DATE: November 29, 1999
TO: The Honorable Mayor and City Commissioners
FROM: Kirsten McGinnis, Senior Planner 04
THROUGH: Russ Wagner, AICP, Director of Planning,,,;,Xi()
SUBJECT: Ordinance Number 99-40: Lake Johio Rezoning (Case Number AR-98-11-13)
ISSUE:
Should the Honorable Mayor and City Commissioners adopt Ordinance Number 99-40 to rezone
the subject property from Orange County R-1A to Ocoee R-1A and R-1AAA?
BACKGROUND:
The subject property is located approximately 450 feet north of the Silver Star/Clarke Road
intersection, east of Clarke Road. The 17.86± acre parcel contains three single family homes,
pasture and associated barns. The applicant is proposing to develop the subject property as a
single family subdivision.
DISCUSSION:
The subject property is designated Low Density Residential (< 4 du/acre) on the City Future Land
Use Map and Joint Planning Area Map. The applicant has requested an Ocoee zoning
classification of "R-1A for Parcel 1 and R-1AAA for Parcel 2, Single Family Dwelling District" (refer
to Ordinance Number 99-39, Exhibit B), which would be consistent with the above referenced land
use designation and character of the area.
The underlying Low Density Residential land use theoretically permits eight possible zoning
classifications (A-1; A-2; RCE-1; RCE-2; R-1AAA; R-IAA; R-1A; and R-1). The Comprehensive
Plan lists several zoning districts that are consistent with the Low Density Residential designation.
The City may choose from the range of potential zoning classifications and select one, as
appropriate. The R-1AAA, R-IAA, R-1A, and R-1 zoning classifications are the most appropriate
Ocoee zoning classifications for single family subdivisions (see attached Table 5-2 of the LDC).
Since the adjoining subdivisions are predominantly zoned R-1A with an R-1AAA classification
surrounding Lake Johio, it is appropriate for the applicant to request similar zoning approval for the
subject property, consistent the character of surrounding development in both the City and the
County.
