SUBJECT: Admiral Pointe Phase II Plat Affidavits
Background
At the City Commission meeting on March 2, 1999 the Mayor and City Commissioners
approved the Admiral Pointe Phase II Final Plat and Replat Agreement. The agreement provided
for the builder to pull permits to build and sell homes on all lots except lots 13 through 22. It
was felt, at that time, a replat would have to be submitted at some future date to clarify and
correct construction limit lines on lots 13 through 22.
Solution
An alternate to submitting a replat has been found acceptable by the city attorney's office. The
two attached affidavits can be approved and recorded by the city, eliminating the need for
replatting. The "Clarification Affidavit"with attached Exhibit"A" clarifies the construction
limits line on lots 13 through 19.
The second affidavit acknowledges a scrivener's error, which showed a"Construction Limits
Line" on lots 20 through 22. The second affidavit removes the construction limits line on these
lots.
Recommendation
Staff recommends that the Board of City Commissioners authorize the Mayor and City Clerk to
execute the affidavits as submitted.

Inc., a surveying corporation;
That the said corporation, Bowyer-Singleton &Associates, Inc., did prepare the Plat of ADMIRAL POINTE
PHASE II, recorded in Plat Book 41, Pages 79 - 81, Public Records of Orange County, Florida;
That this affidavit is made for the purposes of clarifying the "Construction Limits Line" as shown on said
plat. See Exhibit "A" attached hereto. A survey done within the last 10 days shows that there are no
conflicts with the clarifications stated above. •
