Intersection Improvements Project
Change Order Request No. 5
Attached for your review is Change Order Request No. 5 on the Story Road/Kissimmee Avenue
and Marshall Farms Road/Maguire Road Intersection Improvements Project with Southland
Construction, Inc. This change order request was initiated by City staff to enhance the project,
allow for slope stabilization at some drainage structures, comply with the negotiated agreement
with Mr. Adams, reimburse the City for utility system repairs, and provide some enhancements
to the project's appearance.
The items included in this change order are:
No. 5-A - Slope Stabilization at the Maguire Road Outfalls
The original design provided for a discharge into a ditch that drained approximately twenty feet
into the receiving waters. Change Order No. 3 included the extension of the discharge piping on
both sides of the street to the receiving waters and two structures. After the installation of the
structures, it was determined that some slope stabilization would be required to hold the bank in
place at each outfall. The initial concept was significantly scaled back do to cost considerations,
with the final plan calling for compacted fill held in place with stacked and reinforced cement
bags. The cost for this slope stabilization at the Maguire Road outfalls is $2,373.36, with an
increase in contract time of one day.
THE PRIDE OF WEST ORANGE
No. 5-B - Guardrail and Slope Stabilization at the Geneva Street Outfall
The original design called for the outfall to be a mitered end section with riprap at the receiving
water. After the installation of the piping, structures and riprap, it was determined that a
guardrail would be needed to prevent any possible serious vehicular accidents into the ditch. To
install the guardrail the bank would need to be regraded and require stabilization against
washouts. Approximately 135 linear feet of guardrail will be installed along the southern side of
Geneva Street at the Stuchi Ditch and the bank will be stabilized with stacked and reinforced
cement bags. The cost for this guardrail and slope stabilization is $8,152.22, with an increase in
contract time of one day.
No. 5-C - 8" Water Main to Adams Manufacturing, Inc.
The agreement between the City and Adams Manufacturing, Inc. for the additional right-of-way
on Kissimmee Avenue required the City to install an 8" water main across Kissimmee Avenue to
provide improved water service to Adams Manufacturing, Inc. This requirement was not
included in the original design of this project because the agreement was not completely
negotiated and executed until months after the start of construction. The cost for the 8" water
main for Adams Manufacturing is $3,957.72, with an increase in contract time of two days.
No. 5-D - Ditch Bottom Inlet at the Horse Farms
The original design provided for a mitered end section on the north side of the driveway into the
horse farm. After the construction of the new roadway in this area, staff determined that a
different drainage structure would be required to meet new grade elevations and enhance
drainage. After discussions with the design engineer, it was decided to install a ditch bottom
inlet which would match the new grading and improve the drainage characteristics at this
location. The cost for this additional structure at the driveway to the horse farms is $1,600.00,
with no increase in the contract time.
No. 5-E - Driveway Changes for Amber Electric and Run-About-Car Lot
In the original design, additional driveways were included at the request of both property owners.
These additional driveways were based upon the possible site enhancements proposed by both
property owners. As construction proceeded and in discussions with both property owners about
the effects of the project construction on their businesses, staff talked with them about the
driveways. Both property owners proposed new driveway layouts that reduced the number of
driveways on Kissimmee Avenue and Geneva Street. This change resulted in a decrease in
construction costs. The reduction in costs for these driveway changes for Amber Electric and
Run-About-Car Lot is $1,009.50, with no increase in the contract time.
No. 5-F - Substitute of ABC Asphalt for Limerock Base Material
The original design for the roadway called for stabilized subgrade with limerock base for a
support base to the asphalt courses. At two locations, west end of Story Road and north end of
Kissimmee Avenue, it was decided to substitute "ABC type" asphalt for the subgrade and
limerock to eliminate the additional traffic constraints that would be caused by the construction
of the original design. Each of these areas is at the ends of project on these two streets and
would require one lane closure/construction and three days of"setup"time to meet the original
design. Each location would require a total of six days to completed the work. Staff
recommended the design change and agreed to pay for the increase in cost for material only. In
addition it has allowed the contractor to catch up on some of the rain delays which he is entitled
to under the conditions of the contract. The cost for this substitute material at these two locations
is $2,145.50, with no increase in the contract time.
No. 5-G - Reimbursement for Sewer Repairs
In the performance of construction activities on Kissimmee Avenue, Southland Construction
Company damaged the City's forcemain. Although Southland had equipment and material
available to perform the repairs, the City provided labor to shutdown/startup our system and
provide emergency pumping of some lift stations while the repairs were performed. Southland
agreed to reimburse the City for this assistance. The cost of this assistance will reduce the
contract amount by $1,339.62.
The total cost for this change order is $15,879.68 with a time extension of four days on the
contract time. The dollars for this change order will come from the project's construction
contingency. This change order amounts to approximately 1.36 percent of the original bid price
of$1,163,718.10. The total cost for all change orders, to date, will transfer$121,209.02 from the
construction contingency to Southland's contract. The $30,000 difference between the actual
amount and the City's share is a reimbursement from Sprint Telephone Company. To date
approximately 10.42 percent of the 10.0 percent construction contingency has been committed to
the project.
I recommend that the City Commission approve Change Order No. 5 with Southland
Construction, Inc. by increasing the contract amount by $15,879.68, with an extension in
contract time of four days, and authorize the Mayor and City Clerk to execute Change Order No.
5.

CHANGES ORDERED:
I. GENERAL
This change order is necessary to cover changes in the work to be performed under this Contract. The
GENERAL CONDITIONS, SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and all parts of the
Project Manual listed in Article 1,Definitions,of the GENERAL CONDITIONS apply to and govern all
work under this change order.
II. REQUIRED CHANGES
Extension of Contract Time. By this change order Section 00500,Agreement Article 3 Contract Time shall be
modified as follows: 3.1 will be amended to ready within 237 consecutive calendar days of the effective date of the
Notice to Proceed.
III. JUSTIFICATION
Item 5-A. RFP No.23. The slope stabilization measures constructed to date in these two areas did not provide a
sufficient level of protection from erosion. $2,373.36, 1 additional day
Item 5-B. RFP No.24. The original plan for this area did not include provision for a guardrail. With the
reconstruction and widening of Geneva Street it is anticipated that traffic will increase and speed will pick up.
Hence installation of 100±LF of guardrail just north of the drainage ditch seems prudent. Included in this proposal
is the installation of sand cement rip rap for additional slope protection. $8,152.72, 1 additional day.
Item 5-C. RFP No.25. This work is to satisfy an obligation to the landowner that was included in the agreement
with the city for additional right-of-way. $3,957.72,2 additional days.
Item 5-D. RFP No.26. The installation of this ditch bottom inlet will allow the grades in this area to be raised
substantially. $1,600.00.
Item 5-E. RFP No. 27. Two of the landowners in this area opted to delete a planned driveway to their property in
return the drives that will be constructed will be wider than originally designed. The net effect to the city is a credit
of$1,009.50.
Item 5-F. RFP No.29. Allowing the contractor to use asphalt base material instead of Dura Rock in these two areas
provides a means of keeping two lanes open for traffic,versus a one lane only situation that would last for seven
days. The benefits to the city are a safe and smooth flow of traffic through a construction area and a shorter period
of inconvenience to the public.
Item 5-G. This item provides reimbursement to the city for costs incurred for repairing damage to the sanitary
sewer force main in Kissimmee Avenue.
IV. NARRATIVE OF NEGOTIATIONS
Item 5-A. RFP No.23. In discussions with the contractor,he agreed to provide the sand cement rip rap at$275 vs
$325 cy. This reduced the cost to$2,376.36.
Item 5-B. RFP No. 24. This item was priced and repriced by the contractor. The price went from$9,960.22 to the
agreed upon final price of$8,252.22.
Item 5-C. RFP No.25. This item of work was priced several times. The$2,957.72 figure represents the final
agreed upon cost.
Item 5-D. RFP No.26. $1,600 is the final negotiated price.
Item 5-E. RFP No.27. This$1,009.50 reflects the reduction in the scope of work required.
Item 5-F. RFP No.29. This cost is a negotiated figure and represents a premium for material costs only.
Item 5-G. This dollar amount represents actual costs incurred by city forces.

contract other than matters expressly provided herein.
CONTRACTOR acknowledges,by its execution and acceptance of this Change Order,that the adjustments in
Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and
modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other
claim for increased costs of performance or modifications of time will be granted by the OWNER for the Work
covered by this Change Order. The CONTRACTOR hereby waives and releases any further claims for cost or time
against the OWNER arising from or relating to the matters or Work set forth or contemplated by this Change Order.

Dear Keith:
The letter attached is a listing of personnel and equipment utilized by the city to repair the
force main in Kissimmee Avenue that was damaged during the mixing operations on June 18,
1997. The $1,339.62 figure represents the costs incurred by the city as a result of the damage.
I feel that the most expedient method of reimbursement to the city is through a deductive
Change Order item.
