VARIANCE APPLICATION SIGNAGE
ISSUE
Should the Honorable Mayor and Board of City Commissioners approve the subject variance
application that would enable St. Paul's Presbyterian Church, Inc., the opportunity to build a site
identification sign along its West Colonial Drive property frontage (see attached Exhibits "1-3",
"Site Location Maps")?
BACKGROUND/DISCUSSION
The Applicant, St. Paul's Presbyterian Church, Inc., desires to erect a thirty-six (36') square foot
dual pole site identification sign (see Exhibit #6, Amended 2-18-00) along its West Colonial
Drive frontage; however, the road right-of-way for West Colonial Drive and adjacent private
property slopes steeply into the "Seven Lakes Wetland". The Applicant has, therefore, applied
for two variances from the provisions of Ordinance No. 99-23, commonly referred to as the
"Activity Center Regulations", "Signage Design Standards", "Free-Standing Ground Signs", (see
Exhibit#4 and#5).
VARIANCE ONE
Sub-paragraph (c)(i) states that "Free-Standing ground signs...shall not exceed 12 feet in
height." Due to the previously mentioned steep slope of the West Colonial Drive right-of-way,
the Applicant is requesting a twenty-four(24') foot sign height above ground level,which will be
no more than twelve (12') foot above the adjacent paved surface (see Exhibit#3).

VARIANCE TWO
Sub-paragraph (c)(iii) states that "No part of any free-standing ground sign shall be located
closer than 10 feet away from public right-of-way..." Again, due to the steep slope of the West
Colonial Drive right-of-way, the Applicant is requesting a five (5') foot setback to help reduce
the overall sign height.
BOARD OF ADJUSTMENT
The Board of Adjustment at its February 17, 2000, public hearing voted unanimously to
recommend the approval of both of the required variances.
RECOMMENDATION
Staff recommends approval of the requested variances to the two cited provisions of Ordinance
No. 99-23 because the road right-of-way conditions that necessitated the hardship requests are
beyond the control of the Applicant and are not self-created. Secondly, the two requested
variances have been reviewed by Staff and are deemed minimal departures from the Code in light
of the existing circumstances which will not injure the public health, safety, and welfare and are
consistent with the overall intent of the"Activity Center Standards".

All signs shall be designed and selected to provide a logical consistent,and attractive pattern of advertising that relates
to the human-scale, attractively identifies businesses,and conveys an understandable message when viewed in
conjunction with adjacent sions and landscaping. Certain minimum sign standards have been set to promote quality
signs of a design, size, and orientation that enhances the community. Other sign regulations shall be as set forth in
Article VIII of the Land Development Code unless otherwise specified below. Not withstanding any provision in the
Land Development Code to the contrary,all interpretations reaardingthe conformity of signs located within professional
office, service, commercial, and industrial areas shall be made by the Director of Planning or his designee whose
administrative interpretations may be appealed to the Development Review Committee. In the event a person
disagrees with an interpretation or decision made by the Director of Planning,then they may request a meeting of the
Development Review Committee which will be held within 7 working days from the date of receipt of a written request.
All such appeals shall be filed with the Director of Planning. The Development Review Committee may overrule or
modify the interpretation or decision made by the Director of Planning.

• a. Prohibited Signs
(i) Roof top signs, electronic/message board signs, flashing signs and
moving signs are prohibited.
(ii) Banners, streamers. pennants, scintillating lights, strobe lights, and
revolving signs are prohibited.
' (iii) No neon lighting or mini-lights shall be permitted as an adornment on
any building,except asgart of an approved sign.
(iv) No portable signs, trailer signs, signs painted on vehicles parked
adjoining public streets,sandwich board signs,or signs painted upon
benches are permitted.
b. Permitted Signs - Only free-standing ground, wall, arcade, projecting,
shopping center and business center signs are permitted in accordance
• with the provisions set forth below. All other signs, including non-verbal
signs that do not qualify as public art,shall not be permitted.

(ii) Free-standing ground signs shall be limited to a maximum allowable
copy area of 36 squuare feet, except that multiple-user signs may be
permitted at shared entrances up to 70 square feet in total size in lieu
of individual signs for two outparcel uses and 100 square feet in total
size in lieu of individual signs for three outparcel uses. Permitted sign
areas are allowed on both sides of a double-faced signs,

d. Wall Signs
(i) The maximum allowable area of wall signs for individual businesses
shall not exceed the following standards regardless of building

stand-alone business structure located on an outparcel or separate
tract shall not exceed 1 s.f.per lineal foot of building frontage facing
the primary street. On corner buildings, an additional 1 s. f. per
• lineal foot of building frontage facing the secondary street may be
permitted. Sign area shall not be combined between building
frontages.
(iii) Subject to the maximum allowable standards specified in d.(i)above,
the maximum allowable area of wall signs f • ' 'dual businesses

SUBJECT: PROPOSED SIGN ON WEST COLONIAL DRIVE
The proposed sign for the St. Pauls Presbyterian Church will be located as follows:
1) Setback 5 feet from north property line which is adjacent to the West
Colonial Drive right-of-way(front yard setback).
2) Setback 15 feet from the west property line (side yard setback).
3) Setback 72 feet from the east property line(side yard setback).
4) Top of sign will be 24' above existing grade(overall length)
A 5) Top of sign will be 12' above West Colonial Drive edge of pavement.
6) Face of sign will be 36 square feet.
7) Entire sign will be constructed of metal.
8) Design of sign will be 120 miles per hour wind load.
9) Sign will be internally illuminated.
