Invocation and Pledge of Allegiance B. Roll Call and Determination of Quorum Present: Chair Joel Keller, Vice-Chair Lavon Williams, Member Jason Mellen, Member Rodger Wunderlich Absent: Member Marc Bernstein (absent/unexcused) Also Present: City Planner Mike Rumer, Assistant City Attorney Dana Crosby- Collier and Recording Clerk Kathy Heard II. CONSENT AGENDA A. Minutes of the Planning & Zoning Commission Meeting held January 8, 2019. Member Wunderlich advised what he was trying to convey on Page 7 is not correctly represented in the minutes. Therefore, he has requested a revision to that portion of the minutes. (6:33 pm) Motion for Approval of the Consent Agenda with the Amended Minutes: Moved by Member Wunderlich, Seconded by Member Mellen; Motion carried unanimously with Member Bernstein absent. 1 Planning&Zoning Commission February 12,2019 III. OLD BUSINESS -None IV. NEW BUSINESS — Public Hearings (6:33 pm) (Agenda items taken out of order.) Chair Keller advised that the next regularly scheduled P&Z meeting on March 12,2019 has to be rescheduled due to the city election scheduled for the same night. He asked the board which date works best for them: Monday, March 25th or Wednesday, March 27th. City Planner Rumer indicated Wednesday is better for him. Vice-Chair Williams said either day works for her. Chair Keller indicated he is available on either day. Member Wunderlich indicated he is only available on Monday, March 25th. Member Mellen indicated he is not available on either day. (6:34 pm) Motion: Move that the Planning and Zoning Commission, acting as the Local Planning Agency, reschedule the Regularly Scheduled March 12, 2019 Planning and Zoning Meeting to March 25, 2019; Moved by Vice-Chair Williams, Seconded by Member Wunderlich; motion passed unanimously with Member Bernstein absent. A. Arden Park North Phase 4B Large Scale Preliminary & Final Subdivision Plan (PSP/FSP); Project No: LS-2018-015. (Advertised in the West Orange Times on Thursday, January 31, 2019) (City Planner Rumer) (6:40 pm) City Planner Rumer explained the proposed project with a brief PowerPoint presentation. This proposed project was originally approved by the City Commission on November 21, 2006, and amended on February 19, 2013. Arden Park North consists of the northern phases (2-6) of the PUD. Arden Park North is identified as Parcel ID Number 04-22-28-0000-00-001 (9421 Clarcona Ocoee Road)located on the north side of Clarcona Ocoee Road and situated between Hobson Road and Ingram Road.Arden Park North is approximately 308 acres of which 54.44 acres are identified as wetlands/Lake Sims. City Planner Rumer indicated the construction plans are not within their packet, but explained Clarke Road will be widened to a four-lane road from Clarcona Ocoee Road north to the north property line of Arden Park where it will return to a two-lane road north to McCormick Road. Arden Park North Phase 4B includes 122 single-family lots. The subject site is currently undeveloped with mainly planted pine trees. The Future Land Use Map designates the property as "Low Density Residential," with an area around Lake Sims designated as "Conservation/Floodplains." The Applicant has proposed an onsite mitigation program which includes providing an enhancement plan for the wetland and floodplain areas around Lake Sims. All streets in Arden Park North will be private, with the road network contained in tracts that will be owned and maintained by the homeowner's association. The Arden Park North Phase 4B PSP/FSP proposes a six(6) foot high cementitious (or precast)wall system with pedestrian access and associated buffer plantings along the portions of the development that front Ingram Road. Potable water and sewer services will be provided by Orange County. The City of Ocoee will provide solid waste services, reclaimed water, police and fire protection. Finally, the Applicant has requested no waivers from the Land Development Code for this project phase. [2] Planning&Zoning Commission February 12,2019 Development Review Committee(DRC)Recommendation: The Development Review Committee (DRC)met on February 4, 2019, and reviewed the Preliminary/Final Subdivision Plan for Arden Park North Phase 48. The DRC voted unanimously to recommend approval of the Preliminary/Final Subdivision Plan,subject to the resolution of any remaining staff comments. Staff Recommendation: Based on the recommendation of the DRC, Staff recommends that the Planning and Zoning Commission recommend approval of the Preliminary/Final Subdivision Plan for Arden Park North Phase 48, subject to resolving any remaining staff comments before the City Commission meeting. Discussion: Vice-Chair Williams inquired if there is mitigation needed. City Planner Rumer replied mitigation was needed in Phase 4A, but not in this phase. City Planner Rumer explained that the traffic trips within this plan are not new trips and have already been accounted for within the concurrency transportation database of Arden Park as a whole. Member Wunderlich said he noticed that the streets within Arden Park will be private and asked if this community will be a gated community to which City Planner Rumer answered affirmatively. Member Wunderlich asked whether there will be a fence or wall around the community. City Planner Rumer said originally the first builder contemplated walls; however, when the new builder came on, they modified it with the City Commission's approval to a precast/fence combination or a "living wall" with vegetation. Member Wunderlich inquired if the HOA will be responsible for the retention ponds and open spaces to which City Planner Rumer answered affirmatively. Member Mellen asked where Clarke Road will be widening. City Planner Rumer explained the developers for Oak Trail Reserve and Arden Park are responsible for the widening of Clarke Road north of Clarcona Ocoee Road; however, Clarke Road will need to be scaled back from the four- lane road to the two-lane road south of Clarcona Ocoee Road. Member Mellen asked if a right- turn lane could be installed turning east onto Clarcona Ocoee Road from Clarke Road when the widening is underway to which City Planner Rumer answered in the affirmative. Chair Keller inquired if a school is needed with more upcoming developments like CLRM, can OCPS consider utilizing Arden Park's parcel which they have subsequently denied. City Planner Rumer explained currently all developments that come forward in Ocoee fail elementary and middle school to which they are required to mitigate and pay by the desk. He announced they are pushing for new schools, because all of the public schools in Ocoee have exceeded capacity and the new charter schools have not impacted the numbers. Discussion ensued regarding the site OCPS rejected from Arden Park; and further, Arden Park can now develop on this site. (Advertised in the West Orange Times on Thursday, January 31, 2019) (City Planner Rumer) (6:35 pm) THIS ITEM HAS BEEN CONTINUED TO THE MARCH 25,2019 PLANNING AND ZONING COMMISSION MEETING City Planner Rumer announced this item is being continued to March 25, 2019, to give staff and the applicant more time to work with Orange County. Chair Keller asked whether there was anyone present to speak on this item that is unable to attend the March 25th meeting to which no one raised their hand or came forward. (6:37 pm) Motion: Move that the Planning and Zoning Commission, acting as the Local Planning Agency, Continue the CLRM Planned Unit Development (PUD) Annexation, Large Scale Comprehensive Plan Amendment and Rezoning to PUD; Project No(s): AX- 09-18-77, CPA-2018-008 & RZ-18-09-15 to March 25, 2019; Moved by Member Mellen, Seconded by Vice-Chair Williams: motion passed unanimously with Member Bernstein absent. City Planner Rumer stated this item will not be re-advertised, but revised 300-foot notices will be distributed with the meeting date of the Planning & Zoning Meeting and possibly the City Commission Meeting. [5] Planning&Zoning Commission February 12,2019 D. Harper Property — 1304 East Silver Star Road Annexation and Rezoning; Project No(s): AX-01-19-79 & RZ-19-01-17. (Advertised in the West Orange Times on Thursday, January 31, 2019) (City Planner Rumer) (7:03 pm) City Planner Rumer presented a PowerPoint presentation explaining this proposed project,which is located on the northeast side of 3rd Street, north of East Silver Star Road. The site is +1- 1.26 acres and has one existing single-family residence on the parcel. The applicant is annexing into the city limits because their property is now eligible for annexation as it is bordered by property located within the City limits on the east side. Staff is recommending to rezone this parcel from "Orange County" Retail Commercial District (C-1) to "City of Ocoee" Neighborhood Shopping (C-1). Development Review Committee(DRC)Recommendation: On January 29, 2019, the DRC met to determine if the proposed annexation and rezoning was consistent with the City's regulations and policies. When the discussion was finished,the DRC voted unanimously to recommend approval of the annexation and rezoning for the Harper Property. Staff Recommendation: Based on the above analysis and the subsequent DRC recommendation,Staff recommends that the Planning&Zoning Commission, acting as the Local Planning Agency, recommend approval of the Annexation and rezoning from "Orange County"Retail Commercial District(C-1) to "City of Ocoee"Neighborhood Shopping (C-1) of the property known as the Harper Property located at 1304 E.Silver Star Road. (The Board had no questions or discussions.) The applicant was not present for questions. V. MISCELLANEOUS (7.•07 pm) A. Project Status Report City Planner Rumer updated the Board with the following: • City Center West Orange has submitted buildingplans for the foundation work for all of the buildings. Next will be the building plans for the two parking garages, then the commercial plans to be followed by the condo/apartment plans. • Fx Scenery & Display, Inc., has moved from the North Lakewood Avenue location. A new high-tech recycling business is moving into this industrial (I-2) location. • Waffle House is coming to SR 50 in between Race Track and the Oasis Apartments. This is a good indicator of revitalization of SR 50. • Vice-Chair Williams said she has been asked a lot about what happened to Jimmy John's coming to Ocoee. City Planner Rumer indicated the space Jimmy John's was going to lease out was too expensive for them, but now Smoothie King is renting that space. He stated Jersey Mike's is going in where the Subway was in front of Walmart. [7] Planning&Zoning Commission February 12,2019 • Member Wunderlich inquired if there will be another tire repair shop and self- storage center at the southwest corner of SR 50 & Maguire Road. City Planner Rumer explained such uses have been prohibited in that area. • Member Wunderlich asked if addresses can be added to the current projects listed in the Project Status Update list. City Planner Rumer said if the project has an address, they can add that, but he emphasized a lot of projects do not have addresses until they get their building permit. B.
