SUBJECT: Maguire / Marshall Farms Intersection
On April 28, 1993 the City Commission authorized PEC to design the intersection
improvements at this intersection and at the intersection of Maguire Road and Story Road.
PEC's design fee for the Maguire/Marshall Farms intersection was $20,584.00, and the design
was completed for that fee, including preparation of permit applications.
Within the past few months, we have been working on right-of-way acquisition, and have
identified the parcels of additional right-of-way that are required. During initial investigation,
our appraiser came upon a document which indicated the possible presence of soil
contamination on one of the affected parcels. This contamination is due to leakage from old
fuel tanks on the property formerly owned by Central Harvesting.
The contamination on the parcel affected by our project is characterized as a "trace amount"
and may not have affected us during construction, but we did not want to take a chance.
We directed PEC to perform a re-design of the project in the area of the questionable soil
conditions. Our instructions were to re-design the project in such a way that the suspect
parcels would not be needed. State and County environmental agencies are aware of the
contamination, and the site is on a list which will result in clean up as funds become available.
In addition to eliminating the need for the suspect parcels, PEC was able to utilize the latest
revision of FDOT's driveway criteria to reduce or eliminate the need for construction
easements, thus reducing the amount we will spend for these temporary easements.
In the interest of time, I authorized PEC to proceed with the re-design. They have submitted
the attached itemization of their fee for the work involved. This is in line with the fee we

discussed, and their extra work resulted in a revised plan which eliminated the requirement for
the City to obtain any property from the suspect parent tract.
I recommend that the City Commission approve the amount of$8,640.00 as a change order to
PEC's original design fee of$20,584.00 as approved on April 28, 1993.

Dear Mr. Shira:
Presented herewith are the costs incurred for the reevaluation and subsequent redesign
of a portion of the Story Road Intersection Project. The thrust of the reevaluation was
to minimize and possibly eliminate the need for additional R/W in the vicinity of the
parcels at the southern end of the project. These subject parcels are on the west side of
Maguire Road and were identified as possible contamination sites. The original design
was heavily influenced by the presence of a 4 x 8 - 4" buried telephone duct bank.
During this effort, we obtained accurate horizontal and vertical locations of the duct
bank in order to design an alternative solution.
Additionally,we used the new FDOT driveway slope criteria and revisited a number of
the driveway connections. This criteria was published after the original plans were
completed in 1993. The revised driveways have resulted in reduced temporary
construction easements in some cases as well as a complete elimination of the easements
in other cases.
Enclosed for your review is the Fee Breakdown detailing the activities. The cost of these
activities is $8,640. Listed below is a description ofthe required design services and
corresponding fee.

The plans have been updated to include the revisions noted above. No permit
modifications will be required for these changes.
