SUBJECT: USE OF FORFEITURE FUNDS FOR REPLACEMENT FIREARMS

Law Enforcement is drastically changing, with new technology emerging daily it is practically
impossible to stay current. In 1993, the City allowed the department to purchase the weapons
currently being carried by all sworn officers,with the exception of 13 newly hired officers who are
carrying the newly adopted type firearms being purchased by the department now.
Approximately two years ago,the department started purchasing Glocks model 22,.40 caliber pistols
with Trijicon night sights. The ultimate goal was to phase out the current duty firearm, the Smith
and Wesson 4043. When discussing the budget for the upcoming fiscal year, 00/01,the subject of
firearms for new officers came up and further discussion ensued. It was determined that at the rate
the department was growing and in order to keep up with the growth of the city, the phasing out of
the older weapons would not happen for many years down the road because of having to purchase
the new weapons for the new officers. Due to the wear and tear of the current weapons, Smith and
Wesson model 4043,over the years from usage by the police department,the reliability of the older
weapons are being questioned, plus the fact of uniformity for officer safety reasons.
The Glock manufacturer is allowing police agencies to purchase the Glock model 22, .40 caliber
weapon with three magazines and Trijicon night sights for a price of$434 each. They are allowing
a trade in value of our current weapons,the Smith and Wesson model 4043,of approximately$200-
250 each depending on the age and condition of the trades.
Currently, the depaitinent has the strength of sixty-one (61) sworn and five (5) auxiliary officer
positions authorized by the city; and with the anticipation of hiring five (5) additional officers in
00/01 fiscal year, this would bring us up to a total of seventy-one (71) positions including the
auxiliary officers. In addition, we would like to purchase two (2) extra weapons for spares which
brings the total number of weapons needed to outfit the entire department with the same type of
weapon to seventy three (73). Since we have already purchased thirteen (13) Glocks for the new
officers that have been hired,the number of weapons needed to be purchased is sixty(60). Leather
gear(holster and magazine holder)will cost approximately$100 per set for uniformed officers and
additional pancake type holsters for non-uniform officers at a cost of$25 per holster.

RECOMMENDATION
It is respectfully recommended that the Honorable Mayor and Board of City Commissioners
approve the use of the forfeiture funds not to exceed $32,290 to purchase the firearms and the
associated leather gear. As the Police Department has specifically requested Glock pistols, it is
requested that the bid requirement be waived. If the entire amount of monies for this purchase
are needed up front and we are reimbursed at a later date for the trade-in allowance, all monies
received for trade-in allowance shall be placed back into the forfeiture account. Currently the
forfeiture account has approximately $115,000 available.
Furthermore, it is requested that the Honorable Mayor and Board of City Commissioners declare
that our current firearms be declared surplus so that they can be traded towards this purchase.
