ISSUE
Should the Honorable Mayor and Board of City Commissioners appoint
Thomas C. Feeney III of Fowler, Barice, and Feeney as the City of
Ocoee Code Enforcement Board Attorney?
BACKGROUND/DISCUSSION
Pursuant to City Commission direction, the Code Enforcement Board
Attorney Selection Committee which consists of Commissioner Scott
Glass, City Attorney Paul Rosenthal, Code Board Chairman Jim Sills,
Fire Chief Ron Strosnider and Building and Zoning Director Don
Flippen, released in January, a Request For Proposal (RFP) to
solicit proposals to serve as the legal counsel to the Code
Enforcement Board.
On February 19, 1996, the Committee met to review the submitted
three (3) proposals, which resulted in the following ranking-to-
hire recommendation:
1 ) Thomas Feeney, III, Fowler, Barice and Feeney
2 ) Daniel Montaris, Drage, DeBeaubien, Knight, Simmons, Romano
and Neal
3) Gretchen R.H. Vose, Vose and Blau
For your information and review, Fowler, Barice, and Feeney's
proposal application is attached. The other two proposals are on
file in the Building Department for review.
RECOMMENDATION
The Code Enforcement Board Attorney Selection Committee
respectfully recommends that the Honorable Mayor and Board of City
Commission appoint Thomas C. Feeney III of Fowler, Barice, and
Feeney as the legal counsel to the City of Ocoee Code Enforcement
Board.

Dear Mr. Flippen:
The law firm of Fowler, Barice & Feeney, P.A. is pleased to submit its application
to provide legal services to the Code Enforcement Board of the City of Ocoee. We feel
that our extensive experience in local government law makes us uniquely qualified to
provide the highest quality of professional services to the Code Enforcement Board for
the City of Ocoee. Fowler, Barice & Feeney understands the nature and scope of the
work to be done in providing legal services to the Code Enforcement Board for Ocoee.
Thomas C. Feeney, Ill will serve as general counsel to the City of Ocoee Code
Enforcement Board. Mr. Feeney has extensive municipal and code enforcement
experience, and has served as Assistant City Attorney for the City of Altamonte Springs
for seven years. Mr. Feeney has served as lead counsel to the Code Enforcement Board
of Altamonte Springs for four years. That experience has proved invaluable and has
provided Mr. Feeney with the necessary knowledge and ability to handle the types of
Code Enforcement Board issues, from the simple to the complex, that arise on a day to
day basis. In addition, from October 1995 through January 1996, Mr. Feeney has served
as interim attorney for Ocoee's Code Enforcement Board and has gained a familiarity
with Ocoee's Land Development Code, Rules, Regulations and Procedure and City
personnel.
When necessary. Mary L. Sneed will serve as assistant counsel for Mr. Feeney.
Ms. Sneed has been an Assistant City Attorney with the City of Altamonte Springs since
October of 1992. Additionally, she served as legal counsel for the Code Enforcement
Board of Altamonte Springs throughout 1993 and became well versed in many aspects
of Code Enforcement Board issues.
James A. Fowler has served as the City Attorney for the City of Altamonte Springs
for the past fifteen years in all ranges of municipal law, from annexation and bond work
io utilities, zoning and growth management, as well as attending the bi-monthly city
commission meetings and code enforcement board meetings when a particularly
sensitive matter requires the presence of the City Attorney.
Carole Joy Barice has been Assistant City Attorney for the City of Altamonte
Springs for the past nine years and attends all Planning Board and Board of Zoning
Appeals meetings. Additionally, Ms. Barice has attended Code Enforcement Board
meetings and has the experience required to provide the highest level of services to the
Ocoee City Code Enforcement Board. She specializes in the litigation of varied and
complex real estate and environmental matters and has had extensive work experience
at the highest levels of Florida State Government.
Fowler, Barice & Feeney, P.A. is a full service law firm, providing a full range of
professional services. The depth and breadth of our in-house direct municipal and state
government experience and abilities would seem to be tailor made for the representation
of an entity such as the Code Enforcement Board of the City of Ocoee.
Currently the firm consists of four attorneys, James A. Fowler is the Senior Partner
and President of Fowler, Barice & Feeney, P.A. Carole J. Barice and Thomas C. Feeney,
III are both active partners in Fowler, Barice & Feeney. Mary L. Sneed is an associate
attorney in the firm.
The firm is aware of no present conflicts of interest which could prevent us from
representing the City of Ocoee Code Enforcement Board. The firm has
$500,000.00/$1,000,000.00 of legal malpractice insurance coverage as is confirmed in
the Declarations form from National Casualty Company contained in this proposal.
Our firm is prepared and capable of committing the resources required to provide
the Code Enforcement Board of the City of Ocoee with competent representation
delivered in a timely manner. The Ocoee Code Enforcement Board, by virtue of the very
nature and substantial importance of its work, would be a client of primary importance
whose requirements will receive priority consideration. We are committed to the quality

ORLANDO OFFICE
We are very fortunate in having our offices located in the Empire Building. We are in the
process of upgrading our computer system so as to provide rapid and complete access
to information and material contained on CD-Rom disks, including the Florida Statutes,
cases, administrative rules and regulations. Additionally, our computer system is
compatible or can be made compatible with the system which may be in use by our
clients thus enabling us to communicate from computer to computer, through the use
of a modem. This could be most advantageous when deadlines are short, and multiple
revisions to contracts or agreements need to be reviewed.

Springs since 1979. I am responsible for all the legal affairs of the City. I handle a variety
of legal problems associated with a City experiencing the rapid growth that Altamonte
Springs has experienced. These duties include:

RE: Code Enforcement Attorney Position
Dear Mr. Flippen:
I wish to express my appreciation for my selection as attorney for the Code Enforcement
Board. The confidence the board has shown in me I can assure you will not be
misplaced. As you know, our firm has substantial experience in local government affairs
to specifically include representing code enforcement boards, which experience and
expertise we will place fully at the command and direction of the City of Ocoee.
You have asked me to provide a proposed cost and fee basis and I would offer as
follows:
1. Partners or senior attorneys time would be billed at the rade of$165.00 per
hour.
2. Junior attorneys or associates time would be billed at the rate of $135.00
per rO'!r.
3. Paralegal, to the extent that they would be involved in a code enforcement
proceeding, time is billed at the rate of $65.00 per hour.
4. Costs are billed based upon actual incurred expense with no adjustment
for overhead or accounting, the same being covered in the hourly rates.
I do not anticipate that there will be any appreciable costs incurred in connection with
the representation of the Code Enforcement Board. As you know, we are well
experienced in code enforcement proceedings and in municipal governmental affairs in
general, thus I believe making us much more efficient than would be the case with many
other attorneys who must develop a familiarity with the topic and the matters that might
be brought to the Code Enforcement Board's attention. Consequently, I expect our rates
and expenses to be quite competitive with those which you might incur with another less
experienced firm.
I would be pleased to meet with you or any members of the board to discuss the costs
and expenses and to make any adjustments which you feel would be necessary and
appropriate.

We do not have in our reocrds a copy of a city contract with
Thomas Feeney of Fowler, Barice, Feeney & O'Quinn.
I have included a copy of the proposal from Fowler, Barice, Feeney, &
O'Quinn. The other two proposals were held in the Building Department
for review and were destroyed on April 24 , 1998 , according to Florida
Department of State Bureau of Archives and Records Management
retention schedule.
