(7'` -r, - C '_ Project#AP-99-05-04 - r ISSUE: Should the Mayor and City Commissioners approve the PUD Zoning and Land Use Plan for Cambridge Village? BACKGROUND: Cambridge Village will include a maximum of 34 single family residential lots, located on the south side of White Road, just east of Clarke Road. The subject property is currently being considered for annexation and has Orange County Agricultural zoning. The property surrounding the proposed subdivision has R-1-A zoning (north - SF homes), PUD zoning (west - proposed SF subdivision and West Oaks Mall, and south -West Oaks Mall), and Orange County R-1A zoning (east- Rose Hill SF subdivision). The subject property is currently vacant with a mixture of trees, including a significant number of oak trees. DISCUSSION: The Cambridge Village subdivision will have one point of access from White Road, through the same access road which is part of the adjacent Villages of West Oak subdivision. The PUD Land Use Plan shows the retention pond and recreation area separating the lots from White Road. There will be a 6 foot brick column/decorative metal fence with appropriate landscaping along the north and west sides of the retention pond, adjacent to White Road and the entrance road. The plan also shows a wood fence with a landscape buffer along the western and southern boundaries adjacent to the West Oaks Mall. A 10 foot natural landscape buffer will be provided along the eastern boundary adjacent to the Rose Hill subdivision. The minimum lot size in this PUD will be 50' x 110' (5,500 sf), which is the same size as recently approved for the Villages of West Oak subdivision (V of WO). However, the minimum living area will be 1,500 sf, which is larger that the minimum living area provided in that previous subdivision (1,200 sf). This PUD will have 20' front setbacks, 20' street side setbacks and 25' rear setbacks (like V of WO), but it will have 7.5' side setbacks (larger than V of WO - 5'). The recreation area for the project is located just inside the entrance adjacent to the retention pond and will include a picnic tables and benches. POW dk. Pratect Ocoees.Watef Resources February 7, 2000 Honorable Mayor and City Commissioners Page 2 A unique feature of this site is that there are existing public road rights-of-way which have not been improved along the entire eastern and southern boundaries of the property. Neither the adjacent existing developments (Rose Hill subdivision and the West Oaks Mall) nor the proposed Cambridge Village PUD will ever utilize those public rights-of-way. Therefore, this PUD Land Use Plan includes a Condition of Approval which requires the developer to apply to the City to have those unused rights- of-way vacated. The Condition states that the City Commission must take final action on that application prior to City Commission approval of the Preliminary Subdivision Plan. If those rights-of- way are vacated, the additional land which is conveyed to owner of the subject property will automatically be incorporated into this PUD Land Use Plan. As with many other PUD Land Use Plans, this Plan provides 10' of additional right-of-way for White Road, which matches additional right-of-way for White Road dedicated with the PUD for the adjacent Villages of West Oak subdivision. A Development Agreement will be provided which incorporates the PUD Conditions of Approval and the standard provisions for the right-of-way dedication. That agreement has been processed concurrently with the PUD Zoning and PUD Land Use Plan and will be considered by the City Commission on tonight's agenda. The Conditions of Approval for the Cambridge Village PUD are listed on the plan. There is one proposed waiver from Code fequirements regarding the 800 foot maximum cul-de-sac length. Due to the unique configuration of this site, the cul-de-sac will need to be approximately 1,400 feet long. This proposed waiver is supported by Staff, since there is no other practical alternative. The attached PUD Zoning and Land Use Plan for Cambridge Village was reviewed by the Development Review Committee (DRC) on December 22, 1999. The Committee voted unanimously to recommend approval of the proposed PUD Zoning and Land Use Plan, including the proposed waiver, subject to City Commission approval of the proposed annexation and the Development Agreement and a few minor revisions to the Plan. All of the revisions requested by the DRC have been satisfactorily addressed in these plans. PLANNING &ZONING COMMISSION RECOMMENDATION: On January 26, 2000, the Planning and Zoning Commission held a public hearing regarding the PUD Zoning and Land Use Plan for Cambridge Village. During the hearing, Staff and the applicant responded to questions from the Commission and the audience.When the discussion was finished, the Planning and Zoning Commission voted 5-2 to recommend approval of the PUD Zoning and Land Use Plan for Cambridge Village, date stamped received by the City on January 19, 2000, in accordance with the staff recommendation, subject to the construction of a brick wall along the western and southern boundaries consistent with the adjacent properties, to be funded by the mall if possible, but if not, then by the Developer. STAFF RECOMMENDATION: Based on the recommendations of the DRC and the Planning and Zoning Commission,Staff respectfully recommends that the Mayor and City Commissioners approve the proposed PUD Zoning and Land Use Plan for Cambridge Village, including the proposed waiver, as date stamped received by the City on January 19, 2000, subject to City Commission approval of the proposed annexation and Development Agreement. WHEREAS, the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission"), has as of the date of adoption of this Ordinance, annexed into the corporate limits of the City of Ocoee certain real property now located in the City of Ocoee, Orange County, Florida as hereinafter described; and WHEREAS, the owner or owners (the "Owner") of certain real property located within the corporate limits of the City of Ocoee, Florida, as hereinafter described, have submitted an application to the City Commission to rezone and establish an initial zoning classification for said real property of Ocoee, "PUD", Planned Unit Development District (the "Initial Zoning"); and WHEREAS, pursuant to Section 5-9(B) of Article V of Chapter 180 of the Code of Ordinances of the City of Ocoee (the "Ocoee City Code"), the Planning Director has reviewed • said application and determined that the Initial Zoning requested by the Owner is consistent with the 1991 City of Ocoee Comprehensive Plan as set forth in Ordinance No. 91-28, adopted September 18, 1991, as amended (the "Ocoee Comprehensive Plan"); and WHEREAS, on February 11, 1994, Orange County and the City of Ocoee entered into a Joint Planning Area Agreement which has been amended from time to time (the "JPA Agreement") and 'WHEREAS, the JPA Agreement affects the future land use of the real property hereinafter described; and - WHEREAS, pursuant to the provisions of Section 6(B) of the JPA Agreement, the City has the authority to establish an initial zoning for the real property hereinafter described and to immediately exercise municipal jurisdiction over said real property for the purposes of Part II of Chapter 163, Florida Statutes; and WHEREAS, the Initial Zoning was scheduled for study and recommendation by the Planning and Zoning Commission of the City of Ocoee ("PZC"); and WHEREAS, the PZC has held a public hearing with public notice thereof and reviewed the Initial Zoning for consistency with the Ocoee Comprehensive Plan and the JPA Agreement and determined that the Initial Zoning is consistent with the Ocoee Comprehensive Plan and the JPA Agreement and is in the best interest of the City and has recommended to the Ocoee City Commission that it approve the Initial Zoning and find it consistent with the Ocoee Comprehensive Plan and the JPA Agreement; and 'WHEREAS, the Ocoee City Commission has held a de novo public hearing with public notice thereof with respect to the Initial Zoning; and -2- 006.166431.1 WHEREAS, this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041(3), Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Initial Zoning. The zoning classification, as defined in the Ocoee City Code, of the following described parcel of land containing approximately 8.97 acres located within the corporate limits of the City of Ocoee, Florida, is hereby changed from Orange County "A-1", Citrus Rural District, to Ocoee "PUD", Planned Unit Development District: See Exhibit "A" attached hereto and by this reference made a part hereof (the "Property"). SECTION 3. Map. A map of the Property which clearly shows the area of Initial Zoning is attached hereto as Exhibit "B" and by this reference is made a part hereof. SECTION 4. Land Use Plan. The following Land Use Plan for the Property is hereby approved subject to the Conditions of Approval and Waiver(s) from the Ocoee Land Development Code set forth thereon: That certain Cambridge Village Land Use Plan prepared by Professional Design Associates, Inc. dated December 21, 1999 and stamped received by the City of Ocoee January 19, 2000. The above described Land Use Plan is attached hereto as Exhibit "C" and by this reference made a part hereof. -3- 006.166431.1 • SECTION 5. Official Zoning Map. The City Clerk is hereby authorized and directed to revise the Official Zoning Map of the City of Ocoee in order to incorporate the Initial Zoning enacted by this Ordinance and the Mayor and City Clerk are hereby authorized to execute said revised Official Zoning Map in accordance with the provisions of Section 5- 1(G) of Article V of Chapter 180 of the Ocoee City Code. SECTION 6. Ocoee Comprehensive Plan and JPA Consistency. The Ocoee City Commission hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan and the JPA Agreement. - SECTION 7.` Inconsistent Ordinances. All ordinances or parts of ordinances in conflict or inconsistent herewith are hereby repealed and rescinded. SECTION 8. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto.
