We feel that if certain streets and alleys were marked Fire Lane, No Parking and Tow-away Zones in conjunction with Chapter 168-3.1 that violators would reconsider parking in these zones. The attached Ordinance allows the City the right to tow vehicles on City streets and highways designated as Fire Lanes. This Ordinance does not apply to private property. The towing of vehicles in these zones would be in accordance with Chapter 165-9 of the City of Ocoee Code. DATE: August 6, 1997 RE: Towing of Vehicles in Fire Lanes Please find attached a proposed ordinance allowing the towing of vehicles in fire lanes. This ordinance applies to vehicles on streets and highways, not private property. It would be part of Article I of Chapter 168 of the Code and other provisions therein would be applicable to the enforcement of this new section. BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2 . A new Section 168-3 . 1 of Article I of Chapter 168 of the Code of Ordinances of the City of Ocoee, Florida, is hereby adopted as follows: 168-3 . 1 Parking in fire lane prohibited. A. No person shall stop, park or leave standing any vehicle, whether attended or unattended, upon any highway or street designated as a fire lane by the city Fire Chief or his designee. B. Whenever any police officer finds a vehicle standing upon a highway or street in violation of the foregoing provisions of this section, the officer is authorized to provide for the removal of such vehicle to the nearest garage or to the storage area of any person, firm or corporation who has contracted with the city, as provided in § 165-9 of the Code. SECTION 3 . Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 4 . Codification. It is the intention of the City Commission of the City that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City; and that sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "chapter" , "section" , "article" , or such other appropriate word or phrase in order to accomplish such intentions; and regardless of whether such inclusion in the code is accomplished, sections of this Ordinance may be renumbered or relettered and the correction of typographical errors which do not affect the intent may be authorized by the City Manager, without need of public hearing, by filing a corrected or recodified copy of same with the City Clerk. SECTION 5 . Effective Date. This Ordinance shall become effective immediately upon passage and adoption. 2 PASSED AND ADOPTED this day of , 1997 .
