Brookestone Unit 1 Subdivision is a 141 lot single family subdivision located on the west side of
Maguire Road, south of the Florida turnpike. All appropriate documentation pertaining to the plat
has been received and approved.
A Performance Bond has been posted guaranteeing the completion of all site work, including the
installation of upgraded street lighting prior to Centex Homes filing for occupancy permits with
the City.
The two blanks on sheet 1 of the plat have been intentionally left blank. This information will be
included on the plat once the Declaration of Covenants, Conditions and Restrictions has been
recorded with the County. This declaration defines the common areas of this Subdivision and
will be issued a book and page number once this plat has been approved by the City.
I recommend the City Commission approve the final plat of the Brookestone Unit 1 Subdivision
as submitted.

SURVEYOR'S NOTES.
- Bearings based on the East line of the Southeast 1/4 of Section 30, Township
22 South, Ronqe 28 East, being S 00'44'12" E, an assumed meridian.
NOTICE. This plat, as recorded in its graphic form, is the
official depiction of the subdivided lands described herein and
will in no circumstances be supplanted in authority by any
other graphic or digital form of the plat. There may be
additional restrictions that are not recorded on this plat that
may be found in the public records of this county.
- All lines ore radial to curves unless otherwise noted as non radial (NR).
- A 10.00 foot wide utility and drainage easement is reserved within each lot
adjacent to all right-of-way lines.
- A 5.00 foot wide utility and drainage easement is reserved within each lot
adjacent to all side lot lines except those side lot lines also being right-of-
way lines.
- A 5.00 foot wide drainage easement is reserved within each lot adjacent to
all rear lot lines except within lots 57, 58, 64 & 65 which are to be 5.00 foot wide
drainage and utility easements.
- The surface area encumbered by all utility and drainage and utility
easements lying within any individual lot shall be maintained by the owner
of that lot. The utilities underlying such lots shall be maintained by
Brookestone Property Owners Association, Inc. (the "Homeowners'
Association").
- Vehicular access rights to Lots and Tracts abutting Tomyn Boulevard and
Maguire Road are dedicated to the City of Ocoee.
- Concurrency, Note: The City is subject to the terms, provisions and
restrictions of F.S. Chapter 163 concerning moratoriums on the issuance of
building permits under certain circumstances. The City has no lawful
authority to exempt any private entity, or itself, from the application of such
state legislation and nothing herein shall be construed as such an exemption.
- Tracts A, B, C, D, E, G, H, 1, J, K, L, M, 0, P and Q depicted on this plat
constitute "Common Areas" as defined in the Declaration of Covenants,
Conditions and Restrictions, recorded in Official Records Book _ Page
, of the Public Records of Orange County, Florida (hereinafter referred
to as the "Declaration"). Said Tracts are not required by and are not
dedicated to the City of Ocoee or the general public, except as expressly
stated on the face of this Plat. Said Tracts are reserved for the common use
and enjoyment of the owner and of the owners of residential lots described
in the Declaration. The nature and extent and the reservations and
restrictions governing the use and enjoyment of said Tracts are more fully
set forth in those provisions of the Declaration pertaining to Common Areas
and in the following notes.
- Tracts A, B, C, D, E, G, H, 1, J, K, L, M, 0, P and Q shall be owned and
maintained in accordance with and pursuant to the Declaration and by the
Homeowners' Association.
- Owner does hereby grant to the City of Ocoee an easement for access and
utility rights within Tracts A, B, C, D, E, G, H, 1, J, K, L, M, 0, P and Q
as are necessary for emergency purposes and for maintenance of equipment
and facilities which are owned or operated by the City and which lie within
said Tracts or within the subject property.
- Owner dedicates a non-exclusive easement through, over, under and across
each Tract for use by utility companies to construct, maintain and replace
their respective facilities servicing the subject property, but only to the
extent that the use of such easement does not and shall not interfere with the
purpose for which each Tract is dedicated.
- Tracts A, B, C, H, J, K and Q will be used as "Stormwater Retention
Areas". Items to be constructed, maintained and operated within said Tracts
may include, without limitation, drainage control structures, pipes and
similar improvements. Drainage Easements are hereby dedicated to the City
of Ocoee over the entire Tracts A, B, C, H, J, K and Q and Conservation
Easements are hereby dedicated to the City of Ocoee over the entire Tracts
H, J, K and Q.
- Tracts D and 0 are Conservation Areas. Conservation Easements and
Drainage Easements over entire Tracts D and 0 are hereby dedicated to the
City of Ocoee.
- Tracts E, I and L are dedicated for access including, without limitation,
access to the residential lots to be located on the subject property. Items to
be constructed, maintained and operated within said Tracts may include,
without limitation, the paved surface of roadways, utilities, stormwater
drainage improvements and any landscaped areas lying within said Tracts.
Drainage easements are hereby dedicated to the City of Ocoee over the
entire Tracts E, I and L.
- Tract F is a Lift Station Tract to be owned and maintained by the City of
Ocoee.
- Tract M is a Wall and Landscape Tract. A Drainage Easement is hereby
dedicated over the entire Tract M to the City of Ocoee.
- Tract P is a Park to be owned and maintained by the Homeowner's
Association. A drainage easement is hereby dedicated over the entire Tract
P to the City of Ocoee.
- Sight Line Easements on Lots 49 & 50 are dedicated to the City of Ocoee.
All landscape and improvement installations within the sight line easements
shall be approved by the City of Ocoee.
- The brick wall and landscaping within the Wall and Landscape Easements
are to be maintained by the Homeowners' Association. The land burdened
by such easements. shall be owned by the individual lot owners.
- Cable Television Note (per Chapter 177, Florida Statutes):
"All platted utility easements shall provide that such easements shall also be
easements for the construction, installation, maintenance, and operation of
cable television services, provided, however, no such construction,
installation, maintenance, and operation of cable television services shall
interfere with the facilities and services of an electric, telephone, gas, or
other public utility. In the event a cable television company damages the
facilities of a public utility, it shall be solely responsible for the damages.
This section shall not .apply to those private easements granted to or obtained
by a particular electric, telephone, gas, or other public utility. Such
construction, installation, maintenance, and operation shall comply with the
SHEE T 1 OF 3
National Electrical Safety Code as adopted by the Florida Public Service
Commission."

"in those counties or municipalities that require subdivision improvements
and have the means of ensuring the construction of those improvements,
