SUBJECT: Amber Ridge Subdivision
Landscaping Replacement
The initial action by Staff began prior to 1995 when drainage problems were identified in the
subdivision. This area was included in the Stormwater Drainage Problem Areas as listed in the
PEC, Inc. report which was first submitted in September of 1995. This area was identified in
that study for drainage improvements and placed in a high priority position for correction.
The original plan called for the City to perform drainage improvements within the portion of the
development bounded by Key Lime Street, Licaria Drive and Hedgerow Circle and between
Licaria Drive and Satin Leaf Circle. These improvements would include the installation of
underdrains and yard drains to aide in the collection of stormwater runoff. The original
developer agreed to be responsible for the replacement of landscaping for the affected property
owners in these areas. Unfortunately, shortly after the developer agreed to the landscaping
replacement program, the company went out of business and the major partner died. Therefore,
the City took it upon itself to perform the landscaping replacement,too.
Since that time the City embarked on a comprehensive Capital Improvement Program. The
overall program was presented to the City Commission and the Phase 1 projects were approved
for implementation. Included as a part of that overall program authorization was the landscaping
replacement with the intent that the financing would come from the utility contingency fund
when implemented. Exact costs were not identified because of the delays and the timeframe for
completion of the Amber Ridge construction improvements.
The attached memorandum, dated November 28, 1995, by Alice Tate-Barnett listed the
landscaping to be replaced and representative costs at that time. After researching the possible
costs to bring those prices to current dollars, those costs were determined to still be accurate. It

was determined that ten property owners were significantly affected and included in the
replacement program.
Fossitt Groundwork, Inc. was contracted to perform the installation of the underdrains in the
problem areas in the Amber Ridge Subdivision. That work has been completed and the contract
has been held open to include any work which they may be able to perform in completing this
landscaping replacement.
On July 7th, Staff met with most of the property owners and discussed alternatives to bringing
this issue to a closure. The main alternatives discussed were: 1)the City or its representative to
perform the replacement; 2)the City to purchase the landscaping and the owners to install; and 3)
the City to reimburse the owners for the lost landscaping and then they do the work at their
leisure. Many of the property owners have already replaced some or all of the lost landscaping.
Therefore, the consensus was to accept an offer of reimbursement at the value established in the
memorandum as a final solution to the landscaping replacement. With the assistance of Mrs.
Susan Falls, contact was made with the owners who were unable to attend and they agreed to the
same resolution.
One owner, Mr. And Mrs. Arthur Joseph, requested that the City supplement three Queen Palm
Trees which had not been included on the original listing, for the listed plants, with the City to
contract installation. One owner, Mr. Richard Harwood, requested that the City effect the sod
replacement because of his work schedule. These two exceptions will not increase the cost
above the project dollars listed in the original memorandum.
I request that the City Commission approve this expenditure of$10,000, which will now come
from the Stormwater Contingency Fund, to affect the resolution of the landscaping replacement
in the Amber Ridge Subdivision.

At your request, attached is a copy of the memo I sent to Ellis regarding the
replacement plants requested by the residents. Also attached are copies of the
maps with the lot numbers in question highlighted.
I talked with Mrs. Joseph, 2006 Key Lime Street, this week and she has already
replaced 1 Arizona Cypress and 1 Canary Island Date Palm. She requested that
we give her 1 Queen Palm, 15' to 20' tall in their place.
Please let me know if I can provide further information.
