SUBJECT: Vehicle and Material Storage Building
Contract Construction Management/Inspection Services
The construction of this facility requires an inspection expertise that the Engineering and
Utilities Departments do not have within their current experience. Although the Building
Department will be utilized for all the required building inspection services, they do not provide
construction management/administration, shop drawing review and inspection services for the
site work portions of the project. The work in this project generally includes: (1) part time
construction observation and shop drawing review to ensure the project is constructed in
conformance with the plans and specifications and (2) assist the City in the construction
administration of the project.
The Engineering Department is administering and providing construction observation on six City
projects as well as numerous development type projects throughout the City. In the near future,
we will be assisting Professional Engineering Consultants, Inc. with the Maguire Road Project,
which will take one inspector full time for approximately two years.
Mr. Harlow has been working for PEC, Inc. as a contract employee providing resident project
inspection services on the Reuse Pumping and Storage Facilities. That project is basically
complete and therefore PEC's contract for resident project inspection services is almost finished.
The City approached PEC about extending their contract to include this project and they declined
since it was not one of their projects.
Mr. Harlow has worked for numerous consulting firms and government entities providing
contract services for resident project inspection and administration services. He has provided
excellent in the field services for the City through PEC, Inc. on the Reuse Project. By directly
employing Mr. Harlow, the City is realizing the savings on the markup and additional services
provided by a consultant. The City will be providing any assistance that he would require. Mr.
Harlow is a Registered Professional Engineer and will assume liability on the construction
integrity at completion oft he project.

The program is estimated based upon an average of 25 hours per week for the duration to
complete the project. See the attached proposal and resume from Mr. Harlow. The not to exceed
total is $39,875. The City will be responsible for the City's share of Social Security (7.65%) and
Worker's Compensation (0.63%) benefits only, based upon the terms of contract employment.
Therefore,the not to exceed cost for this contract employment will be $43,200. The employment
contract will terminate on October 31, 2000. The costs for this work will come from the 1997
Utility Bond Issue.
I recommend that the City Commission approve the contract employment of Mr. Phil Harlow to
provide contract services for project construction inspection and administration for the not to
exceed amount of$43,200 for the Vehicle and Material Storage Building Project and authorize
Mr. Shapiro to execute the Employment Agreement.

I am pleased to present this proposal in response to your recent verbal request
for services. I will provide Resident Project Representative Services, as further defined
below for an amount not-to-exceed $39,875.00. The proposed scope of services
includes:
1. RPR inspection services of 725 hours, 25 hours per week, average.
2. Attend or conduct monthly construction meetings.
3. Review and file all shop drawings.
4. Process Requests for Information (RFI's).
5. Assist with Proposed Change Orders (PCO's).
6. Review and approve Contractor's Pay Requests.
7. Conduct substantial and final inspections.
8. Professional Liability Insurance in the amount of $1,000,000.00.

PROFESSIONAL EXPERIENCE
• Resident Engineer and Inspector on a 3 million dollar project with 3
pumping stations, storage tanks and roadway.
• Consulting Engineer to the City of Kissimmee on two wastewater treatment
plant expansion projects valued at 14 million dollars. Duties: submittal review,
clarification, schedule monitoring, verifying payment quantities, overseeing
inspectors,chair progress meetings;coordination between city, design engineers

County, Solid Waste Authority. Activities: Resident project engineering,

• Resident Project Representative on a wastewater treatment facility and effluent
pumping stations for the City of Kissimmee. Activities: Overseeing the work of
up to three city inspectors working on the wastewater treatment plant and
ancillary projects, totaling approximately $25 ,000,000 in construction cost.
• Design of blower building equipment,yard and interior piping layouts for a 20
million dollar wastewater treatment plant process conversion project. My design
portion of this project included approximately 10- 24 x 36 drawings and ovei 20
technical specification sections.
• Mechanical/Electrical Project Coordinator for a new whale stadium. The
project included a complex life support system with a reverse osmosis filtration
system,designed by my subsequent employer(PBS&J ). Activities: shop drawing
review,field inspection,technical liason, and coordination of the mechanical and
electrical subcontractor's work forces with the general contractor's forces.
• Resident Project Representative for construction additions at a remote plant
site. Projects induded:2-6000 sf building additions, a 52,000 sf industrial/office
building, a 2000 sf chemical storage building, renovation of a printed circuit
board plating area, a class 10,000 clean room, and installation of production
assembly lines.
• Proposals Engineer for coordinating the preparation of bid proposals, assisting
in negotiating new contracts, and modifying existing cost plus contract terms.
These contracts were for projects from $100,000,000 to $500,000,000 in value.

EMPLOYMENT AGREEMENT
COMES NOW, Phillip E. Harlow. P.E., (hereinafter referred to as Contract Employee)
and the City of Ocoee (hereinafter referred to as the City) and enter into the following
agreement.
1. The City of Ocoee and the Contract Employee enter into this Employment Agreement
subject to the conditions and considerations set forth below and shall terminate at the end
of October 30, 2000, unless extended in writing by the City.
2. During the period of this contract, the Contract Employee shall receive $55.00 hourly and
will be paid in accordance with the Fair Labor Standards Act. The employee will be an
hourly employee.
3. During the period of this contract, the Contract Employee shall do that work assigned to
him by the City Engineer/Utilities Director and shall perform in an adequate and
acceptable manner. The Contract Employee shall serve at the will of the City and the
City may terminate this contract at any time for any reason, consistent with the applicable
law. In the event the City terminates this contract, it shall make reasonable efforts to give
the Contract Employee at least two (2) weeks notice; however, such notice is not required
in case of operational inconvenience.
4. Not less than thirty (30) days prior to the termination date of this contract, the Contract
Employee shall advise the City as to whether he wishes to be considered for an additional
contract period. The City, at its option, may discuss future employment upon mutually

acceptable conditions. Nothing herein shall create any obligation on behalf of the City to
renew a contract of employment or to employ Contract Employee except as provided
herein, such notice is not required.
5. As a Contract Employee, Contract Employee recognizes and agrees he will not receive
any fringe benefits, and shall be entitled only to the pay as set forth in paragraph two (2)
above.
6. Work to be accomplished is in accordance with the attached letter from Mr. Harlow to the
City of Ocoee which details the work task for this project.
7. Activation of this contract will only take place upon approval of the City Commission.
