ISSUE:
Should the Mayor and City Commissioners approve a Special Exception for Summerville at
Ocoee Assisted Living Facility?
BACKGROUND:
The subject property is an outparcel of the Lake Olympia Square Shopping Center (Lot 2) and
currently has C-2 zoning. The City is concurrently considering an application to rezone the
property to PUD as part of a Mixed Use project within an Activity Center. The parcel adjacent to
Lot 2 to the north is occupied by the Lake Olympia Square Shopping Center. The property to the
south is occupied by a radio station (Orange County enclave), and the Lake Olympia Club single
family subdivision is adjacent to the west. The applicant wishes to develop this parcel with an
Assisted Living Facility, with a maximum of 120 beds. Due to the unique nature of the proposed
use and the way the Land Development Code is structured, the Assisted Living Facility will
require both PUD zoning and Special Exception approval.
DISCUSSION:
Approval of a Special Exception typically includes a Preliminary Plan and a list of Conditions of
Approval for the Special Exception. All of the usual Special Exception Conditions of Approval
have been incorporated into this Preliminary Plan. A waiver to allow 18' parking spaces with a 2'
overhang into landscaped areas is also being requested for this project. The same waiver was
granted for the Lake Olympia Square Shopping Center. Most of the parking spaces on this site
are designed to take advantage of that waiver. The Final Site Plan for the Assisted Living Facility
will be reviewed later and will be consistent with the Preliminary Site Plan approved with this
Special Exception application.

The attached Preliminary Site Plan for the Summerville at Ocoee Assisted Living Facility Special
Exception Application was reviewed by the Development Review Committee (DRC) on May 6,
1998. The DRC determined that the proposed use as designed for this site would impose
significantly fewer impacts on surrounding properties than would commercial uses, and that the
facility would be architecturally compatible with surrounding residential properties. The
Committee voted unanimously to recommend approval of this Special Exception Application.
The attached Plan is date stamped received by the City on May 19, 1998, but it is the same plan
that was approved by the DRC on May 6, 1998.
PLANNING & ZONING COMMISSION MEETING AND RECOMMENDATION:
On May 27, 1998, the Planning and Zoning Commission held a public hearing on this Special
Exception for the Summerville at Ocoee Assisted Living Facility. During the public hearing, the
developer's representatives were present and answered several questions asked by the
Commission. After a brief discussion, the Planning and Zoning Commission voted unanimously to
recommend approval of the Special Exception for the Summerville at Ocoee Assisted Living
Facility, in accordance with stalTs recommendation.
STAFF RECOMMENDATION:
Based on the recommendations of the DRC and the Planning and Zoning Commission, Staff
respectfully recommends that the Mayor and City Commissioners approve the Special
Exception for Summerville at Ocoee Assisted Living Facility (Case # 1-1SE-98), to be built
according to the attached Preliminary Plan as date stamped received by the City on May
19, 1998, including the Conditions of Approval identified thereon.
