Some unforeseen conditions of the Operations Building were encountered which are unused drains found under existing tiles and an existing supply duct revealed to terminate before the connection point of the new supply duct as depicted in the plans. During construction, field changes were made to make an opening in an existing wall to increase the space and efficiency of the operator's office area. Replacement of the existing door and door frame to the operator's lab will be needed to offset repairs and to match the design of the building addition. To help ensure the building does not experience problems during adverse weather and change unforeseen/existing conditions, the contractor (Brodway Contracting) and City staff propose the following changes/additions: • Extension of concrete slab at the porch at the front of the building to the stairs at the side of the building • Addition of a drainage system from new concrete slab to curb • Leveling of floors for new tiling after existing drains are cut and capped • Additional length of supply duct installed to connect existing duct to new duct • Installation of new door and door frame to replace existing • Supports and framing to reinforce opening of the existing wall Staff is recommending the approval of Change Order No. 3 to move forward the additional work needed to change unforeseen/existing conditions and help prevent possible erosion. The Utilities Department shall be available for questions. Issue: Should the Mayor and City Commission approve Change Order No. 3 for the Wastewater Treatment #2 Operations Building Expansion Project? Recommendations: Motion for Mayor and City Commission to authorize an increase in funding for the Wastewater Treatment #2 Operations Building Expansion by $26,255.00; and authorize City Mayor to approve Change Order No. 3 with Brodway Contracting in the amount of$26,255.00. Attachments: 1. Change Order No. 3 Financial Impact: Project Available Funding: The initial Wastewater #2 Treatment Operations Building Expansion's available funding from the Capital Improvements Fund (408-531-00-6302) was $388,000.00. On April 2, 2019, City Commission approved an amount of$50,000 from available funds in the Capital Project—Carry Over (408-531- 00-6302) making available $438,000.00. Project's Expenses: Based on the initial Contract amount of $368,000.00, along with $61,258.50 from Change Order No. 1 and No. 2, and additional expenses for Change Order No. 3, the new Contract amount will be $455,513.50. Funding is available in the amount of $26,255.00 for Change Order No. 3 in the Capital Project — Carry Over (408-531-00-6302) from unused funds of the Dash-3 FDOT State Road 50 Widening Utility Work. JUSTIFICATION Due to unforeseen conditions of the Operations Building, unused drains were found under existing tiles in the process of retiling the floors, an existing door and door frame was discovered to need repair, an existing wall had to be cut open during construction and needs new reinforcements and framing, and the existing supply duct in the original building was revealed to terminate before the connection point of the new supply duct. Change Order #3 will help ensure the building doesn't experience problems during adverse weather. This change order will extend the concrete slab at the porch at the front of the building down to the stairs at the side of the building and add a drainage system to eliminate any exposure of the foundation, keeping the stairway in a safe and usable environment. The existing drains will be capped and floor will be leveled for installation of new tiles, a new door and door frame will be installed replacing the existing door frame, supports will be attached to the trusses to reinforce the new opening in the wall, and the additional length of supply duct will be installed to connect the existing duct to the new supply duct in the building addition. III. NARRATIVE OF NEGOTIATIONS The unit cost for CO3.01 —CO3.05 was reviewed by the Utilities Department along with Rhodes and Brito's Architects and found to be within reasonable range. Waste Water Treatment#2 Operations Building Expansion Bid#B18-05 IV. PAYMENT The total expenses for the additional work in conjunction with Change Order#3 are $26,255.00. The Waste Water Treatment #2 Operations Building Expansion had a budgeted amount of $388,000.00 from the Capital Improvements Fund (408). Due to the approval of Change Order #2 by City Commission on April 2, 2019, the project's budget was increased to $438,000.00 from funds in the Capital Project—Carry Over(408). Change Order #3 will increase the contract amount to $455,513.50. Unused funds for Change Order #3 are available from savings on other projects in the Capital Project— Carry Over Fund (408-531-00-6302). V. APPROVAL AND CHANGE AUTHORIZATION The original project and funding allocation was established by issuance of a CITY purchase order, subject to the terms and conditions contained in the CITY's solicitation, Project Manual, Drawings, Specifications, and/or the CONTRACTOR's service and price proposal, which collectively form the terms of an agreement between the CITY and the CONTRACTOR for the performance of the Work. This proposed change to the agreement requires approval by the City Commission under the CITY's Purchasing Rules and Regulations and is consistent with any prior action by the City Commission to award the Work to the CONTRACTOR. It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original agreement other than matters expressly provided herein. CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in contract price and time shown hereon constitute full and complete compensation and satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other claim for increased costs of performance or modifications of time will be granted by the CITY for the Work covered by this Change Order.
