MEMORANDUM
TO: The Honorable Mayor and City Commissioners
of the City of Ocoee

RE: Charter Review Commission
Commissioner Glass has requested that I provide the Mayor
and City Commissioners with a memorandum explaining the
responsibilities of the Charter Review Commission so that you may
have this information available to discuss with your potential
nominees to the Charter Review Commission.
The provisions of Article X of the City Charter governs
the responsibilities of the Charter Review Commission. The Charter
provides that a Charter Review Commission must consist of five (5)
members appointed by a majority vote of the City Commission who
will serve for terms of one year unless such terms are extended by
the City Commission. A Charter Review Commission must be
established every ten (10) years, but may be established at such
other times as determined by the City Commission.
The Charter Review Commission serves as an advisory body
to the City Commission. When such a body is appointed, it is
charged with the responsibility of preparing a report to the City
Commission which sets forth recommended amendments and revisions to
the Charter, if any. Within two months of the receipt of any such
report, it must be accepted or rejected by the City Commission or
sent back to the Charter Review Commission for further study and
consideration. Any proposed Charter Amendments accepted by the
City Commission are then adopted by an ordinance which must be
submitted to the electors of the City for consideration at the next
general municipal election or at a special election. Any such

amendment would become effective upon approval by a majority of the
electors voting in any such elections .
Following appointment by the City Commission, the Charter
Review Commission should meet and elect such officers as they deem
necessary. Additionally, a meeting schedule should be established
and preliminary decision should be made regarding the conduct of
any public hearings with respect to proposed Charter Amendments .
Finally, in establishing a Charter Review Commission, the
City Commission should establish a deadline for receipt of their
report . If there are any specific issues that the City Commission
wants to have addressed, then there should be a specific direction
to the Charter Review Commission to address such issues and make
recommendation to the City Commission with respect thereto.
