BACKGROUND AND DISCUSSION: Per a memo from Martin Velie, Building and Zoning Official, and a note from the City Manager, we were advised that the subject tree is diseased and poses a serious threat to adjoining property owners. In discussions with the City Manager, he directed Public Works to have the tree removed as soon as possible. We contacted Apopka Tree Service and they provided a quote of $1,700 to remove the tree, haul all debris, and grind the stump. RECOMMENDATION: Therefore, it is respectfully requested that the Honorable Mayo and Board of City Commissioners approve the expenditure of$1,700 from the Contingency Fund for the removal of the tree. MCKEY STREET Please be advised that there is an old (approximately 150 years) tree located at 20 E. McKey Street. Also, based upon observation by myself and our Arbor Specialist, we feel that this tree is unsafe and needs the City's immediate attention for removal. The tree is in a state of disease and rot. Currently this property is owned by the City of Ocoee and is under lease by Ben Griffin. Recommendation: The City takes the responsibility of tree removal through the Public Works Department via a tree removal contractor. Littering—See Ch. 101. Solid waste—See Ch. 143. ARTICLE I General Provisions § 115-1. Conditions constituting a nuisance. [Amended 4-20-1999 by Ord. No. 99-22] For the purposes of this article, the existence or accumulation of any combination of the following conditions or things on lands within the city is hereby declared and defined to be a "nuisance and menace to public health, safety and welfare": garbage, refuse, rubbish, junk, unusable furniture, refrigerators, stoves and appliances, trash, debris, dead' diseased, decayirngp ndgun"safelcees.b ainy Ilmb or other o ion thereaf, the remains or rubble of structures which have been burned or which have been stricken by other casualty or any other noxious material of any kind or any used or scrap building materials, any of which tend to be a breeding place or haven for snakes and vermin or which tend to create any hazard endangering the lives, health, welfare and property of the citizens of the city or which tend to create fire or traffic hazards. § 115-2. Creation prohibited. • No person shall dump or cause to be dumped or place or cause to be placed on any lands or premises within the city any nuisance and menace to public health, safety and welfare. § 115-3. Prohibited acts. [Amended 4-20-1999 by Ord. No. 99-22; 11-2-1999 by Ord. No. 99-35] No person shall allow to remain or allow to be dumped, placed, accumulated or otherwise located on lands or premises owned, rented, leased or controlled by such person within the city any nuisance and menace to public health, safety and welfare, nor shall any person, after notice as provided in §§ 7-6 and 7-10 of the Code that a nuisance and menace to public health, safety and welfare exists on lands or premises owned, rented, leased or controlled by 11502 1-10-2000
