BACKGROUND: The Glenfinnan Subdivision will include a total of 76 single family residential lots, located at the southeast corner of the intersection of Clarke Road and Clarcona-Ocoee Road. The subject property is zoned R-1-AA, which provides for minimum 75 foot wide / 9,000 square foot lots, with a minimum living area of 1,400 sf. The property surrounding the proposed subdivision has Orange County A-1 zoning (north, east and west - mostly vacant pasture land) and R-1-A zoning (south - SF homes). The subject property is currently vacant with a mixture of trees. DISCUSSION: The Glenfinnan Subdivision will have one primary point of access from Clarke Road. The plan also provides two points for future access to the adjacent properties to the east, to allow those properties to have indirect access to Clarke Road through this subdivision. There will be a 6 foot brick wall with appropriate landscaping along the entire western and northern boundaries of the subdivision adjacent to Clarke Road and Clarcona-Ocoee Road. The recreation area for the project is centrally located adjacent to one of the retention ponds and will include a tot lot, a picnic table and benches. Water and sewer utilities for the subdivision will be provided by Orange County since it is not within the City's utility service area. A unique feature of this subdivision is that it involves a land swap with the City. The developer proposes to swap the land currently occupied by the existing retention pond on the property (owned by the City) with a parcel of land on Clarcona-Ocoee Road and some additional right-of-way for Clarke Road. The existing retention pond provides stormwater management for Clarke Road. When this subdivision is developed, that pond will be eliminated and the stormwater retention relocated to a new pond (Tract A) which will serve both Clarke Road and this subdivision. The new pond will be owned and maintained by the homeowners association. The benefits to the City of this land swap are as follows: 674- PowFy Protect Ocoes's Water Resources February 7, 2000 Honorable Mayor and City Commissioners Page 2 • The City gains additional right-of-way for future widening of Clarke Road. • The parcel of land on Clarcona-Ocoee Road which will be conveyed to the City (Tract F) can be used by the City as part of its contribution to the County's road widening project for that road. • Even though Tract F will be owned by the City, it will be maintained by the homeowners association until the land is transferred to the County. • The existing pond is currently surrounded by a chain link fence and can be considered an eyesore. The new pond will be behind a brick wall, thus eliminating the eyesore. • The existing pond is difficult to maintain, but the new pond will be maintained by the homeowners association. • Since the new pond will not be owned or maintained by the City, any liability the City has associated with the existing pond will be eliminated with the new pond. • Land which is currently not on the tax roll will be added to generate new revenue. Since there is a land swap and a right-of-way dedication involved in this project, there will be a Development Agreement with this subdivision. That agreement is being processed concurrently with the Preliminary Subdivision Plan. The Conditions of Approval for the Glenfinnan Subdivision are listed on Sheet 1 of the plan set. There is one proposed waiver from Code requirements regarding the 24' minimum pavement width. The developer wants to use the standard 24' pavement width on most of the streets, but a 20' pavement width on two small cul-de-sacs. The proposed waiver is supported by Staff. The attached Preliminary Subdivision Plan for the Glenfinnan Subdivision was reviewed by the Development Review Committee (DRC) on December 22, 1999. The Committee voted unanimously to recommend approval of the Preliminary Subdivision Plan, including the proposed waiver. PLANNING & ZONING COMMISSION RECOMMENDATION: On January 26, 2000, the Planning and Zoning Commission held a public hearing regarding the Preliminary Subdivision Plan for the Glenfinnan Subdivision. During the hearing, Staff and the applicant responded to a few questions from the Commission and the audience. When the discussion was finished, the Planning and Zoning Commission voted unanimously to recommend approval of the Preliminary Subdivision Plan for the Glenfinnan Subdivision, date stamped received by the City on January 19, 2000, in accordance with the staff recommendation. STAFF RECOMMENDATION: Based on the recommendations of the DRC and the Planning and Zoning Commission,Staff respectfully recommends that the Mayor and City Commissioners approve the Preliminary Subdivision Plan for the Glenfinnan Subdivision, including the proposed waiver, as date stamped received by the City on January 19, 2000, subject to City Commission approval of the Development Agreement.
