Code Enforcement Board
April 23, 2019
I. CALL TO ORDER
Chairman Lowery called the Code Enforcement Board regular meeting to order at 7:01 p.m. in the Commission
Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida.
A. INVOCATION: Member Odom initiated the moment of silence.
B. PLEDGE OF ALLEGIANCE: Member Lomneck led the Board in the Pledge of Allegiance to the U.S. flag.
C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared
quorum (4) present.
PRESENT: Chairman Lowery & Members Lomneck, Odom, Bandur, & Mirza.
Also present: Board Attorney Mary Sneed, Assistant Support Services Director Doug Gaines,
Code Enforcement Clerk Justin Mieras, and Code Enforcement Officers Diaz, & Loeffler.
ABSENT: Vice -Chairman Carrington and Lewis are excused absences.
D. SWEARING OF OFFICERS/WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code
Enforcement Officers and to anyone intending to speak regarding a case.
II. CONSENT AGENDA
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT
BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS
UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE
BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY.

B. DISMISSAL OR COMPLIANCE: Assistant Support Services Director Doug Gaines presented the dismissals and
compliances.

Member Lomneck seconded by Member Odom moved that the supplemental consent agenda be accepted as
presented. Motion carried unanimously.
III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS
CASE NO 2019-00191
OFFICER LOEFFLER 1 831 LICARIA DR JOHN N DENT ESTATE
Violation Cited: §6-4.H.(6)(b), §115-3.b, & §165-3.A.
Summary: Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is
located behind the front yard building line and screened with a six-foot high opaque fence with gate.
No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass,
undergrowth or other dead or living plant life. No person shall allow or allow to remain any Junk or Debris classified as
nuisance and menace to public health, safety and welfare.
No person shall keep any abandoned orjunk vehicle on any public property or any private property.
Observation: RV Camper parked / stored in prohibited location, tall weeds and grass, vehicle with expired tag.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of April 23, 2019, is still
in non-compliance for only violations §6-4.H.(6)(b) & §165-3.A. The City asked for an order of compliance within 15 days,
or thereafter to be fined $25.00 per day, per violation until found in compliance.
Member Lomneck, seconded by Member Odom, moved that in Case #2019-00191, the respondent be found in violation
of code 6-4.H.(6)(b) & §165-3.A. as of March 27, 2019, and be given until May 8, 2019, to come into compliance or be
fined $25.00 per day, per violation that remains in non-compliance. Motion carried unanimously.
IV. CASE RESOLUTION
CASE NO 2018-00271

Violation Cited: §115-3.A. & B. and §165-3.A. & B. City Code and 6-4.H.(6)(a) LDC
Summary: No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass,
undergrowth or other dead or living plant life. No person shall allow or allow to remain any Junk or Debris classified as
nuisance and menace to public health, safety and welfare.
No person shall keep any abandoned orjunk vehicle on any public property or any private property.
No more than one commercial vehicle, under one and one -half -ton, allowed on the premises.
Observation: Vehicle untagged, and inoperable on property. Misc. junk/debris on property. Overgrown grass/weeds.

Commercial vehicles stored on property.
Assistant Support Services Director Doug Gaines explained the property was in compliance upon reinspection on March
28, 2018. No further action needed.
CASE NO 2018-00080
OFFICER LOEFFLER 328 SPRINGFOOT CT DANIEL AVILES

Violation Cited: §54-3.A.(1)D., §165-3.A., & §168-6.B.(1) City Code
Summary: The building numbers shall not be less than three inches in height and shall be of a color that will contrast
with the immediate background material.
No person shall keep any abandoned orjunk vehicle on any public property or any private property.
No owner, private property, shall consent to the parking or storing of vehicles on non -improved surfaces of the
Observation: Vehicles parked upon unimproved / non -surfaced portions of yard/grass. Vehicles with no tag / expired
tag. No address numbers displayed.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of April 23, 2019, the
property is still in non-compliance. The City asked to impose fines as previously set by the Board.
Member Odom, seconded by Member Lomneck moved that in Case #2019-00080 the Board imposes fines as of April
12, 2019, as previously set by this Board. Motion carried unanimously.
