Shira, P.E. City Engineer/Utilif s irector SUBJECT: Water System Improvements Design Services Contract with Professional Engineering Consultants, Inc. The 1997 Water and Sewer Utility Bond issue included $3,123,000 for water distribution system improvements and $649,000 for engineering and inspection services related to water system projects. In meeting with Professional Engineering Consultants, Inc. (PEC), we have been able to fine-tune the proposed water distribution network, taking into account those water lines which have been or will be installed by developers. By removing these from the list of proposed water lines used in the bond issue, we have been able to lower the estimated construction cost from $3,123,000 to $ 2,500,700, a 20% reduction. Attached for your review and action is a proposal from PEC for the design services required for this project, and Addendum No. 97-3 to their contract. PEC's proposal is based on a fee of 7% of the actual cost of construction. The anticipated fee is $175,100 based on the estimated construction cost of$2,500,700. Your approval of this Addendum will allow us to proceed with design of this important project. Design services will be complete in late January 1998, and we should be ready to advertise for bids in early March 1998. I recommend that the City Commission authorize the Mayor and City Clerk to execute Addendum No. 97-3 to Professional Engineering Consultants, Inc.'s contract in the not-to-exceed amount of 7% of the construction cost of the water distribution system improvements. THE PRIDE OF WEST ORANGE ADDENDUM NO. 97-3 TO AGREEMENT FOR CONSULTING ENGINEERING SERVICES INCLUDING ENGINEERING DESIGN AND PERMITTING SERVICES FOR EXPANSION OF POTABLE WATER DISTRIBUTION SYSTEM This Addendum No. 97-3 hereinafter called the Addendum, as of this 5th day of August, 1997, shall constitute an Addendum to the Agreement for Consulting Engineering Services between the City of Ocoee, Florida (the CITY) and Professional Engineering Consultants, Inc., 200 East Robinson Street, Suite 1560, Lake Eola Centre, Orlando, Florida(the CONSULTANT), dated the 21st day of August, 1984, hereinafter referred to as the AGREEMENT. WHEREAS, the CITY and CONSULTANT entered into an AGREEMENT whereby the CITY retained the CONSULTANT to provide professional engineering services as required from time to time, and WHEREAS the CONSULTANT will perform' consulting engineering services for the CITY as herein defined. NOW THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth on the part of both parties to be kept and performed, the parties do mutually agree as follows: Section 1 - Services of the Consultant 1.1 The CONSULTANT shall perform the Engineering services as outlined in the attached proposal P-7036R2, revised as of July 7, 1997 relative to the provision of consulting engineering services to the CITY. Section 2 - Compensation 2.1 Compensation by CITY for engineering services provided under this Addendum shall be computed under Paragraph 6.1.2.3 of the Agreement, utilizing the Percentage of Construction Value (Lump Sum) Method of Compensation with the compensation for this authorization not-to-exceed 7% of the cost of construction of the water system improvements as outlined in the attached proposal, without further authorization from the CITY. The estimated design and permitting fee is $175,100. Section 3 - Time of Completion 3.1 The CONSULTANT shall provide the services within six (6) months as described in the attached proposal. City Engineer/Utilities Director City of Ocoee 150 North Lakeshore Drive Ocoee, Florida 34761 Re: Proposal for Engineering Design Services Water System Distribution Improvements Dear Jim: We are pleased to present the attached revised proposal for the engineering design and permitting services related to expansion of the City's potable water distribution system. This proposal has been revised to reflect the changes discussed in our meeting June 19, 1997. These changes include the deletion of several pipeline alignments and an increase in the pipeline diameter along several segments. The changes are summarized in Attachment A for your reference. The City has planned for the expansion of the water distribution system through the Series 1997 Water and Sewer Revenue Bonds. The Engineer's Report for the 1997 Bond Issue describes the proposed water distribution system improvements consisting of three (3) phases or levels of service and provides a construction cost estimate of $3,123,000. All three (3) phases will be designed under this scope of work. As discussed during our meeting, the revenue committed for this Bond issue is the Water Connection Fees (Impact Fees). Because the outlying undeveloped areas (Phase 3) are presently more costly to serve than other established areas within the City, we concluded that the Connection Fees should vary to reflect the cost of providing water service to these areas. Water Service Districts would be established which would reflect the cost of providing water service, i.e., the outlying undeveloped areas would require a higher Connection Fee. Based on the pipeline alignment and pipeline size changes made during our meeting, the total linear footage of pipe has decreased from 70,020 LF to 56,050 LF while 7,300 LF increased in size form 12-inch to 16-inch near the South WTP. The background of this exhibit now uses an aerial raster image dated about April, 1997 of the Ocoee planning area The alignments are still preliminary as we discussed in our meeting, and additional preliminary engineering analysis and evaluation will be necessary to select specific cost effective pipeline alignments for the identified segments. Our fee proposal is based on a not-to-exceed amount of 7% of the cost estimate for construction of the water distribution system improvements. It is our understanding that the fee for preliminary design, final design and permitting will not exceed 7% of the actual cost of construction of the water distribution system improvements. The 7% fee is based on an average complexity of design. Our estimate of the maximum design and permitting fee is $ 175,100. This proposal does not include fees for bidding assistance or construction phase services. At a later date the City may request a proposal for services of PEC to provide bidding phase services and construction administration. This proposal does not include eminent domain assistance by PEC. If any eminent domain or acquisition assistance is necessary PEC will provide the services on a parcel by parcel basis as authorized by the City of Ocoee.
