FLIPPEN, BUILDING AND ZONING OF ICIAL`-Aj DATE: JANUARY 21, 2000 SUBJECT: VARIANCE APPLICATION CASE NO. 02VR-99: GARLAND 622 SHERWOOD OAKS DRIVE ISSUE i Should the Honorable Mayor and Board of City Commissioners recommend approval of the subject variance application which would enable the applicant to retain two storage sheds in their present locations upon the subject property (see attached Exhibits #1 and #2, "Site Location Maps" and Exhibit#3, "Boundary Survey")? BACKGROUND/DISCUSSION The applicant constructed two (2) storage sheds upon the rear of his property (see attached Exhibit #3) without first obtaining building permits. The Staff believes that had Mr. Garland followed the correct procedure to obtain a building permit, the present process would probably not be necessary. Rather than proceeding directly to the Code Enforcement Board, Mr. Garland requested that the Board of Adjustment and City Commission "hear" his variance request for "after-the-fact" building permits that would allow him to keep the subject two sheds in their present locations. Please review Exhibit#4, which is a petition signed by many of Mr. Garland's neighbors, which was provided to buttress his request to allow the two subject sheds to remain in place. The first storage shed is a 10' by 13' aluminum structure that was erected within a 10' drainage easement and within a 7 '/2' accessory building rear setback. It was erected an estimated several years ago. The second shed being a 12' by 24' wooden structure that was erected within the - same 10' drainage easement and within a 5' utility easement. Also, shed #2 was erected within the 7 %2' accessory building rear and side setbacks. It appears to have been built in early 1999. Both subject sheds are erected in a platted 10' drainage easement which alters the stormwater flow of a publicly dedicated easement (see Exhibit#5-3) for Forest Oaks,Unit 1 subdivision. 2) BUILDING PERMIT AND SETBACK ISSUES Per the Land Development Code Article V, Section 5-1(E)(1) page 18099 and Article V, Section 5-6(B), page 18107 (see Exhibit #6), "no building or structure...shall be erected...unless in conformity with all of the regulations herein specified". "In residential districts, utility or accessory buildings will be no closer than seven and one-half (7 I/2") feet to the rear lot line and seven and one-half(7 Y2') feet to the side lot line." BOARD OF ADJUSTMENT The Board of Adjustment voted unanimously at its January 20, 2000, public hearing to uphold the Staff Recommendation. RECOMMENDATION Staff recommends that the Applicant's variance requests be denied because he has failed to demonstrate that the four prerequisite conditions prescribed by the L.D.C., Article IV, Section 4- 9(A) (see Exhibit#7), have not been met, namely: 1) There are no special circumstances and circumstances peculiar to the subject land and structures. 2) A literal interpretation of the L.D.C. provisions are necessary in order to prevent the applicant from enjoying rights that are denied to other citizens. 3) The conditions and circumstances in this case are the direct result of the Applicant's actions. He built a shed in his backyard without pulling a permit. He thought the only time it was necessary was if he was doing any physical or major construction work to his house, not his yard. We have seen this shed and feel that where it is located is the best possible spot in his yard. The space or land behind him is a greenbelt and can never be built on. The shed is well built and camouflaged by two trees for shade. The shed is serviceable from all four sides, if ever need be, say by fire, etc. There is a fire hydrant next to his house out front and plenty of room behind the fence to service it. This shed is not hurting anyone, it is not a safety hazard to the public, and it doesn't look like it will hurt any neighboring property values, if anything it will help. Mr. Garland has worked on this project for about one year in his spare time. If he had to move the shed it wouldn't look right and he would be using most of his yard for the shed. His yard is small and these homes don't have much storage so he needed this space. None of us have any near or future plans that would require a similar variance. Because this shed is well built and located in a good place in his yard,we, the neighbors of the Garland residence are hoping the City of Ocoee can assist us in helping Mr. Garland keep his shed where it is. To the extent that such will not impair the overall drainage capability of a site and is otherwise feasible, natural drainage features should be maintained during the development process. § 6-8 UTILITIES. A. Potable Water Supply. • (1) General. Each lot within a subdivision shall be provided with a connection to an approved central water supply system. The development of new water facilities and mains, and the expansion of existing water systems, shall be designed by the project engineer in accordance with all applicable state and local criteria. Systems designed for connection to or Inclusion within the City of Ocoee water system shall be in accordance with City standards and specifications. • (2) Central water systems. Central water systems shall be designed to satisfy the domestic water supply and fire protection requirements for the area and shall be designed and constructed for an economic life of not less than fifty(50)years. The City Engineer shall have the right of final design review approval and inspection of all extensions to the City of Ocoee's central water systems. (3) Fire protection (water supply). (a) General standards.. The water system shall be designed and constructed to satisfy both the domestic potable requirements and the fire protection requirements. Fire hydrants and shut-off valves shall be of the type, size, and brand specified by the Southeastern Underwriters' Association and approved by the City of Ocoee Fire Department. • (b) The on-site water distribution system for each new subdivision shall be connected to a looped water main of six(6) inches minimum diameter size. • 1. An attached or detached private garage which faces on a street shall not be located closer than twenty-five (25) feet to the street right-of-way. • § 5-5 HEIGHT The following requirements are intended to, or qualify and supplement, as the case may be, the specific district regulations set forth in this Article: A. Chimneys, elevators, flues, spires, tanks, towers and other projections not used for human occupancy may not extend more than 10% above permitted height limits in each zoning district without receiving a variance. B. The Board of Adjustment may recommend and the City Commission may permit buildings in certain zoning districts to exceed the height limitation of the district if the minimum depth of front and rear yards and the minimum width of the side yards required in the district are increased one foot for each two (2) feet by which the height of such structure exceeds the prescribed height limit, and the increased height will otherwise have no adverse effect on adjacent development and is in keeping with the overall character of the area. § 5-6 LOCATION AND CONSTRUCTION OF PRINCIPAL AND ACCESSORY STRUCTURES A. Construction and Use of Accessory Structures. • No accessory building shall be constructed upon a lot until the construction of the main building has been actually commenced,and no accessory building shall be used unless the main building on the lot is also being used. B. Location of Accessory Uses and Structures. • In residential districts, accessory uses and structures shall not be located in front or side yards but may be located in rear yards; provided, however, that accessory structures for - the housing,of persons, such as guest houses and garage apartments,shall not be located ' in any required yard. On double frontage, through or corner lots in residential districts, accessory uses and structures shall not be located in either of the required front yards but may be located in one but not-both side-yards. Adopted July 21, 1992 18107 E !7/a/T TT 6- ARTICLE IV (3) The proposed uses and structures would net violate the health, safety, welfare, and/or convenience of those residing, working or owning land in the vicinity of the • proposed use or structure, specifically with respect to: (a) The use or structure would not exceed the applicable density or bulk regulations except as specifically authorized, nor shall the use or structure result in overcrowding of land or buildings; (b) The use or structure would not impair pedestrian or vehicular movement in adjoining streets so as to violate adopted level of service standards; (c) The use or structure would not create a fire hazard; (d) The use or structure would not result in noise, odor, glare, vibration, or other similar characteristic which is detectable at the property line and which exceeds the level which will result from permitted uses; (e) The use or structure would not prevent an adjoining landowner from the legal use of his property pursuant to this Code; (f) The use or structure would not violate a requirement of limitation of any applicable state or federal law or regulation, and; (g) The use or structure would not result in the inadequacy or inability of any public facility or service to meet adopted standards. § 4-S VARIANCES The Board of Adjustment may recommend and the City Commission may grant a variance from the terms of these regulations when such variance will not be contrary to the public interest and where, owing to special conditions. a literal enforcement of the provisions of these regulations would result in unnecessary hardship. Such variance shall not be granted if it has the effect of nullifying the intent and purpose of these regulations. Furthermore. such variance shall not be granted by the City unless and until: CjApplication A written application for a variance is submitted with the application fee demonstrating: (1) That special conditions and circumstances exist which are peculiar to the land, structures, or required subdivision improvements involved and which are not applicable to other lands, structures, or required subdivision improvements; (2) That a literal interpretation of the provisions of these regulations would deprive the applicant of rights commonly enjoyed by other properties with similar conditions; (3) That the special conditions and circumstances do not result from the actions of the applicant; (4) That the granting of the variance requested will not confer on the applicant any special privilege that is denied by these regulations to other lands, structures, or required subdivision improvements under similar conditions_ No pre-existing conditions of neighboring,lands which are contrary to these regulations shall be considered grounds for the issuance of a variance. iX /Sir 7-I Adopted July 21, 1992 18093 • ARTICLE IV B. ' Findings The Board of Adjustment shall make findings that the requirements of this section have been met: (1) A public hearing on the proposed variance shall be held. The public hearing may. be held prior to or simultaneously with the public hearing for approval of the Preliminary Plan. Both the Board of Adjustment and City.Commission public hearings must be advertised in a newspaper at least seven (7) days before each hearing. All property owners within 300 feet of the subject property must also be notified by mail at least seven (7) days prior to the hearing date. This notice may include information on both the Board of Adjustment and City Commission hearings if the item goes before both Commissions. If the hearing information for the City Commission meeting is not available at the time the notices must be sent far the Board of Adjustment meeting, a second notice to property owners must be mailed seven (7) days before the City Commission hearing detailing the meeting time, place, and other particulars. (2) The Board of Adjustment shall further make a finding that the reasons set forth in . the application justify the granting of the variance which would make possible the reasonable use of the land, buildings, or other improvements. (3) The Board of Adjustment shall make further finding that the granting of the variance would be in harmony with the general purpose and intent of these regulations, will not be injurious to the surrounding territory, or otherwise be detrimental to the public welfare. C. Board of Adjustment and City Commission Action In recommending any variance, the Board of Adjustment may prescribe appropriate conditions and safeguards in conformity with these regulations and the City Commission may approve such conditions. Violation of such conditions and safeguards when made a part of the terms under which the variance is granted, shall be deemed a violation of these regulations and Chapter 65-2015, Laws of Florida. § 4-10 DEVELOPMENT AGREEMENTS A. Intent and Purposes Development Agreements are agreements which may be entered into by a landowner and/or his or her agent and the City Commission consistent with the provisions of Sections 163.3220 through 163.3243, Florida Statutes, for one or more of the following purposes: (1) To provide for a longer time period for performance under this Code. (2) To guarantee that the regulations existing at the time of execution of the development agreement shall govern the development for the duration of the agreement, except as specifically restricted herein.
