Wagner, AICP, Director of Planning SUBJECT: Olympia Development Group, Inc. - Joint Planning Area Land Use Map Change CASE #: JPA-98-001 ISSUE: Should the City Commission approve,the above application to change the Joint Planning Area Land Use Designation of a +/-15 acre parcel from Low Density Residential to Commercial? BACKGROUND: The subject property is located on the southeast corner of Clarke Road and Silver Star Road. It is approximately 15 acres in size and is part of a larger 38 acre parcel within an Orange County enclave situated in the Ocoee Joint Planning Area. The overall parcel abuts the City of Ocoee to the north, east, west, and southeast. In 1995, the City of Ocoee received an annexation and rezoning request for the 38 acre tract which has been pending since that time. Recently, Orange County Library System Staff met with the City of Ocoee Planning Staff to identify possible library sites. The Library Staff identified a future library site located on the 38 acre tract, immediately to the east of the 15 acre subject property. Olympia Development Group, Inc., the contract purchasers, have finalized a contract for purchase (at a reduced price) with the Orange County Library System'pending approval of the requested 15 acre commercial node on the corner of Clarke Road and Silver Star Road. The subject property has historically been zoned A-1, Citrus Rural District, in Orange County. When the Joint Planning Area Agreement was adopted in 1994, the subject property was identified for Low Density Residential (< 4 dua) development only. Commercial development has occurred within Ocoee on two of the corners at this intersection and the third corner is vacant with Ocoee.commercial :zoning. Other land uses surrounding this Activity Center node are largely Low Density Residential. Staff Report to the Honorable Mayor and City Commissioners Subject: Olympia Development Group, Inc. - Joint Planning Area Land Use Map Change May 13, 1998 • Page 2 DISCUSSION: Although the Orange County Comprehensive Policy Plan does not encourage commercial uses on all four quadrants of an intersection, the Ocoee Comprehensive Plan identifies the intersection of Clarke Road and Silver Star Road as an Activity Center which does allow commercial uses on each of the corners. It is important to note that the requested Commercial land use would not take effect until after the property is annexed into the City of Ocoee. In Orange County, the existing Future Land Use designation remains in effect. If the requested Joint Planning Area Land Use Change is approved, the City of Ocoee would subsequently annex the entire 38 acre tract, amend its land use plan, and rezone the property to allow the 15 acre commercial node, and perimeter single family development. It should also be noted that library and school uses are allowed by the Ocoee Land Development Code as public buildings within any zoning category upon authorization of the City Commission after conducting a duly advertised public hearing on the request. Under the Joint Planning Area Agreement, the proposed change to the Joint Planning Area Land Use Map must be approved by the City and County at advertised public hearings. Approval of this amendment can be accomplished without a comprehensive plan amendment. However, as indicated above, a comprehensive plan amendment will be necessary following annexation. Attached hereto is a draft of the proposed amendment to the Joint Planning Area Land Use Map between Orange County and the City of Ocoee. This document will effectuate the requested change. PLANNING AND ZONING COMMISSION MEETING: On May 12, 1998, the Planning and Zoning Commission held a de novo public hearing regarding the Olympia Development Group, Inc. application. The Planning and Zoning Commission Members asked a few questions about the subject property before voting unanimously to recommend approval of the requested Joint Planning Area Land Use Map Amendment as recommended by Staff. STAFF RECOMMENDATION: Staff recommends that the Honorable Mayor and City Commissioners APPROVE the requested Joint Planning Area Land Use Map Change from Low Density Residential (< 4 dua) to Commercial, upon finding the Olympia Development Group, Inc. application to be consistent with the character of surrounding land uses and the proposed use of an adjacent site as a library.
