DATE: JANUARY 24, 2000 SUBJECT: DEMOLITION OF ABANDONED DWELLING LOCATED WITHIN CUMBERLAND AVENUE RIGHT-OF-WAY ISSUE Should the Honorable Mayor and Board of City Commissioners approve the demolition of a structure located on public property? BACKGROUND/DISCUSSION There is an abandoned, dilapidated single family dwelling, which is located entirely on a city owned road right-of-way (S. Cumberland Avenue). The residence was used in the past as a rental unit by the previous owners of the adjacent property (west common property line). The current owners of the adjacent properties are Wingate, Kenneth R. and Wingate, Bonny B. Lee (H/W), and Wingate, Donald A. and Wingate, Carole P. (H/W). I discussed this situation with the Wingates and was informed that they had no claims on the building or property and that they may at sometime in the future request the City to abandon certain sections of Cumberland Avenue. Due to this building being abandoned (for approximately two (2) years) and dilapidated, it has been posted by the City as unsafe for human occupancy. A research of Orange County Tax Records revealed the building was never on the county tax rolls or records. Bob Smith, Director of Public Works, informed me that he will demolish and remove the building using City Personnel and equipment at an estimated cost of one thousand ($1,000) dollars. RECOMMENDATION Staff respectfully recommends approval of the demolition of an abandoned dwelling located within Cumberland Avenue Right-of-Way. Off- PoWIu Protect Ocoee's Water Resources
