BACKGROUND: The subject property is located west of Ocoee-Apopka Road and north of Palm Drive (refer to Exhibit B, Ordinance Number 2000-09). The property comprises approximately 1.02 acres and is proposed to be developed as an automotive repair shop, if the Small Scale Comprehensive Plan Amendment (SSCPA) is approved. DISCUSSION: The subject property is designated High Density Residential (8-16 du/acre) on the City Future Land Use Map; However, a Commercial Land Use is specified on the Joint Planning Area Map. The applicant has requested a SSCPA to change the Future Land Use designation from High Density Residential to Commercial. The SSCPA will be processed concurrently with the Annexation and Initial Zoning Petition. If the SSCPA is approved, the requested C-3, General Commercial District, zoning would be consistent with the Commercial Future Land Use designation requested in the SSCPA. On November 2, 1999, the Ocoee City Commission approved the Third Amendment to the Ocoee-Orange County Joint Planning Area Agreement amending the Joint Planning Area Map for the subject property from High Density Residential to Commercial. The requested Small Scale Comprehensive Plan Amendment, if approved, will amend the City Future Land Use Map, making it consistent with the Joint Planning Area Map. Olt Protect Ocoee's Water Resources:. �jv Page 2 Honorable Mayor and City Commissioners February 1, 2000 Staff has determined that the requested SSCPA is consistent with the (1) Joint Planning Area Agreement; (2) Comprehensive Plan; (3) Land Development Code; and (4) surrounding land uses and zoning classifications. More specifically, the request is consistent with the Future Land Use Element of the Comprehensive Plan: (a) Goal 1; (b) Objective 1; (c) Policy 1.1; (d) Policy 1.5; (e) Policy 1.6; (f) Objective 2; and (g) Policy 2.4 (attached). PLANNING &ZONING MEETING: On January 26, 2000, the Planning and Zoning Commission, acting as the Local Planning Agency, held a public hearing to consider the Wood SSCPA. No one spoke in favor or opposition to the request. The Planning and Zoning Commission unanimously recommended approval of the SSCPA. STAFF RECOMMENDATION: Based upon the recommendation of the Planning and Zoning Commission, Staff respectfully recommends that the Mayor and City Commissioners adopt Ordinance Number 2000-09, changing the Future Land Use designation for the subject property from High Density Residential to Commercial, and find the SSCPA consistent with the (1) Joint Planning Area Agreement; (2) Comprehensive Plan; (3) Land Development Code; and (4) surrounding land uses and zoning classifications, subject to approval of the Annexation and execution of an Annexation Agreement. BE IT ENACTED BY THE CITY COMMISSON OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Findings, Purpose, and Intent. In adopting this Ordinance, the City Commission of the City of Ocoee ("City Commission") hereby makes, expresses, and incorporates the following findings, purposes, and intent: a. On September 18, 1991, the City Commission adopted a new comprehensive plan pursuant to Chapter 163, Florida Statutes, by adopting Ordinance No. 91-28, which has been amended from time to time (the "Ocoee Comprehensive Plan"). b. The property owner has initiated Amendment Number SSCPA-99-003 in order to amend the future land use designation of its property. c. Amendment Number SSCPA-99-003 constitutes a small scale comprehensive plan amendment within the meaning of Section 163.3187(C), Florida Statues. d. On January 26, 2000, the City of Ocoee Local Planning Agency held an advertised public hearing and recommended adoption of Amendment Number SSCPA-99-003. e. On March 7, 2000, the City Commission held an advertised public hearing and adopted Amendment Number SSCPA-99-003. f. All required public hearings have been held after due public notice in accordance with Chapter 163, Florida Statutes, and Sectionsl-8 and 1-10 of Article I of Chapter 180 of the Code of Ordinances of the City of Ocoee. 1 SECTION 2. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida, and Chapters 163 and 166, Florida Statutes. SECTION 3. Plan Amendment. The future land use designation as set forth on Figure 2 of Appendix A of the Ocoee Comprehensive Plan for the following described parcel of land containing approximately 1.02 acres located within the corporate limits of the City of Ocoee, Florida (the "Property") is hereby changed from High Density Residential to Commercial. SEE EXHIBIT "A" (METES AND BOUNDS LEGAL DESCRIPTION) ATTACHED HERETO AND BY REFERENCE MADE PART HEREOF. A MAP OF THE PROPERTY IS ATTACHED HERETO AS EXHIBIT "B" AND BY REFERENCE IS MADE A PART HEREOF. - SECTION 4. IViap Amendment. The City Planning Director is hereby authorized and directed to revise the Official Future Land Use Map of the City of Ocoee as set forth on Figure 2 of Appendix A of the Ocoee Comprehensive Plan to incorporate Amendment Number SSCPA-99-003 consistent with the provisions of this Ordinance. SECTION 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 6. Effective Date. This Ordinance shall become effective on the 31' day after passage and adoption if no affected person has filed a petition with the Division of Administrative Hearings in accordance with Section 163.3187 (3), Florida Statutes. If such a petition is timely filed, this Ordinance shall become effective on the date the Department of Community Affairs or the Administration Commission issues the final order determining that the adopted amendment, SSCPA-99-003, is in compliance. 2 PASSED AND ADOPTED this_ day of , 2000.
