged fence with missing section; accessory structure (fence). Prohibited nuisance of misc.trash,junk, litter and debris visible to pedestrian, residents, and from roadway. Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of February 26, 2019, the property is still in non-compliance.The City asked for an order of compliance within 15 days, or thereafter be fined $50.00 per day, per violation and to allow the City the option to abate the property. Vice-Chairman Carrington,seconded by Member Odom, moved that in Case#2019-00009, the respondent be found in violation as cited as of January 17, 2019, and be given until March 15,2019, to come into compliance or be fined$100.00 per day, per violation that remains in non-compliance and to authorize the City to abate the property with the related costs assessed against the property. Motion carried unanimously. CASE NO 2019-00030 STEPHANIE CAFARO OFFICER RODRIGUEZ 716 BROADWAY DR PETER A CAFARO JR SUSAN CAFARO Violation Cited: §6-4. H. (6)(b) LDC Summary: Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is located behind the front yard building line and screened with a six-foot high opaque fence with gate. Observation: Unscreened two trailers in the backyard and one trailer parked on the driveway. Officer Rodriguez presented the case and gave its history. Officer Rodriguez further explained that as of February 26, 2019,the property is still in non-compliance.The City asked for an order of compliance within 15 days, or thereafter be fined $50.00 per day until found in compliance. Vice-Chairman Carrington,seconded by Member Lomneck, moved that in Case#2019-00030, the respondent be found in violation as cited as of January 24, 2019, and be given until March 15, 2019, to come into compliance or be fined $50.00 per day until the property is found in compliance. Motion carried unanimously. II. Case Resolution CASE NO 2018-00067 OFFICER LOEFFLER 1490 FOXFIRE DR RICARDO ESTEBAN GUERRERO Violation Cited: §168-4.A. (1), §108-24. D., & §168-6. & B. (1), City Code &§6-4. H. (6) LDC Summary: No person shall stop or park a vehicle on a sidewalk. It shall be unlawful for to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove,glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items as listed above, including but not limited to weeds, dead trees, trash, garbage,etc. No owner, private property, shall consent to the parking or storing of vehicles on non-improved surfaces of the property. 5I Pdp,P Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is located behind the front yard building line and screened with a six-foot high opaque fence with gate. Observation: Prohibited trailer storage locations, equipment,tools, materials littering property. Grass parking.Vehicles blocking pedestrian sidewalk. Officer Loeffler explained that as of February 26, 2019,the property is still in non-compliance.The City asked for an order imposing fines. Member Odom, seconded by Member Lomneck, moved that in Case#2018-00067, the Board impose fines previously set by this Board as of February 07, 2019. Motion carried unanimously. CASE NO 2018-00187 DOROTHY L DURRANCE OFFICER SIEGRIST 2549 DOVETAIL CT CHARLES SR DURRANCE KURTIS HENSON Violation Cited: § 165-3. A., § 108-23. Q., § 168-6. B. (1), § 115-3. B., &§ 115-3. A. (2) & (3) City Code Summary: No person shall keep any abandoned or junk vehicle on any public property or any private property. Garages, storage buildings and all other accessory structures shall be maintained and kept in good repair and sound structural condition. No owner, private property, shall consent to the parking or storing of vehicles on non-improved surfaces of the property. No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds, grass, undergrowth or other dead or living plant life. No person shall dump or cause to be dumped,or place or cause to be placed within the City any nuisance and menace to public health, safety and welfare. Observation: Dodge Ram 3500 pick-up truck/blu/FL tag#J51 3XH/exp. DEC-18/with flat LF tire. Also, I-H pick-up truck in disrepair parked in backyard. Fence in disrepair with broken/missing slats. One (1) I-H pick-up truck parked in backyard on grass.Grass/weeds in backyard over 10". Misc. trash/debris on property. Officer Siegrist explained that as of February 26, 2019, the property is still in non-compliance.The City asked for an order imposing fines. Member Odom,seconded by Member Lomneck, moved that in Case#2018-00187, the Board impose fines previously set by this Board as of February 23, 2019. Motion carried unanimously. CASE NO 2018-00199 OFFICER SIEGRIST 6825 WOODGRAIN CT JOSEPH RIVERA CINDY ANN RIVERA Violation Cited: § 108-23. Q. & 165-3.A.City Code Summary: Accessory structures. Garages, storage buildings and all other accessory structures shall be maintained and kept in good repair and sound structural condition. No person shall keep any abandoned or junk vehicle on any public property or any private property. 6 I I' j t> Observation: Fence in disrepair with missing/fallen sections/slats. Ford Expedition/blu/ NO TAG/parked in driveway. Officer Siegrist explained this case will be presented next month as the Board's order of compliance gave the respondent until March 05, 2019,to comply. CASE NO 2018-00231 OFFICER SIEGRIST 6733 SAWMILL BLVD ERIC MARSHALL TAMI MARSHALL Violation Cited: §165-3.A. City Code Summary: No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation: Dodge Ram 1500 pick-up truck/blk/FL tag#Y32 HXF/exp.JAN-18/parked in driveway. Officer Siegrist explained the property is in compliance. No further action needed. V. COMMENTS Clerk Mieras inquired about omitting the zeros when speaking the case files name. Board Attorney Mary Sneed asked the Board to include the zeros when making a motion, but was fine with having them omit zeros during general discussion. Assistant Support Services Director Doug Gaines announced he will not be at the meeting next month, and explained that Member Murry has resigned since he moved outside the city limits.
