BACKGROUND AND DISCUSSION: The City of Ocoee, for the past several years, has been using Lake Correctional Institution inmates to perform public works functions throughout the community. The prison provides approximately six inmates to the city along with a guard to provide supervision and insure community protection. We are fortunate to have this labor and their equipment provided to the city free of charge once or twice weekly. In all the time Lake Correctional Institution has provided their services to the City there has not been one incident reported and the savings to taxpayers is in excess of $60,000 annually. The amendments to this years agreement further relieve the city of liabilities which were included in last year's agreement. RECOMMENDATION: Therefore, based on the above background and discussion, it is respectfully requested that the Honorable Mayor and Board of City Commissioners approve the agreement with Florida Department of Corrections and Lake Correctional Institution. THE PRIDE OF WEST ORANGE a _J Updated 1996 FLORIDA DEPARTMENT OF CORRECTIONS INTERAGENCY/PUBLIC WORKS AGREEMENT - This agreement made and entered into this 01 st day of July 19 96, by and between the State of Florida Department of Corrections institution/facility, Lake Correctional Institution hereinafter referred to as Corrections, and City of Ocoee , hereinafter referred to as the Agency, is done in accordance with Chapter s.946.40 F.S. and the Rules of the Department of Corrections, Chapter s. 33-3.003, F.A.C., Inmate Work Program and s. 33-3.017, F.A.C., Use of Inmates in Public Works. The duration of this agreement is from July 01, 1996 to June 30, 1997 mo/dy/yr mo/dy/yr ' Work performed under this local agreement is determined to be value added or cost savings as defined in the Community Work Squad Manual. Value Added x Cost Savings 1. Corrections agrees to provide for those items so indicated with a check (✓) to the left of each appropriate number. All other items are to be marked "N/A" to the left of the number. x 1. Screen the inmates for the work to be performed to provide a reasonable basis to believe that none present a danger to property or persons. 2. Provide up to 6 inmates each workday for the period of the agreement. Medium custody ( ): minimum custody ( ): both (x ). x 3. Provide 1 vehicles and 1 Correctional Officers each workday to transport inmates assigned to the Agency and to provide supervision as agreed herein. x 4. Provide food and drinks for inmate lunches. x 5. Be responsible for the apprehension of an escapee and handling of problem inmates. Provide transportation from the work site to the correctional facility for inmates who refuse to work, become unable to work, or cause a disruption in the work schedule. x 6. Be responsible for administering all disciplinary action taken against an inmate for infractions committed while under the supervision of the Agency. 7. Provide for medical treatment for ill or injured inmates and transportation of such inmates. Inmate Labor Agreement Page 2 WA 8. Conduct a background check, which includes a criminal history check, and obtain approval by the institution/facility Superintendent or designee prior to authorizing Non-Corrections personnel to participate in training to supervise inmates. N/A 9. Provide orientation and training to non-Corrections personnel approved to supervise inmates prior to their assuming supervisory responsibility of an inmate squad. Training will be in accordance with Corrections' guidelines for non- corrections personnel supervising offenders. Provide refresher training each successive training year. LILA 10. Notify the Agency in the event one of their employees fails to provide proper supervision of inmates. x 11. Provide inmates with all personal items of clothing appropriate for the season of the year. x 12. Provide inmates for transportation/work at the appropriate times regardless of temperature or inclement weather, unless notified by the Agency of suspended work operations, or the Department determines that a squad should not check out. 13. Other(attached additional page if necessary). II. The Agency agrees to provide for those items so indicated with a check (u) to the-left of each appropriate number. All other items are to be marked "N/A"to the left of the number. 1. Provide Corrections with a schedule of hours which inmates will be worked in accordance with the established workday for the Agency and the transportation time required. Any deviation from the established schedule must be reported to an agreed to by Corrections. N/A 2. Provide supervision of inmates in accord with Department of Corrections Rules and Regulations. Non-Corrections personnel may supervise minimum and medium custody inmates. Each such person must have a background check, which includes criminal history check, and be approved by the institution/facility Superintendent or designee and complete required orientation/training in the supervision of inmates. 3. Provide transportation of inmates to and from work if such is not provided by Corrections as agreed to in Section I of this Agreement. N/A 4. Provide all tools, equipment, materials and personal items such as gloves, rubber boots, hard hats, etc., necessary and appropriate to perform the required work. Inmate Labor Agreement Page 3 X 5. Ensure that licensing or permits are obtained if required for the work to be performed. Provide necessary supervision and guidance for projects which require a permit which require technical assistance to complete the project. N/A 6. Immediately notify Corrections in the event of an escape while the inmate is under supervision of the Agency. Report any inappropriate behavior displayed by inmates or any inmate who fails to perform his tasks in an acceptable manner. N/A 7. Record daily the number of hours worked by inmates using forms provided by Corrections and submit the form on a weekly basis to Corrections. N/A 8. Report all inmate injuries, regardless of how minor in nature, to corrections as soon as possible. Medically related complaints made by an inmate shall be reported to corrections as soon as practical. In cases of emergency, first aid, within the scope of the supervisor's medical training, shall be provided, request emergency health care assistance, and assistance rendered to corrections. X 9. Provide inmates with a fifteen minute rest break in the morning and afternoon. Lunch breaks 'shall normally begin at 12 Noon and last at least thirty (30) minutes. Ensure inmates are supervised duringrest and lunch breaks. N/A 10. Provide an employee of the same sex as the medium custody inmate(s) to be immediately available to render assistance in cases where the squad supervisor is of the opposite sex as the inmate. N/A 11. Require each non-Correction person approved to supervise inmates and other appropriate staff members to attend orientation/training in the supervision of inmates prior to assuming supervision of inmates, and to attend annual refresher training in the supervision of inmates. Orientation/training to be provided by the Department. 12. Agency hereby agrees to be liable for, and shall indemnify, defend and hold Corrections harmless from all claims, suits, judgments or damages including court costs and attorney's fees arising out of intentional acts, negligence or omissions by the Agency in its supervision of inmates pursuant to this Agreement. x 13. Ensure that all work assignments/orojects utilizing inmates are authorized projects gf the municipality. city. county. governmental agency or non-profit organization and that private contractors employed by your agency do not use inmates as any part of their labor force, x 14. The Department or the Agency may suspend this agreement or terminate this agreement with immediate notice, in whole or in part, when the interests of the Department or Agency requires such termination.
