HomeMy WebLinkAbout03-26-2019 Minutes CITY OF OCOEE Code Enforcement Board March 26, 2019 I.CALL TO ORDER Chairman Lowery called the Code Enforcement Board regular meeting to order at 7:02 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Member Lomneck initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Lewis led the Board in the Pledge of Allegiance to the U.S. flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared quorum (4) present. PRESENT: Chairman Lowery, & Members Lomneck, Odom, Bandur, Lewis, & Mirza. Also present: Board Attorney Mary Sneed, Support Services Director Al Butler, Code Enforcement Clerk Justin Mieras, and Code Enforcement Officers Loeffler& Diaz. ABSENT: Vice-Chairman Carrington is an excused absence. D. SWEARING OF OFFICERS/WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II.CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. Motion carried unanimously. III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS CASE NO 2019-00017 OFFICER DIAZ 307 W OHIO ST BRIAN E DAVIS Violation Cited: §6-4.H.(6)(b) LDC and §108-35. Summary:Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is located behind the front yard building line and screened with a six-foot high opaque fence with gate. When nuisance conditions or hazards degenerate or cumulatively impact on structures, dwellings or other buildings regulated by the Minimum Standards Codes,to the extent that repair, removal,securing or demolition is necessary for the public health,safety and welfare,then the Code Enforcement Board is authorized to order the property owner or City agents to repair, remove, secure,vacate or demolish such structures according to procedures outlined herein. Observation: RV on the property is also being used as living quarters for homeless people and illegal activities. Public nuisance conditions constituting an extreme life safety danger. Extreme traffic of homeless and illegal activities. Officer Diaz presented the case and gave its history. Officer Diaz further explained that as of February 25, 2019, property is in compliance.Since but as a repeat violation the City asked for an order imposing fine for the 11 days the property was found in non-compliance. Member Lomneck,seconded by Member Lewis, moved that in Case#2019-00017, the respondent be found in repeat violation of codes 6-4.H.(6)(b)& 108-35. as of February 14, 2019, and in compliance February 25, 2019, and be fined $500.00 per day for the 11 days the property was found in violation. Motion carried unanimously. CASE NO 2019-00080 21 Page DANIEL AVILES OFFICER LOEFFLER 328 SPRINGFOOT CT ERICA C CASTILLO Violation Cited: §54-3.A.(1)D., §165-3.A., & §168-6.B.(1) City Code Summary:the building numbers shall not be less than three inches in height and shall be of a color that will contrast with the immediate background material. No person shall keep any abandoned or junk vehicle on any public property or any private property. No owner, private property, shall consent to the parking or storing of vehicles on non-improved surfaces of the property. Observation:Vehicles parked upon unimproved/non-surfaced portions of yard/grass.Vehicles with no tag/expired tag. No address numbers displayed. Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of February 26, 2019, the property is still in non-compliance.The City asked for an order of compliance within 15 days,or thereafter to be fined $50.00 per day, per violation until found in compliance. Member Lomneck,seconded by Member Odom, moved that in Case#2019-00080 the respondent be found in violation as cited as of February 19, 2019, and be given until April 11, 2019, to come into compliance or be fined$50.00 per day, per violation that remains in non-compliance. Motion carried unanimously. II. Case Resolution CASE NO 2018-00166 OFFICER DIAZ 217 S KISSIMMEE AVE JOSUE D SANDOVAL MARIELA SANDOVAL Violation Cited: §115-3.A., §115-3.B., &§165-3.A. City Code Summary: No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass, undergrowth or other dead or living plant life. No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation: Excessive weed or grass growth on the property back and front.Vehicle untagged,and inoperable on property. Misc.trash/debris on back of property on City right of way. Officer Diaz explained that this case was heard on February 26, 2019, and given until March 15, 2019,or be fined $25.00 per day, per violation that remains in non-compliance.Officer Diaz further explained that as of March 26, 2019 the property is still in non-compliance.The City asked for an order imposing fines. Member Lomneck,seconded by Member Lewis, moved that in Case#2018-00166, the Board impose fines as of March 16, 2019, as previously set by this Board. Motion carried unanimously. CASE NO 2018-00199 OFFICER SIEGRIST 6825 WOODGRAIN CT JOSEPH RIVERA CINDY ANN RIVERA Violation Cited: §108-23.Q. &§165-3.A.City Code Summary: Accessory structures. Garages,storage buildings and all other accessory structures shall be maintained and 31Page kept in good repair and sound structural condition. No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation: Fence in disrepair with missing/fallen sections/slats. Ford Expedition/blu/ NO TAG/parked in driveway. Officer Loeffler explained the property was in compliance prior to the March 05, 2019, deadline. No further action needed. CASE NO 2018-00261 OFFICER SIEGRIST 2620 COVENTRY LN CHERYL L FLANNIGAN Violation Cited: §165-3.A.City Code & §51-13. LDC Summary: No person shall keep any abandoned or junk vehicle on any public property or any private property. It shall be a violation to do work related to construction without first obtaining a permit. Observation:One (1) Ford Explorer/whi/ FL tag#164 OIF/exp.JUL-16/parked in driveway. 'Pack Rat' storage container #T803483 in driveway. Officer Loeffler explained the property was in compliance prior to the March 07, 2019, deadline. No further action needed. CASE NO 2018-00294 OFFICER LOEFFLER 1504 STARFIRE LN CHUNSHENG YU Violation Cited: §108-24.D. &§115-3.A. City Code Summary: It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove,glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items. No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. Observation:Condition constituting a nuisance and creating a blighted effect on the neighborhood; Misc.junk, debris, parts,tools, supplies,equipment,furniture littering front, side and rear yards. Items covered with tarps. Not characteristic of a residential neighborhood. Officer Loeffler explained the property was in compliance prior to the March 07, 2019,deadline. No further action needed. CASE NO 2019-00005 OFFICER RODRIGUEZ 806 WINDERGROVE CT SNIIIC TWO LLC Violation Cited: §51-13 City Code Summary: It shall be a violation to do work related to construction without first obtaining a permit. Observation: Re-roof of property without required permits, plans, approval and inspections. Officer Loeffler explained the property was in compliance prior to the March 15, 2019,deadline. No further action needed. 4IPage CASE NO 2019-00009 OFFICER LOEFFLER 9723 CLARCONA OCOEE RD STANDARD PACIFIC OF FLORIDA Violation Cited: §108-23.Q.&§115-3.A. Summary:Accessory structures. Garages, storage buildings and all other accessory structures shall be maintained and kept in good repair and sound structural condition. No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. Observation: Damaged fence with missing section; accessory structure (fence). Prohibited nuisance of misc.trash,junk, litter and debris visible to pedestrian, residents, and from roadway. Officer further explained this case was heard on February 26, 2019, and given until March 15, 2019 to come into compliance or be fined$100.00 per day, per violation that remains in non-compliance.The City asked for an order of imposing fines. Member Lomneck, seconded by Member Lewis, moved that in Case#2019-00009, the Board impose fines as of March 19,2019, as previously set by this Board. Motion carried unanimously. CASE NO 2019-00030 STEPHANIE CAFARO OFFICER RODRIGUEZ 716 BROADWAY DR PETER A CAFARO JR SUSAN CAFARO Violation Cited: §6-4.H.(6)(b) LDC Summary: Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is located behind the front yard building line and screened with a six-foot high opaque fence with gate. Observation: Unscreened two trailers in the backyard and one trailer parked on the driveway. Officer Loeffler explained this case was heard on February 26, 2019, and given until March 15, 2019 to come into compliance or be fined$50.00 per day, per violation that remains in non-compliance. Officer Loeffler further explained that as of March 26, 2019,the property is still in non-compliance.The City asked for an order imposing fines. Member Lomneck,seconded by Member Odom, moved that in Case#2019-00030, the Board impose fines as of March 16,2019, as previously set by this Board Motion carried unanimously. V.COMMENTS The Board and Staff welcomed the newest Member, Mr. Bandur, to the Board. Support Services Director Al Butler thanked all member for their service and attendance. He mentioned staff is working on refining our orders and making a separate lien document and therefore to expect to see some wording changes in these documents.
