Assistant City Engineer/Utilities Director SUBJECT: Continuing Horizontal Construction Services Capital Improvements Projects No. 1 and 6 Change Order Request No. 1 Attached for your review is Change Order Request No. 1 on the Continuing Horizontal Construction Services Capital Improvements Projects No. 1 and 6. This change order request was initiated by City staff due to PEC's oversight in not including the one property that has the worst drainage problem on Dovetail Court. This oversight was discovered after PEC had completed the design and the City was in receipt of the bids for this stormwater improvements project. This additional construction request was initiated not only due to the oversight; but also due to additional subsurface investigations by the subconsultant employed to inspect the underdrain installation for these initial horizontal construction projects. This change order request was further enhanced by the excessive rainfall from tropical storm Josephine and the results witnessed by staff and its consultants. The excessive rainfall occurred during the same time period that Dr. Seereeram, P.E. and his soils technician performed additional soils investigation in the backyards of the Fergus and Murray properties. The original design solved the drainage problems along the rear and side lot lines and partially assisted in the drainage problems behind the Murray house. Since the initial investigations by PEC which prompted the design were performed,the drainage problems have become worse and warrant the additional underdrains and surface drains in both properties. The contractor for this project and City staff have negotiated the scope and cost for the change order to ensure that the City is only incurring reasonable costs for the additional construction. Had this additional work been included in the original design project, staff feels certain that the costs would have been the same. I recommend that the City Commission approve Change Order No. 1 by increasing the contract amount by$34,492.00, with an extension in contract time of fourteen calendar days, and authorize the Mayor and City Clerk to execute Change Order No. 1. GENERAL This Change Order is necessary to cover changes in the Work to be performed under this Contract. The GENERAL CONDITIONS, SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and all parts of the Project Manual listed in Article 1, Definitions, of the GENERAL CONDITIONS apply to and govern all work under this Change Order. Change Order No. 1 II. REQUIRED CHANGES Provide changes to comply with City of Ocoee review comments regarding additional rear yard underdrains for Coventry Subdivision Lots 100 and 101, and review comments by the project geotechnical engineer(Devo Seereeram, Ph.D., P.E.)regarding the addition of a swale and alternative trench material on the rear yard underdrain detail. JUSTIFICATION The current project geotechnical engineer (Devo Seereeram, Ph.D., P.E.) was made,a part of the project team following bidding of the project, due to PEC/Professional Engineering Consultants (Engineer) concern with regard to the lack of direction/guidance provided by the previous project geotechnical engineer. Therefore, this change order is predicated on a very detailed review and investigation conducted by the current project geotechnical engineer (Devo Seereeram, Ph.D., P.E.)at the request of the Engineer, and is based entirely upon the site specific conditions prevalent at Coventry Subdivision Lots 100 and 101 at the time of this investigation. IV. PAYMENT Following Change Order approval, additional compensation will be provided to the Contractor based upon the percentage completion of the described Work up to the Lump Sum Value of$34,492.00, via the Periodic Estimate for Partial Payment (00861). V. NARRATIVE OF NEGOTIATIONS Following completion of the construction plans which depict the proposed revisions as previously discussed, a meeting was conducted between representatives of the City of Ocoee (Owner), PEC/Professional Engineering Consultants (Engineer) and Georgetown Enterprises(Contractor). Upon comparison and review of the Engineer's and Contractor's Estimate(s), the proposal from the Contractor dated October 11, 1996 in the amount of$34,492.00 was verbally accepted by the Owner. APPROVAL AND CHANGE AUTHORIZATION This proposed change to the Contract is to be approved by the Ocoee City Council. 00842(1)-2 C:\WORK\W P61\OE-25T1-1A6\00842(1) • • Acknowledgments: The aforementioned change, and work affected thereby, is subject to all provisions of the original contract not specifically changed by this Change Order; and, It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original contract other than matters expressly provided herein. CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other claim for increased costs of performance or modifications of time will be granted by the OWNER for the Work covered by this Change Order.
