SUBJECT: DISPOSITION OF SURPLUS PROPERTY - 703 CALIFORNIA AVENUE
The letter from Mr. Dabbs indicates his interest in the property located between
Montgomery Avenue and Chicago Avenue, and was last discussed as a possible Fire
Station site earlier this year.
The first decision the City Commission should make is whether they still want to sell the
land as surplus property. If they do then City Attorney Paul Rosenthal's comments
should be reviewed and followed.
If you do not wish to sell the property and it is not needed by the Utility Fund, then we
should also discuss whether the General Fund should buy the property from the Utility
Fund so that the rate payers are paid for the asset.
We will answer any further questions you may have at your convenience.

RE: Disposition of Surplus Property at 703 California Avenue
The City is the owner of a vacant tract of land located at 703 California Avenue. This
land is an asset of the Wastewater Utility Fund and has previously been declared surplus by
the City. In 1996 the City obtained an appraisal which valued the parcel at $83,200. By Bid
No. B97-05 the City attempted to dispose of this property through a competitive bidding
process in late 1996. The City did not receive any response to the request for bids.
The City has now received an inquiry from a person interested in purchasing the
property at 703 California Avenue. Jim Shira has confirmed that the Wastewater Utility Fund
has no reason to retain this asset. You have requested that I advise you regarding the
procedures for the disposition of this property.
The City Charter requires that the City cannot approve the sale or other disposition of
property owned by the City for a price below the City's estimate of the fair market value
thereof. Further, any proposal for the disposition of property owned by the City which has a
fair market value in excess of $100,000 must be approved at an advertised public hearing.
There is no specific requirement that the disposition of real property be by competitive bids,
but it has been the practice of the City to dispose of surplus real property by competitive bids.
As indicated above, the last appraisal obtained by the City was a 1996 appraisal. In my
opinion, that appraisal is too old to serve as a basis for the determination of the property's fair
market value. Further, it is possible that the property has appreciated to a price in excess of
$100,000 which would require a public hearing prior to disposition. In the event the City is
interested in disposing of the property, it is my recommendation that a new or updated
appraisal be obtained to determine the current fair market value. Further, it would be my
recommendation that the City should then seek new bids with respect to the sale of the
property since it has been over three years since the City last attempted to dispose of the

property. If no bids are received, then the City could consider the disposition of the property
through a negotiated sale or the listing of the property with a real estate broker.

Dear Ellis:
I wish to express my interest in property owned by the City of Ocoee, which was
advertised for sale and no bids were received. This property is the old sewer plant
sprayfield located in east Ocoee between California and Montgomery Avenues. I have
reviewed the documents made available to me and believe the property meets a family
need.
It is my understanding this property can be purchased without re-bidding as per Florida
Statutes and the Charter of the City of Ocoee. Please advise me of the procedures I
need to follow in order to consummate the purchase of the property.
Your cooperation in this matter is sincerely appreciated. I look forward to your
response at your earliest convenience.
