City Engineer/Utilitie -Director SUBJECT: Construction Management Service Contract Attached for your review. is Addendum No. 96-4 to PEC Is continuing contract. This addendum would authorize PEC to provide construction phase services for the Forest Oaks and South Water Plant projects as well as the White Road Realignment project. The attached letter from Mr. Ken Hooper details the services to be provided as well as their proposed fees. Due to the volume of inspection work required by current development activity and the complexity of the water plant projects, we are unable to provide construction observation services with existing City staff. Similarly, the White Road project is complicated by the coordination required due to the tight work limits and maintenance of traffic requirements. We have only one city employee to inspect all current street and drainage construction projects, and this project is too large to add to that workload. PEC proposes to provide construction phase services for both projects for a combined fee of $182,823.50 which represents 6.2% of the combined construction cost which is a reasonable percentage for the work involved. I recommend that the City Commission authorize the Mayor and. City Clerk to execute Addendum No. 96-4 in the not -to -exceed amount of $1,82,823.50. City Engineer/Utilities Director City of Ocoee 150 North Lakeshore Drive Ocoee, Florida 34761 Dear Mr. Shira: Pursuant to your request we are pleased to present the attached programmatic construction phase services proposal for the Forest Oaks/South Water Plant Improvements and the White Road Improvements. Construction phase services include the following tasks: 1. Coordination of pre -construction conferences, preparation of pre -construction booklet, preparation of meeting minutes; 2. Review and approval of shop drawings; 3. Attend project progress meetings (two/month), prepare and distribute meeting minutes; 4. Review construction schedule and observe actual construction progress; 5. Provide project engineer for periodic observation of construction progress and technical assistance related to the interpretation of contract documents and provide an experienced and qualified Resident Project Representative (RPR) to afford the City extensive representation at the project site during construction. The RPR shall observe construction progress and the quality of construction to generally determine that work is proceeding substantially in accordance with Contract Documents. The on-site RPR services shall be provided 20 hours per week for the Forest Oaks and South Water Plant Improvements and 20 hours per week for the White Road Improvements. This proposal is based on forty (40) hours per week of RPR and any overtime during construction will require additional authorization. It is also noted that a third construction contract may be awarded and RPR services may be provided to the City for reconstruction of the Story Road/Kissimmee Avenue and Marshall Farms Road/Maguire Road Intersection. The intersection improvement project is anticipated to start construction by June 1996. 6. Review results of tests or inspections that the contractor is required to submit; 7. Review contractors' applications for payment; 9. Attend demonstration and review start-up of major equipment; 10. Conduct substantial completion inspection and final inspection; 11. Prepare project close-out documentation and provide recommendation to City for final payment reflecting any changes in contract time or contract price; 12. Provide reproducible set of record drawings based on data provided by contractor; 13. Provide a "Certification of Completion" set of documents to the appropriate regulatory agency(s); Our compensation for construction phase services is based on a contract duration of six months for the White Road. Improvement Project and nine months for the Water Plant Improvements. The total cost for construction phase services by PEC is $182,823.50, with $63,692.50 for the White Road Improvements and $119,131.00 for the Water Plant Improvements. Attached are manhour and fee estimates for these construction phase services. The construction contracts for the projects are $646,000.00 for the White Road Improvements and $2,292,000.00 for the Water Plant Improvements, for a total construction cost of $2,938,000.00. We propose to perform these construction phase services on an hourly not -to -exceed basis of $182,823.50. WHEREAS, the CITY and CONSULTANT entered into an AGREEMENT whereby the CITY retained the CONSULTANT to provide professional engineering services as required from time to time, and WHEREAS the CONSULTANT will perform consulting engineering services for the CITY as herein defined. NOW THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth on the part of both parties to be kept and performed, the parties do mutually agree as follows: Section 1 - Services of the Consultant 1.1 The CONSULTANT shall perform the Engineering services as outlined in the attached proposal P-6043, dated March 26, 1996 relative to the provision of consulting services to the CITY. Section 2 - Compensation 2.1 Compensation by CITY for engineering services for the construction phase services for Forest Oaks/South Water Plant Improvements and the White Road Improvements are provided under this Addendum shall be computed under Paragraph 6.1.2.3 of the Agreement, utilizing the Payroll Cost Times a Factor Method of Compensation with the compensation for the Forest Oaks/South P:\c1er\cnv\oe\ocoee\96.2.ADN -1- OE (01/02/96) Water Plant Improvements and the White Road Improvements authorization not - to -exceed $182,823.50 as outlined in the attached proposal, without further authorization from the CITY. Section 3 - Time of -Completion 3.1 The CONSULTANT shall provide the services within a 300 day period from the notice to proceed as outlined in the attached proposal.
